[Resolved]  Mr. Shantanu Bhaduri — Refund of Advance amount paid to the developer for purchase of a flat

I am chasing my developer, Mr. Santanu Bhaduri for refund of advance amount of Rs. 7.0 lacs paid to him in two installments in the month of August and October'12 towards purchase of a flat at 4/1 Harisava Road, Anandapuri, Barrackpore, Kolkata 700122 as he could not get his project approved by HDFC against my loan application due to non submission of original link deed and copy of sanctionned plan for 2nd floor of the building. Since the project is not approved by HDFC, I am unable to get the loan from them. Moreover, there is an ongoing court case against the land of the Project since July'12 which was also not disclosed to me by the developer during the booking of flat. As a result, the construction work of this project has been stopped by the order of court for the last one and half months. Althogh my developer has agreed to pay me back the total amount of Rs.7.0 lacs, till date neither he has paid the money nor replied to my letter.
