There is no Association last 10 years, facing issue with existing members

I have purchased the flat TWO years back and from day one onwards i am asking them to form a body with 5 members people. Every time they are postponing or avoiding with different reasons, even they are not keeping a meeting. Without any discussion with other Owners they are taking decisions which is related to apartment. TWO years back they have collected 40k from each flat for some apartment renovation works, as of now one of the "tiles work" not yet completed.
When i started WhatsApp group and register for Apartment some of the updates are getting to other owners. But simply saying no one is coming forward, to clear that forcely i have arranged a meeting after communicating on WhatsApp group. They clearly planned and brought their family members (nothing but along with wife) & Tenants also attended the meeting and attacked on me with their wards. I want file a complaint legally on them, i request you to help on this.
Last month i have raised a complaint against this issue. But it was closed without any communication, kindly look into this.

They have collected 40k from each flat last two years back, till now tiles work was not done. Every time in the group also we will not get response from them. They are not ready to form Association. Tried multiple times but i couldn't make it.
Hardly i was communicated and arranged a meeting to form Body. But for that meeting they are pre planned and brought their families, supported families & even tenants to meeting to attack me. Finally it was ended with Bank account. But as of now it was not done, they only keeping apartment funds with them. They are no meetings and not communicating anything before taking the decision with any one. Three months back suddenly we got regular monthly maintenance and there is a difference of Rs.1000/- in Watchmen Salary. I have replied in the WhatsApp group, there is no discussion and information to anyone. I have given statement that "Due to there is no action on association and due to this reason i am stopping maintenance & i am not going to pay any charges for that. Last TWO months they have charged me fine of Rs. 200- as of now.
When i approached to file a case, they asked me to raise complaint to Municipal team. Kindly requesting to involve and do something against this issue.

noises/sound pollution from temple from dec to feb every year

I am writing regarding disturbance every day from 4 am to 6.30 am.
There are two temples nearby they are shivalayam and ramalayam. They are putting loud speakers everyday at the mentioned timings and disturbing everybody.
We have students preparing for boards, old parents, heart patients, babies, office going people etc. We are mentally tortured with these songs everyday.
Please do something about it.

garbage cleaning

We from sai lakshmi apartments b. S layout request you to take necessary action to remove garbage as it was not collected from past one week. This was repeated problem. Before we complained and cleaned again it is repeating. Before complaint no is[protected]. We request you to take immediate action as it was related to health. Houseflies and mosquitoes are spreading and hampering the health. Thank you

construction with no boundaries and more floors than the plan

This place in new thippasandra annayappa block 3rd cross hal 3rd stage new thippasandra is under construction (Opposite to house #283) which is located to the opposite lane of c. V. Raman bjp mla office. There is no gap between the building and they keep blocking the road now and then for construction they dump the waste on the middle of the road and no covering is done around the building as it obstructs the people who are walking and the owner of the building says this is how construction is done and does not take any precautions and causes difficulties to the neighborhood. Irrespective of being near an mla office nothing could be done..

lift
Association of my flat asked me to pay 2 lac for the replacement of lifts and other maintenance work. I bought this flat in 2011 from the builder and moved to the flat by sep 2011 even though flat was not fully completed (Amenities and lift were not available at that time). Lift was ready only by dec 2011. That means lift is only 5.5 years old. Lift was having frequent issues, but it was operational. Recently technician from the lift company inspected the lift, as per the request from the association, and give a report stating lift is in bad condition and should not be used in any circumstances (This was happened 2 months back, unfortunately association didn't take any precaution till now and we are using the lift even now). Based on the report from lift technician, association decided to replace the lift. But i am really worried about the condition of the lift which is of 5.5 years old. I fell that builder cheated us by providing this substandard lift. Is there any option for me/association to approach the consumer court against builder or lift manufacture for providing this substandard product? Another issue is that after 2nd year, lift amc was given to some third part vendors and they are continuing till now.

Landlord not returning lease amount after lease expiry

We were staying in a lease apartment in Thippasandra, Bangalore. The lease tenure expired last may (2015) and the owner is not ready to return the lease amount. We had intimated him 6 months prior that we wont be continuing the agreement but he keeps giving excuse and shouts at us when we go to his house to ask money. The lease amount is 10lakhs.

