Hi all

My email is with good intentions to alert not to fall trap with the builders.

Please avoid aliens group (www.aliensgroup.in) and all their projects in and around hyderabad. they keep changing names to play with and they are not really going to deliver what they promises. if anyone visiting and you see them in property expo, please question them.

Aliens group has many projects like space station -1, space station – 2 (discarded) and aliens hub and a new project aliens sky park.

I have been a victim by purchasing the flat in 2009 (space station -1) and still not able to get the money back. there are 350 + consumer cases out of 50 in national level consumer forum, 300+ firs, md got arrested last year and released after 2-3 months, no charge sheet filed yet by police officials. same flat sold to different customers. banks of no help (major banker is sbi). suspecting political support. around 1000 cr project and collected about 600 cr.

My suggestion is to avoid all the projects which are at initial level, and it is wise to purchase a finished flat/villa with all the documents and plans approved to save all hard earned money and peace.

Subject –either hand over of our flat no. 601 in station#1 and flat no.420 in station#4 in aliens space station#1, tellapur, hyderabad or refund of principal amount with 24% interest which works out to be rs.12302278/ (As mentioned in aos). – reg.

I(Nirbhaya kumar shah) and my son(Abhishek kumar) have booked flat no.601 in station#1 vide a9/ss/959 dated 23/06/2009 and flat no.420 in station#4 vide a9/ss/918 dated 23/05/2009 in aliens space station#1, tellapur, hyderabad in 2009 and paid rs.1851713/- and rs.1587500/- respectively through state bank of india, hyderabad bank home loan a/c no.[protected] & saving bank a/c no.[protected](Nirbhaya kumar shah) and state bank of india, hyderabad bank loan a/c no.[protected] & saving bank a/c no.[protected](Abhishek kumar) respectively in the year of 2009, which is a 50% cost of flat, with a commitment by aliens to hand over flats in three years as per “agreement of sale” i.E. In the year 2012.But aliens could not deliver the flats till now. In fact aliens did very little work and seems most of our fund was diverted in their other project.

Therefore m/s aliens is noticed and intimated either to refund our principal amount with 24% compound interest from the date of our payment to aliens as per aos signed by m/s aliens (Which works out to be rs.6731375/-+rs.5570903/- = rs.12302278/-) or hand over alternate ready flat available at other station#14 at the same rate with delay compensation as agreed in aos to us at the earliest otherwise action as deemed fit will be initiated against m/s aliens developers private limited.

We have paid entire loan amount to state bank of india.

We will return aos to m/s aliens after getting entire principal amount with interest in our saving bank account which is mentioned above or after getting hand over of alternate ready flat available at other station#14 with delay compensation as agreed in aos.

Sub. – sanctioning of house building loan by sbi official of hyderabad without checking of genuiness of builder’s paper to favour builder –reg.

I(Nirbhaya kumar shah) and my son(Abhishek kumar) were sanctioned house building loan in 2009 by sbi, hyderabad official without inspecting builder’s (Aliens developers private limited, hyderabad) valid document by sbi and paid money to builder without progress as well as without registration of property (Which is the very primary checks of bank) resulting loss of our principal amount (Rs.1851713/- + rs.1587500/- = rs.3439213/-) along with interest since 2009 which works out to be rs.4879662/- + rs.3983403/-=rs.8863065/- at the rate of 24% as per aos and total amount works out to be rs.12302278/- for these six years as builder did not make our apartment(Intention was to cheat customer) till now and is not going to make before 2022 as orally intimated by m/s aliens executives and that time also m/s aliens will hand over flats with increased rate as being threatened by m/s aliens.

We have paid entire loan amount (Principal and interest) to state bank of india and got back our original aos being a government officer and good citizen of india.
I request you to please inquire your official to clarify following points –

