[Resolved]  True Value — Non Transfer of Vehicle by True Value

I need to mention that until today we were ‘Maruti Loyalists’; we have bought all our cars from Maruti Competent showroom at Connaught Place in Delhi. In fact we were so happy with Maruti Competent that we have never bought our cars from any other company or of any other company! We had bought a Maruti Wagon R – on December 15, 2008 and had given an old 1994 model Maruti 800 car to True Value at Competent, Connaught Place. After having signed the relevant papers we were assured by the Manager that they will take care of the transfer etc. from then on and we were given a certificate from true value on a prescribed format saying the we have handed over the RC of the said car on December 15 2008 and therefore sold the car to true value and the company will henceforth be responsible for any accident, challans, misuse etc. from the mentioned date. The money that we got from the sale of the old car was adjusted in the cost of the new Wagon R as we just paid the balance money to Competent.

The problem started when in 2012 October my husband was called to the police station and informed that Maruti 800 car number was caught and seized with liquor and the car was still on our name and had not been transferred by True Value on being sold to another person! We were called then to the Police station where we showed them all our papers, including the receipt from True Value that showed that we had sold the car in exchange for a new Wagon R to them and that they would be responsible henceforth. The police asked us to write this story again on plain paper and got it signed by my husband and we were allowed to go back home after being assured that the Police were doing their duty and had seized the car. We as responsible citizens did all that we were asked to do.We then went to see the Manager, personally at Competent, Connaught Place, who assured us that it certainly was their responsibility to have got the car transferred when they had sold it. He also helped us locate to whom they had sold the car and that the person to whom they had sold the car was not traceable! He introduced us to Mr XXX who would receive our calls on his behalf and tell us that they were not able to locate the papers because that time the papers in their office were being computerized and that they could do nothing. Mr XXXX was helpful but now he had stopped picking up our phone calls.

On June 5, 2013, I got a call that the Police station again wanted my husband to come and see them. When my husband and I went to the Police station we were told that my husband was to be arrested and after having spoken with the SHO, we were told that the Magistrate under a new Excise rule had asked for the owner to be arrested.

My husband and I both are in extreme mental stress; we have seen humiliation on being summoned to a police station and the worst we now have applied for Anticipatory Bail! And all because we were Maruti Loyalists!

I am an Associate Professor at the University of Delhi, teaching Post Graduate classes. My husband is also an AGM with a reputed Navratna Company. We get enough salary for the two o[censored]s to be living comfortably and without having to smuggle liquor for a living especially when my husband is a total teetotaler. WE are totally stressed and don't know what to do.
