Took possession of rent house on 8th of january 2018. One family stays in ground floor husband, wife and 2 kids, and some relatives. First floor me and mother.
1. Owner told property has parking space but later refused to allow me to use it freely. He broke the lock that i had put of my parking garage - cum - entrance gate when i went out of station. There is a separate gate and space for use by the other tenant which was told to me by the landlord. But later both the tenants and landlord conspired to not allow me to use the parking space freely and told it is a common space after a week of my arrival. Also sometimes the other tenant will park his vehicle inside and i am forced to park my car outside.
2. Owner has only municipality water connection. No borewell. Water sump pump has common meter and as per agreement owner told the sharing of the bill will be as per number of persons staying in each family. But when the first electricity and water bill came, both tenant and landlord denied the agreement and demanded that i pay 50:50. The access of the water pump is also with the other tenant in lock and key and they use it as per their will and sometimes in the middle of night we have faced water shortage due to this. We have not been provided access to the pump for our convenience. It was duty of the landlord to provide me all the access for things he is charging me for.
3. Demanding me to pay for old damages. Day 1 old leaking pipes and faulty electricity repair charges were demanded. Refused to replace the lights which fused within a week, stating that they were newly replaced. When i asked for the new purchase receipts of tubelights, which warranty period minimum of 6 months is always there, they refused and told me to vacate the house if we are unhappy. Further, on day of occupation, owner told he forgot to bring the bedroom door and almirah locks, but later when he came with a bunch of keys, none fitted. I requested him to replace those locks, for which he said his house is very secure and i don't need to lock anything. Even i requested to fit ceiling fans for bedroom and hall for which he dais it is not that hot and fans not required. He refused to make any replacement or repair or pay for it. I requested many times but he stopped taking my calls or responding my messages and even switched off his phone. I myself have spent for bathroom fixtures etc and washing machine tap connection for which i had to spend around 2000 rupees.
3. During negotiation when i asked about rent agreement and he said he will do it and give me in a week. But later owner visited my house and told about his poor health and that he wont be able to do it. So he requested me to prepare it. He said it will be within rs 400. I made all the expenses and prepared it. He came home to sign it, took the original document and refused to pay the money i spent.
4. Major problem started when ground floor tenants started to park their vehicles in front of my gate, blocking my parking gate-cum-entrance and keeping their gate free. My clothes got torn one day and so i called up owner to intervene. To which owner said it is bbmp area and he has no jurisdiction over it and so they are free to park where ever they want. Itis a daily harassment. Every day 3 to 4 bikes are parked in front of my parking garage cum entrance gate.

5. Owner send repair workers to my home in my absence and without prior intimation when only my mother is at home and who does not understand the local language. The worker calls me from my mothers phone and charges me rs 300 for repair which i have not asked for. He is someone known to the landlord.

6. I paid first month rent on time. At the time of payment for first month rent he raised many objections. He showed his calculation as follows. I took keys from him on 7th january and came to occupy the house on 8th. There are 31 calendar days in january, so 7 to 31 jan i. E (25 days rent). Per month rent is 18500. So he divided 18500 by 30 days instead of 31 days of january month and multiplied it by 25 days. 18500/30 = 616.66 = he made it 617. 617 x25 =15425.
I had calculated 616.66 x 25 = 15416.66 and paid him rent of 15416. He then visited the home in my absence and argued with mother and called me repeatedly when i was busy with office work that i paid him 9 rupees less in january month rent.
It is a 25+years old house as per their claim and that when they lived there was no complain and also no previous tenants had so many complaints and i am the only one complaining.
Now his daughter and wife has joined him in saying that i am harassing an 80 year old man. I have my own health problems and was unwell in february and i even could not go for work. There was a delay in paying the rent by one week, to which they told i should strictly follow the agreement clauses regarding rent payment. 5th is the last day and i paid on 11th.

7. Also he had told me that it is my responsibility to keep first floor and terrace clean and that ground floor tenants will keep ground floor clean. I am not aware of any thing about the ground floor as it is out of my access too. But owner called me up and accused me of blocking the ground floor drain. He told me he got complaints from ground floor tenants about a blocked drain. He told i should call municipality workers to clean blocked drains. He and his daughter accused that i throw leaves from terrace down and because of it the block has happened. There are huge trees around the house and in this season leaves are falling everywhere.in morning if i clean then by evening again the terrace will be full. It is a big space and it is impossible to clean everyday, me being a working person and my mother and old retired lady. Still i pay to municipality workers and dispose those every week. I have been wrongfully accused for no reason. The main reason is the downstairs tenant never clean around their house. And never seen them disposing garbage to municipality garbage collectors from the day i started living here.

Do i have to follow rent agreement clauses when clearly all the other clauses owner has already violated. I have moved in january and now he wants me to move out in next 2 months. I am afraid that at the time of leaving the house they will deduct wrongfully from my security deposit.

Kindly advice what i should do?
