[Resolved]  Toplite Holidays — Fraud- Not Cancelling the Membership

My wife and I got caught in a scam of Toplite Holidays Private Limited Company on 27th November, 2021 in Goa.
We were going on bike and stopped the bike to ask the address. But our luck was very bad that day. The person to whom we ask for address, that person was the company hired man, he told us about his hotel anniversary that today is his hotel anniversary so he has a proposal for couples in which two cards will be given, if we become winners then we will get gifts at their hotels, by opening the cards she become the decided winner. We got caught in his trap and went to his 4 Star hotel. One of their condition was that they would scratch the card after we walk around the hotel and Know about their membership. We went to the hotel and then they took us to a room where all the couples were already seated. We were also seated and explained how we can save both our money and time by subscribing to this company. Amisha and her manager through his list explained to us about the places to visit around the world, then showed us some pictures of couples traveling to different places across the world through this subscription. We also decided to take the plan, we found this plan easy and affordable as it covers both national and international tours.
We are fully promised that we will get free pickup and drop facility, 4*, 5* hotel, and some maintenance charges per alternate year if we will travel through it, and nothing more. We decided to take an alternate 5 years plan which was of Rs.40000. I do not have credit card so they told me to use my Debit card. I had less money in my debit card, so we were offered EMI. Asked to do EMI from debit card but due to slow internet, he converted EMI from his laptop. We were not even given a chance to read the agreement and they took our signature. In all conversation they didn't told us that we can not cancel our membership in near future.
we came to our hotel and read the review of the company, there were many negative comments regarding membership, we understood that we were caught in its trap. I am following up with them since December to cancel my membership, but they are denying it and saying that we can not cancel your membership. Since January they started to deducted my EMI. Even I ask to hold for some year and do not deduct my EMI but they are not ready on that as well. They are saying that for deduction of your EMI contact your bank. Even I contact my bank also, they are also not ready to cancel my EMI. They are saying that take confirmation from Toplite company to cancel my membership, then only they cancel my EMI.
Now, they are replying same thing om mail that we can not cancel your membership, we want to cancel our membership and want our money back.
I humbly request to Indian government & Tourism Ministry of GOA please look into the matter and ask this company to return the payments. These Highly Organized frauds with Honest & Innocents Tourist.

Dear Sir,
With Due respect we find this allegation done completely baseless as you have already singed and read the agreement with the firm where all the points you mentioned has been clearly written.
Secondly even after you had spoken to the Customer Care the team had clearly informed you on mail as well as on the calls that your membership is active and as the agreement is non cancelable non refundable. Since you had requested the firm to provide you a resolution wherein you will not be able to take the holidays for 2-3 years since you are planning on to your future aspects the firm had provided you an option wherein you will be able to hold your membership for 3 years and utilize it later. when the firm gave you a positive response for your queries, you came up to the management again requesting for cancellations wherein the reason was EMI deductions this also the management provided you with all the possible help needed.
Since now that you have made all false allegations on the firm and have posted on forum we would like to get it into your notice you no where had mentioned these things when our management was helping you with the your request to keep your membership on hold. But you had confirmed our team that you do want to continue with the membership but as your wife wont be able to travel an d you wont be taking vacations for next 3 years you would want the firm to help you with resolution. wherein our management gave you the privilege to hold the membership for 3 years and no maintenance charges will be applicable for these 3 years you kept your membership on hold. The firm had done the best it could and all your allegations that you made are false we could prove it through all the mail communications you done with the customer care team.

You people make very nice story about my wife. But you didn't mention anything here that from my first email I am saying to cancel my membership. But you fraud people are not ready to cancel my membership. For on hold status, in emails I clearly mentioned that if you are putting my membership on hold then EMI should not deducted. Just for your sake you people put my membership on hold for 3 year. If you can check my emails then check properly what I mentioned there. About my wife, she didn't said anything like that we are not going anywhere. I just don't want your membership. STOP MAKING INNOCENT PEOPLE FOOL AND STOP THIS FRAUDULENT

Dear Sir,
Your membership is not cancelable but yes we took in your requesting of your holding the package as its mentioned on the mail earlier, Secondly the EMI deducted from your bank cannot be stopped by us as you have converted with the bank and there we cannot interfere so calling us fraud makes non sense.
And its only your wife but you also had number of calls made on the same regards.

You people are properly mention the story here. Good story writing.
First of all, I remind you that at the time of giving your so called membership you didn't gave us the time to read all points. You people just want to make innocent fool. You people did that and make me as well fool.
Regarding bank EMI, I already spoke to bank they already gave you money of my membership. So this is reason you people are not cancelling my membership because you people got money. I didn't do any EMI conversion. Your so called manager had did this. You make the people in your trap by miss calling on toll free of HDFC bank number. Just for checking eligibility you people make the EMI conversion.
Don't make people fool and cancel my membership.

@Ashu Mishra, I am also facing the same problem and this company is not allowing to refund. Let's file a legal case against this company together (i am also pitching most of the people whom this company is befooling, my email id is pawandesigns77atgmaildotcom).

Without giving proper resolution they stated it as resolve. But this fraud company is didn't resolve any thing and portal is allowing them to resolve the case.
Please portal admin re-open my complaint.
