On 9th may, 2017, while searching availability of hotel accommodation during may, 2017 through tripadvisor at darjeeling in the internet, i got phone call from one mr. Rajesh mehata who posed as if calling from tripadvisor and assured packages 5n/6d at star hotel/resort naming resort mayfare and hotel elgin at a special price of rs. 12, 999/-. Mr. Mehata's mobile no. [protected]. Being senior citizens and ailing health condition, decided to pay to ensure assured accommodation at the peak tourist season at darjeeling. As our vacation was planned for 11 days, we arranged payment through credit card on line as suggested by him. On 10 may, i received payment requests from mr. Mehata vide email from yatri4travel, mentioning payment link from yatri4travel, yatri4travel sent invoice for inr 12, 999 (Two mails seperately), yatri4travel c-18 shanti nagar razorpay.
I checked my earlier mail box wherein i found mr. Rajesh mehata sent mails from yatri4travel offering lucratlve hotel accommodation packages for same 5n6d for inr. 12, 999 attaching the names of hotels and resorts having 3 to 4 star category located at darjeeling as well as many other tourist places including a grade cities in india. The names mentioned by him the earlier day were included in the list. As the date of our journey was approaching fast, and mr. Mehata insisted for immediate payment so that yatri4travel could immediately book the named hotel / resort before they were booked by others, i made the payment arrangement. When i tried to pay on line through my citibank credit card, system refused to accept. Mr. Mehata suggested to pay through my sbidebit card. He guided me to on line payment over phone. Payments were effected through mobiquik wallet (Transaction date - may, 10 tr i. D. 54f2a3795e13d for amount rs. 12, 999 and another one transaction i. D. - 7owcizj8en6wbf for rs. 12, 999.
Confirmation (Payment receipts) were sent by them immediately.
Now, i was asked to send the scaned copy of the travel voucher which were sent by them through courior service, mentioning the receipt nos. And dates of stay in the hotel/resort and place of the stay i. E. Darjeeling, and scanned copy of identity proof (Driving licence or voters i. D. Card or passport). I sent promptly. They sent mail suggesting a name of the hotel for my perusal and confirmation. I was astonished to see that the mentioned hotel was of low graded one. On search through internet i could see that the hotel was offering discounts and their normal rates were below rs. 900 per day. I told them that it was a total breach of their assurance and it was not acceptable to me. Being an old senior citizen it was not possible to bear the pressure and their torture, i asked mr. Mehta to refund the money. As mr. Mehata told over phone that it was not possible to arrange promised hotel of that standard, i immediately cancelled our railway booking to avoid heavy penalty after discussion with mehata. Mr. Mehata assured me refund of the money and asked me to send him the a/c details so that he could electronically transfer the money. I sent him the details through sms. Then certain gentlemen from yatri4travel started sending emails denying their telephonic offers and commitments. They started mentioning their standard t&c and refused to refund. At the same time mr. Mehata was communicating with me and giving his assurance to do his best for refund. He afterwards suggested that i should make one more attempt for a holiday when he would try for better accommodation so that my money was not wasted. We are old people with ailing health condition. As he was insisting i purchased railway ticket for puri and asked for accommodation as mentioned and named in their earlier mails. Mr. Mehata told me that their booking team would contact me and arrange. They contacted, i also contacted over phone. They sent me a list of hotels for selection. I found not a single hotel was upto the standard as assured and promoted. Those named in their suggested list were available through online bookings at a rates ranging from rs.500 to rs. 900, and located not on the seashore. I refused to accept and asked them for better accommodation. They sent again a few names and that too of the same standard. Their cheating business was totally exposed. I cancelled my vacation and railway reservation. I asked them to refund the money. They started pointing out their t&c, no provision of refund etc.. Even they stated that they won't reply to my mails and my mails would be dumped as spam. Mr. Mehata stopped answering my phone calls.
This is their business to cheat people. I found many many coplaints in the internet against them. Unfortunately i did not check their credentials and about their cheating methods and people's experiences aired out in the internet.
Now, i want my money refunded and expect the authorities to take stern action against this company so that common citizens are not cheated and defrauded their hard earned money by this type of cheaters.

I can send all the email communications as documents. Hope to receive acknowledgement and updates on this matter in my mail.

This is regarding to your online complaint, we would like to inform you that there is no point to argue on single topic where we are continuously asking you to abide our conditions and you keep on arguing that you have taken this package for the particular hotel as You have already been clearly informed the below mentioned points in the first email that has been sent to you over Mon, May 8, 2017 at 12:17 PM. Please go through the email:

1. Covered locations: Anywhere in India Up to 4 star properties.
Which Means Hotels category May be 1, 2, 3 or 4 Star (No Fix Category).
2. Any person taking advantage of this promotion does so under the complete acceptance of the terms and conditions.
Customer must have to check the terms and conditions before making the payment. Its available on website :http://www.yatri4travel.com/privacy-policy.html
3. The attached list of resorts is examples and used for promotional purposes only.
Any availability is subject to live booking and hence, the availability will keep changing & Yatri 4 Travel reserves the right to alternate dates and hotels, in case of no availability (Under exceptional cases).
4. Transportation can be arranged at an extra cost.
Sometimes we arrange the Vehicle for our customer but that services is chargeable. If customer can pay for the cab he will be getting those services included.

How can you expect a particular hotel when the email says that list are just for the example purpose and Yatri 4 Travel reserves the right to alternate dates and hotels, in case of no availability (Under exceptional cases).

If you still not agree to follow the terms and conditions the we can not help you or serve you as we do not want to stretch this matter further anymore. Further to this if you are willing to take a legal step then you may proceed we are having enough communication to show as documents if required. Also Please Note: Consumer escalations and disputes, if any, shall be subject to the laws of India and jurisdiction of Gautam Budh Nagar Courts only.

Now coming to the main point, in terms to use your package, you need to fill the booking request form and send it back to us. On receiving of that form we will share you the availability mail containing the list of hotel available for your preferred dates. You need to choose any one hotel from the availability mail to get your hotel booked from our booking team.

We ensure replying to each and every email we receive form the customer but if customer is not trying to understand the condition of company and keep sending repeated emails with different-2 timing on the same topic would be treated as spam emails. Please note that TnC mentioned on Website / Booklet are applicable. Please refer to the same and abide.

Please don't mark as resolved, repeat don't mark as resolved.
It is a clear case of cyber fraud. Justification as given by yatri4travel is not acceptable.
They are now trying to harass us by asking us to go to the consumer court at Noida.
I am not going to follow their advise and will take appropriate action to ensure refund my hard earned money.
I expect Indian consumer complaints forum to let me know about their intending action in this matter.