1) did builder submit a complete project plan with construction schedule for above described residential project, to state bank of india for home loan approval? Has builder submitted any amendment to the original project plan and schedule after initial submission? Please provide a copy of project plan and schedule and details of amendment like nature of change in original plan, and percentage of delay in original schedule.
2) did builder submit a detailed cost and price estimation of above project to state bank of india, describing the construction cost, facility and provision cost, landscaping cost, administrative cost, and the profit margin etc.? Were details of material cost, labor cost, and any other cost included under construction cost category? Were details of quality, grade, and brand etc. Of construction material referenced in cost of material? Has builder submitted any amendment to the original cost or price estimation after initial submission? If yes then exactly which part of cost or price was impacted? What was the reason/rational provided by builder for this change? Did other builders also report similar cost escalation around that period? Did builder ever inform the bank about any mistake committed in costing and pricing? If yes then, did builder inform the bank about corrective measure builder planned to take? What was the percentage of error in costing or pricing if informed any? Can builder request/ask/force customer to pay additional cost without informing bank?
3) if builder amends the project plan or schedule, cost or price, without informing bank and without agreement with customer, will it impact the home loan agreement signed between customer and bank as the objective of home loan has changed? Can you please explain the objective of a consumer home loan as described by reserve bank of india?
4) how frequently did corporation bank verify the actual project progress against the project schedule submitted by builder? Did state bank of india ever identify any significant delay in the construction? If yes then what was the percentage of delay as per actual plan? Please provide the date of such incidents; also please provide the details of any such communication between bank and builder. As per current status of this project, can bank estimate and provide me the percentage of project completion and delay in schedule? Also please provide the number of state bank of india home loan customers who already have got the possession of flats in this project till date.
5) the builder sent me an email to facilitate me with flat shift option to phase 1. Did builder inform bank also about such facilitation? Is bank aware about the construction phase, in which my flat 601 in station 1 and flat 420 in station 4 falls as per project plan and schedule submitted by builder? Can builder force such facilitation upon customer without informing bank?

Hence i request you to please look into the matter and do the needful to get our apartment or principal amount with interest. I had taken home loan from sbi considering it government of india and i am also government officer invested my whole life hard earned money.

Complaint filed under section 17 (1), a (I) of consumer protection act 1986 & 2002


The address for service of notices and summons if any on the complaint is that of their counsel mr d raji reddy and mr c vijayashekar reddy, advocates, 4-1-371, 4th floor, kundas estate, beside jaya international hotel, reddy hostel lane, abids, hyderabad.
For service of notices and summons, if any on the opposite parties, is that of on the addresses given in the cause title thereof.

Brief facts of the case:

1. It is submitted that the 1st opposite party is a company registered under indian companies act, 1956 represented by its managing director and joint managing director mr hari challa and mr venkat prasanna challa, the 2nd and 3rd opposite parties respectively and are responsible for the day to day affairs of the 1st opposite party/company. In its course of business the 1st opposite party under taken a development agreement cum gpa’s nos.23198 of 2006, 23230 of 2006 both dt.07.10.2006 and 13321 of 2007 dt.23.06.2007 with the respective land owners for development of land admeasuring ac.19.26 gts., into residential apartment complexes thereon in sy no.384, 385 & 426/a, situated at tellapur village, ramchandrapuram mandal, medak district. The 4th opposite party is the home loan banker extended home loan finance to the flat under sale as per the contractual obligations mentioned in agreement of sale and other agreements thereof.
2. It is submitted that 1st to 3rd opposite parties made believed the complainant that they have undertaken the construction of multi storied apartments in the name and style of aliens space station-1 situated at tellapur village, ramchandrapuram mandal, medak district and obtained building permission vide lr.No.621/p4/ plg/hmda (Huda)/2008 dt:[protected] and had absolute rights over the flat bearing no.601, station- 1, on 6th floor comprise of super built up area of 1344 sq. Ft, in the complex ‘space station- 1 ’ together with 28.90 sq. Yards o[censored]ndivided share of land out of 82976.89 sq. Yards in sy.Nos.384, 385 & 426/a, situated at tellapur village, ramchandrapuram mandal, medak district.
3. It is pertinent to mention that believing the words and at the offer of the 1st to 3rd opposite parties the we undertook

