[Resolved]  Apartment — Approach Road

One builder had acquired some land of 32 Guntas and shown one approach road of 30feet to the Apartment
building and got the construction drawings approved from BDA. Builder constructed the building with some work left out uncompleted. The approach road he provided is of only 20 feet and that too is kuchcha road. This road is passing through the land of some other owner who was compensated by providing equal land from these 32 guntas. The agreement on stamp paper between the builder and the land owner in whose land the road is passing is a part of the total agreement given to every flat owners. Basing on this agreement the BDA has approved the construction drawings.

Now one of the partners of the builder's company has acquired that land which is touching the apartment building from front side and is intending to grab the road in his new venture of 30 flats by joining land of both sides of road and is offering us the passage from his basement of 12.5 ft wide which as per our knowledge, he is bound to leave open from all the four sides of his proposed building.

We are requesting him to give us equal road on one side of the subject land and that will just touch our main gait of the building. We feel he is adamant and is trying to grab the land of road free.

Is there any legal remedy to this case ? Any institution providing legal help at a very low cast as the owners of flats are from middle class.