I) agreement of sale dt:04.07.2009 for purchase of flat bearing no.601, station – 1, on 6th floor of the complex by name space station-1, comprise of super built up area of 1344 sq. Ft, with one covered car parking besides undivided share of land 28.90 sq. Yards out of 82976.89 sq. Yards in sy.Nos.384, 385 & 426/a, situated at tellapur village, ramchandrapuram mandal, medak district a consideration of rs.37, 03, 425/- and paid an amount of rs.6, 00, 000/- towards earnest money and advance sale consideration vide cheque no.312889 dt.28.06.2009 drawn on icici bank, vijayawada, and the same was acknowledged by the opposite parties no.1 to 3 vide receipt no.03516 dt.23.06.2009 and the same was also admitted and acknowledged in the agreement of sale dt.04.07.2009. On 10.07.2009 the complainant has paid a sum of rs.1, 40, 685/- vide cheque no.312890 dt.09.07.2009 drawn on icici bank, vijayawada, and the same was acknowledged by the opposite parties no.1 to 3 vide receipt no.03584 dt.10.07.2009. On 12.09.2009 the complainant, the opposite parties no.1 to 3 and the 4th opposite party had entered into tripartite agreement for housing loan, based on that agreement the 4th opposite party has paid a sum of rs.11, 11, 028/- on avail of home loan of rs.24, 34, 000/- by the complainant vide cheque no.499718 dt.12.09.2009 and the same was acknowledge by the opposite parties no.1 to 3 vide receipt no.03683 dt.12.09.2009, thus the total amount paid to you is rs.18, 51, 713/- in accordance with the terms and conditions of the agreement of sale dt.04.07.2009 as against the total consideration of rs.37, 03, 425/-.
Ii) agreement of sale dt:05.06.2009 for purchase of flat bearing no.420, station – 3, on 4th floor of the complex by name space station-1, comprise of super built up area of 1432 sq. Ft, with one covered car parking besides undivided share of land 30.79 sq. Yards out of 82976.89 sq. Yards in sy.Nos.384, 385 & 426/a, situated at tellapur village, ramchandrapuram mandal, medak district a consideration of rs.38, 73, 353/- and paid part of the consideration of rs.8, 07, 500/- towards earnest money and advance sale consideration vide cheque nos.923871 to 923875 all dated 23.5.2009 @ rs.49, 500/- each drawn on state bank of hyderabad, _____, rs.4, 60, 000/- vide cheque no.748452 dt.05.06.2009 drawn on citi bank, delhi and rs.1, 00, 000/- vide cheque no.312888 dt.05.06.2009 drawn on hdfc bank, vijayawada the same was acknowledged by the opposite parties no.1 to 3 vide receipt no.03433 dt.05.06.2009 and the same was also admitted and acknowledged in the agreement of sale dt.05.06.2009. On 06.02.2010 the complainant has paid a sum of rs.1, 80, 000/- vide cheque no.748464 dt.06.02.2010 drawn on citi bank, _____, and the same was acknowledged by the opposite parties no.1 to 3 vide receipt no._______. On 06.02.2010 the complainant, the opposite parties no.1 to 3 and the 4th opposite party had entered into tripartite agreement for housing loan, based on that agreement the 4th opposite party has paid a sum of rs.6, 00, 000/- on avail of home loan of rs.19, 32, 000/- by the complainant through internet transfer, thus the total amount paid to the opposite parties no.1 to 3 is rs.15, 87, 500/- in accordance with the terms and conditions of the agreement of sale dt.05.06.2009 as against the total consideration of rs.38, 73, 353/-.
4. W had paid a sum of rs.18, 51, 713/- as against the total consideration of rs.37, 03, 425/- & rs.15, 87, 500/- as against the total consideration of rs.38, 73, 353/- respectively. The 4th opposite party herein on the basis of agreement of sale sanctioned a home loan of rs.24, 34, 000/- & rs.19, 32, 000/- respectively with a condition to disburse the home loan on execution of mortgage of the flat besides utilization of the loan amount shall for the purpose mentioned in the loan application. In contrary to the terms of agreement the 4th opposite party released 45% of the home loan to the developer company even before start of construction. The 4th opposite party would have remitted into escrow account ought to be maintain by the developer company in this regard. As a result the developer company resorted to diversion of home loan by defeating the very purpose of the home loan scheme thereby made suffer the complainant.
5. It is pertinent to mention that the loan disbursement shall be co-related with the progress of the construction and in accordance with the provisions of section 4 & 5 of the ap apartment (Promotion of construction and ownership act & rules, 1987). Whereas the 4th opposite party violated the same and committed unfair practice.
6. It is submitted that the home loan banker being a legal body under law ought to follow the provisions of statues such as the andhra pradesh promotion of apartments and ownership act, 1987 besides other guidelines issued by its superior/regulatory authorities such as rbi & nhb while releasing the home loan but failed to do so thereby the developer company diverted the home loan including the margin money paid by the complainant. Thereby, 1st to 3rd opposite parties in collusion with the 4th opposite party committed not only deficiency of service but also unfair trade practice and caused loss besides physical suffering and mental agony to the complainant.
7. It is submitted that we were compelled to pay emi’s into home loan besides interest thereon as charged by the 4th opposite party, otherwise the 4th opposite party cautioned about the reference of default to the credit agency (Cbil). It is submitted that there has been no response over phone and mails from the opposite parties 1 to 3 in respect of progress of construction of flat under sale. Even though the complainants are ready to pay the balance of installments in accordance with the terms and conditions of the agreement of sale and progress of the construction, the opposite parties no.1 to 3 have not provided the details of the progress of the construction of the flat under sale as on date.
8. We submit that the opposite parties started aliens space station-1 project in the year 2007/08 and in the span of 7 to 8 years not even 1 station (Out of 13) is 100% complete, leave alone the amenities, car park, lakes and other infrastructure promised. It is not only deficiency of service and commitment; it is intentional case of cheating and deceiving innocent buyers who have invested sizable portion of their life savings with a dream to own a house. On noticing about the snail space of construction at project site the complaints prevailed up on the opposite parties 1 to 3 but they deaf eared and gave evasive replies. It is pertinent to mention that the developer company has to complete the construction of the flat by december, 2012 in terms of agreement sale dt.04.07.2009 and 05.06.2009 respectively under clause viii (Delivery of possession), under any circumstances. On the recent visit to the project, the complainant noticed that only basement work is completed, but the complainant’s flat is at 6th floor of the complex.
9. On noticing about the snail pace of works at the project we prevailed upon the opposite parties but could not get proper response. It is pertinent to mention that the opposite parties 1 to 3 have to complete the construction of the flat by december, 2012 in terms of agreement of sale dt.04.07.2009 and 05.06.2009 under clause viii (Delivery of possession), under any circumstances. Thereby the opposite parties committed deficiency of service in not constructing the flat under sale in terms of agreement of sale dt.04.07.2009 and 05.06.2009. Moreover the 4th opposite party is having charge over the flat soon after sanction and disbursement of the home loan. As such the home loan banker ought to exercise its charge for recovery of home loan from the opposite parties 1 to 3 but did not do so. As such complainant got issued legal notice on the opposite parties on the available address but there has been no response.
10. In view of cheating, mischief, fraud committed by the opposite parties no.1 to 3 the complainant lost the opportunity to have a residential accommodation in the year 2012 on the then prevailing costs. Besides the complainant paying interest into the home loan amount paid to the opposite parties no.1 to 3. Due to the fraudulent action of opposite parties no.1 to 3, the we suffered with mental agony, escalation of cost and other physical sufferings by wandering in and around the office of the opposite parties no.1 to 3 for the past few years, for which the opposite parties no.1 to 3 are liable to pay to a tune of rs.10, 00, 000/- to each o[censored]s.

11. The 1st to 3rd opposite parties continuously made false promises in collusion with the 4th opposite party and not completed the project with fraud intention to cheat the complainant. In view of deficiency of service and unfair trade practice committed by the 1st to 3rd opposite parties in collusion with the 4th opposite party, and having no scope of completion of construction in the near future by the opposite parties 1 to 3, the complainant demanding the refund of the sale consideration of rs.18, 51, 713/- and rs.15, 87, 500/-, which includes home loan, with 24% interest per annum for the period from the respective dates of payments and subsequent interest till the refund of the same from the opposite parties. Besides the opposite parties are also liable to pay compensation charges @ rs.3/- (Rs.3/- per square feet) per month according to clause-g of viii (Delivery of possession) for any reason if the opposite parties failed to handover the flat to us on or before december 2012, further the due date for handover of flat is already over by december, 2012 and due to the deficiency in service by the opposite parties. As such the opposite parties are liable to pay fair rental value @ rs.10/- per sq. Ft., per month for the delayed period w.E.F. December, 2012 to till the date if refunding the amount paid including compensation and interest.
12. It is submitted that in view of deficiency of service and unfair trade practice committed by the 1st to 3rd opposite parties, they are liable to pay compensation for escalation of costs, physical suffering and mental agony caused to the complainant to a tune of rs.10, 00, 000/- to each o[censored]s.

Cause of action: the cause of action arose on 04.07.2009 and 05.06.2009 when the complainant had entered into agreement of sale and on due date of hand over of the possession of the flat by december 2012 and issue of legal notice dt._04.09.2015 to the opposite parties and receipt of notice and the cause of action is subsisting and continuous as the claim of the complainant so far not paid by the opposite parties.

We bought a nice 3 bedroom apartment in the Aliens Space Station project in 2013. They said they would handover the flat by 1st Jan of 2015. It's April now and the construction of the building hasn't even started. Due to this, the comfort which we very much deserve is merely just a dream. All we ask is what we were promised and what we payed for. Is that too much to ask?

I have booked a flat in Aliens Space station 1 in the year 2011. The flat booked in 13th floor. The builder is supposed to make the hand over latest by 2013 end. Whereas, they have did not construct the ground floor till now. I was continuously pursuing with various employees in the Aliens space station including Mr. Hari Challa, the managing director of Aliens Space Station. Every time they, say stories change their words and since Jan 2014. They do not want to give back my money rather they proposed a flat shift option in already constructed flats in Aliens space station and also in some other properties. Nut even in the flat shift option, they want to charge me 50% to 60% extra which is un-realistic and without justification. They did gross cheating and I am suffering with huge financial burden due to their mischief and malafide intentions.I am paying regular EMIs for the loan taken and given to these cheaters with a hope of getting a dream home for a comfortable living of my family. I am loosing interest for the entire money paid from savings as well from the loan which is an additional cost. I am not able to avail the income tax benefit. Over all the impact on me is already 30% plus to the payment made apart from the mental agony and the rent I am paying since then.I am seeking justice from various forums including police and courts to get back my hard earned money.

Dear Prospective buyers, I have purchased 2 flats in station 4 & station 7 each in 2012 by paying 50% of the amount . They promised me to handover in by Dec 2013. So far they haven't even started by construction in these station. When asked about the project progress, they don't even care to respond to the customer. On top of these, the builder is demanding 40% extra money ( more than what was agreed in the agreement) to switch to another owner. If owners are not willing to give this extra money, they say we can approach courts. Hence scores of customers ( so far 90 customers and the number is still growing ) have filed consumer cases and also cheating FIR. Now Aliens MD, Hari challa is arrested by RC puram police station, Hyderabad. They have cheated the customers by taking money and diverting/siphoning if off from the project. We have now resorted to legal battle with this builder. I caution prospective home buyer to be careful about this project & builder. They are targeting mostly NRIs & software engineers. Hi I booked a 3 Bed, 3 Bath apartment in 2007 in Aliens Space Station 1. I have paid Rs 31.47 Lakhs already in 2008 with commitment of handover by 2010. It is already 8 years and the builder has not even started my apartment block (station). Whenever I ask for status, they say their customer service will work with me. They are asking me to move to another station at an added cost of Rs 40 Lakhs than what was mentioned in the AOS. I have requested for refund of my money (as mentioned in the AOS) and from that point onwards, I am not getting response from them. Basically, I have put in all my life savings on a virtual apartment. The builder is not prividing an alternative apartment and not responding to requests for refund of money. I have bought a Flat in Aliens Space station 1 on June, 2012 and my possession date is Dec, 2013. Till now they haven't handed over my flat and they are asking for extra money. I am struggling now to get my money back. Never Buy a Flat in Aliens Space station 1. Please read the reviews in google before buying a flat in Aliens Group. I would suggest any body to donate their money to any charity, instead of buying a flat in Aliens Space Station 1.

I am writing this as a sufferer of this ‘Stupidest Scheme’. I have invested in 2011 with a promised handover in Dec 2012 (+9 months grace period). This is 2015 and the construction in my station (Station-5) has not even started. I have come to the conclusion that this is a big fraud planned by set of scheme and here is my view on how this has been executed. Aliens Identify a piece of land in a good location, shown lucarative pictures and videos to the landowners, promise them flat instead of buying their land. Identify the most reputed government/Private bank and ‘fix’ them to approve the project. Again on promise of some more flats attracted most famous social media and got the front page advertisement. Print thousands of 250 pages glossy leaflet describing raft foundation, green building, Building automation, the complete design, project rendering beautiful views. Identify some renowned international consultants who would do some design and their name can be put on leaflet. You need not finally pay them, it is just a question of another lawsuit. Get bookings done through any means. Price, flat location, terms, payment of Pre-EMI, anything goes. Targeted overseas people since they cannot be bothered to do court cases in India and most would just write it off as a bad investment. Targeted middle class and IT people who don't have very good political and administrative support.Not heard if any of the potential customer have political link, lawyer or in police or very strong background. Get the minimum of 50% advance from customers with all rubbish reasons of transfer slab and all as part of bank disbursements, sometimes 100% money from hundreds of prospective buyers. Then diverted the money to other projects and company. Construct only 5% of project. These can be used as showcase to attract more and more people. Do not handover the flat to the owners of the constructed flat, unless they pay 50-75% more than the AOS. Do no respect even the ownership of registered flats. Once you have invested and paid them money and then suddenly they stop responding both on phone calls and even emails too. Threaten people, block websites, make police complaints again people who can expose you. At the end of it you just have 250 consumer cases against you, and can laugh all the way to bank. The landowners, consultants, flatowners can all go to hell. If some judgment goes against you in 4-5 years, escalate to National forum. If you lose and are made to pay your cheques can bounce and the cycle of case for the hapless owner starts once again. When customers met Naveen and Hari challa, they will just laugh at your condition and ask you to pay 25%-30% on top of AOS. Customers have fed up and have now register a FIR (Crime number 14/2015, RCPuram Police Station, Medak district) in group apart from other customers who have already registered FIR’s individually. I have booked a flat of 1687 sft in Aliens space station in the year 2011 and has paid 50% of the money. Some part from my savings and remaining through bank loan. The indicated delivery for the flat was March 2012. But even now i.e., Feb' 2015, nothing has developed. No indication that these people can finish the towers. Moreover, the construction was stalled since last two years. They are reluctant to pay the money back and are giving flat shift options with un-realestic figures and prolonging the time. I am ditched by this Aliens Space station management. Now I am looking for my money along with interests at the earliest. I want Justice for getting my Flat at purchased price or refund of the money paid along with interests.

We purchased a flat in the year 2010 in Alience space station-1. station -8 flat number 1551. At the time of flat booking they said that they will handover the flat by[protected] with a grace period of six months. at booking time we paid 12lakhs and we got approval for 31 lakhs from SBI RACPC secunderabad and they disbursed 12.36 lakhs. we started the repayment( EMI-29393/- to the bank) from September-2010. Since 1 year we are paying only interest part i.e 7500/- due to some problems. But our station is not at started not even footings. from last one year they are forcing us to shift to the completed flats by paying double price which costs us more than 20lakhs. now we are not in a position to pay that amount then we tried to cancel the flat. We are asking for interest of 24% (i.e 2 rs) from the date of booking. They are not accepting for this and moreover they said that for this, we don't charge any cancellation charges for your flat. Many times we visited and requested them for further processing but different people are assigned to us to answer. it is our hardened money, we dont know what to do and whom to contact for the justice.we heard that many people are suffering like us please help us. Please don't beleive on fancy photos and look for ground reality. Aliens has been building Space station 1 in Tellapur since 2007 and still not even 10% project is completed after 7 years. So think 1000 times and talk to the people who are suffering. You may visit to the site but don't beleive on what these fraudsters say otherwise you yourself will be to blamed for falling into this trap. Its not about 100 or 1000 rupees but lacks of ruppes you are going to invest so do proper investigation and talk to all the Banks and ask why they are not issuing loan or disbursing amont for the sanctioned loan previously and try to get the numbers of other owners from Aliens(I"m sure they won't give) and talk to them. The fact is they have diverted the money collected for this project to gain some benefit and now stopped the project and seeking extra money on top of "Agreement of sale", from the existing owners. Did any of you get any justice for your complaint till date. if nothing has done, whats your next step in getting back your hard EARNED MONEY. I had booked a flat in Feb 2013 and paid 8 Lakhs as advance. The construction of said tower didn't start till now; they asked me to shift to another tower with the price of 40% more. As it’s not affordable, i cancelled the flat and they promised to refund the MONEY within 3 months with interest. All these happened in April 2014. They are not responding to any mails of me and are not answering to my phone calls, i got vexed with their attitude including Mr.Hari Challa (MD, Aliens developers), and sent a legal notice to all the executives, managers and MD who ever involved in my flat allotment and the process till date. Surprisingly, all of them refused to take the legal notice. Finally i decided to go to consumer court, because there is no other way for a common man to deal such problems. I had booked a flat at Aliens SS in 2009. I paid an amount of Rs 2.5 L towards booking and SBI has disbursed Rs 16 L.I am paying EMI for last 5 years (totalling to Rs 10 L) and to get rid of my EMI i had paid Rs 12 L to SBI. ​I have no update about my flat from them. I am following with the exes and no response. ​I want to know if the flat owners had collectively filed a legal case against the builder. If yes, let me know the forum details and i would also like to register a complain.

We have booked three flats in Alien Space station and unfortunately we have paid full amount for them.Now they are asking huge some of money for all the flats. The status of my flats are as below: One of my flat is ready in station 13 and they are not going for registry of that flat. Every time i call up them, they come up with new excuse and every time a new person is there to give you new story. They are sort of blackmailing me that i should pay huge sum of money for shifting my other two flats to other space stationd & pay huge amount of money. Otherwise they will not go for registry for this already constructed flat. I am very much worried about my money now. Can anybody who has gone for consumer Court /police can share the detail so that i can also join them . Dear All, Writing to seek your guidance in dealing with the Aliens Group and recouping my investment. In 2009 we had booked an apartment with Aliens for their Space Station building in Tellapur Hyderabad with delivery date as 2011. By 2011 we had made a payment of 50% of the agreed upon price (Rs. 25 Lakhs) with no delays basis the schedule of payments shared, with the builder suggesting a delay of 1 year in project completion. The project has now been delayed by 3 years and the builder has now indicated through their sales team that the delivery for my flat would not be completed for another 3 years at the minimum[protected]. Further due to the improved "specifications" (for which no approval was given by us) he is hiking the per sq. ft rate to double the agreed upon rate (Rs. 4500 per sqft!!!) irrespective of when he delivers the flat. At the same time he has also refused to make any adjustments to the payment plan to factor the interest loss I have incurred/rent payments made by me due to the delay in the construction. Given the above and with my patience running out, I wish to cancel my booking and obtain a refund. However, the builders have indicated a payment plan which only starts 1.5 year later with no legal documentation to back the same (an email is all they are willing to provide). At the same time, they have refused to factor any payment towards the interest loss incurred by me! Also, given that they have duped me time and again for so long I have no faith that they would stick to the payment plan promised. In light of the above, can someone please suggest a way out of this? We booked a 3BHK flat in Station 7 in Aliens Space Station at Tellapur in 2009. They promised us the delivery in 2011 or maximum by early 2012. We paid them 25 lakh rupees so far ( our life time savings ) trusting them on their words and contract. Its been 6 years and they did'nt even build a single floor in our station. In last six years they managed to build only one single tower out of 14 towers and nothing else. Now they say the project will be ready by 2017. And when we requested them to give us a solution they are asking us to move to a ready apartment by paying additional 20-25 lakh rupees . And if we choose to wait for 2-3 years for our tower to be ready, they are asking us to pay extra price ( almost 40% more than our contracted price ) to take the handover. They are almost 50+ cases booked against this developer in the consumer court and we are opting to take legal action against them aswell. Flat no 703, Space station 1 Flat booked in Jan 2010...promised delivery on 11-11-11 Pre EMI started immediately for 18 months, post that full EMI till date... They did not hand over on the promised date of 11-11-11 From June 2012, they stopped sending me site updates Their site updates always show the same stage of construction...a copy paste of earlier image. Now they are saying handover in 2015, no date shared. They cannot keep repeating dates and there should be penalty and a case booked against them. All flat owners need to be compensated at current market rates by attaching MD hari challa's properties.

I have booked flat in 2009 in Aliens space station 1, Thellapur. They have promised me to deliver the flat in 3 years with a grace period of 6 months. According to that they should deliver by 2013 but still the construction has not been started. They are asking to move to another tower where there is progress but charging me huge costs with respect to difference in sft and huge costs for upgraded specifications. Not giving me any option other option rather than accepting their cost or wait for another 3 -4 years. Please help me on this.

I booked a flat in Dec 2011 with a promised date of delivery in Jun 2013 and a grace period of 6 months. This was under EMI scheme where the builder was supposed to pay the pre EMI until possession, so no more penalty clause for delay was added. The builder stopped paying EMI post Dec 2012 and just revoked the clause unilaterally. I got the information from bak after 2-3 months. Moreover the construction for my station has been postponed indefinitely and the builder is also not sure about the date. I have paid more than 50% already including the bank loan. They want me to pay more if they move me to a flat that will be delivered in 2016. I am in a quandary now. Given their history it does not seem correct to pay them more money and my loan is becoming an NPA as per the bank. To keep it going, I have to Rs 60K as EMI every month. This is a very difficult situation to be in. Need advices to tackle this situation.