Street dog disturbance everyday night

We stay at ganapathy annai sathya nagar. Here street dogs barking sound in intolerable from 9.00pm to 3.00am. There are childrens and elder peoples staying in this area getting disturbed. So we are unable to sleep properly in night times. Kindly take necessary action for the same. Thank you.

Deficient handover

Background - There are two buildings on the same piece of land (i) Commercial complex named VV Vintage Boulevard and (ii) Residential complex of 32 apartments named VV Vintage Residency. The address is 6-3-1093, Raj Bhavan Road, Somajiguda, Hyderabad 82
VV Vintage Residency is a one basement+Ground+8 floors residential building was developed by Vishnu Vardhan of VV Associates, Banjara Hills. People took handover of the apartments from 2005 onwards.
However, we now realise that the builder did not fulfill the following :
a) Did not give us the fire clearance certificate for the building. The system is never charges, tested and offered for clearance from fire department ;
b) Did not provide the 32 apartment complex with an exclusive drinking water supply connection. In fact, one 2 inch water supply connection was asked to be shared between the two complexes ;
c) Blocked the second vehicle access to the residential complex by building us an office room in the way and gave exclusive rights of our second exit to the commercial complex ; and
d) The builder sold the basement of the residential complex as parking for the commercial complex. However, he did give one parking each in the ground floor for the apartment owners some of which are not under the building but in the open area which he has covered with plastic sheets.
We applied for building regularisation in 2008, but due to non-availability of fire clearance certificate, it is kept pending by GHMC for the past 5 years. However, about 6 of the 32 apartment owners managed people in GHMC and obtained the regularisation.
I am owner of one apartment but bought it second hand in 2006. Since it has been more than 7 years, can this be taken up by the Consumer Redressal for getting us justice.

IN MY SALE DEED, IT WAS CLEARLY MENTIONED THAT EAST SIDE COMMON CORRIDOR AND OPEN TO SKY. UNFORTUNATELY, NORTH FLAT OWNER ERECTED A GATE AND AND USING THE COMMON AREA EXCLUSIVELY FOR THEM. WHEN OBJECTED, HE SAYS BUILDER SOLD INCLUDING COMMON AREA. SIMILARLY OTHER FLAT OWNERS ALSO ERECTED GATES FOR NOT ALLOWING FOR OTHER FLAT OWNERS TO GO NORTH SIDE.

complaint of bamatech builder noida

Bamatech is a builder in sec-53 Ghijjor village noida near kanchanjanga market . Bamatech builder is a fraud and cheater builder. i bought a 2 bhk in its building sai plaza in sec-53 noida. Bamtech builder has not clarified me the unit number and he said that the authority gate will be open to us ,bamatech is not able to open it. The map is still not clear from Noida authority or zila panchayat, all the promises that were made to me are wrong now. The authority gate is never going to open and slum area nearby will not move from there. No loan is being disbursed on its project and it's pressurising me to make full payment.bamtech is asking 30% percent payment again and again How can i make full payment when loan is not being disbursed. I have clarified from different bank ,no bank is giving loan, I am now looking to get my refund from Bamatech builder and now bamatech is not giving my money .they are making fool to all client .Now I donot how to take my money back,when I am asking for money ,they are saying to shift in our new project which is again not approved by bank and near to slum area.Friends donot fall in trap of bamatech builder in buying your dream home.

I agree with the above statement. Bamatech builders are cheaters and liars. We'd also seen a dream to make a home of our own. On Dec'10 we, made the payment of 30% from the total amount to the builder. From 2011, we're going around banks to get our loan sanctioned of the balance amt. We wasted almost 15, 000-20, 000 rs to banks, as their processing banks. Now the builder is saying ur loan can't get sanctioned and he is making a fool o[censored]s. Now tell us what to do. Is there anybody who can just help us. We are middle class family. Everyone have a dream to make a home of own. He is not giving us back our money. Now, what should we do to get back our money.
So, dear friends I beg, if anybody is reading this column, pls pls try to educate everybody around you that BAMATECH is a cheater. A REAL CHEATER. We're going from that much mental trauma becoz of BAMATECH. He doesn't even care for our money.
He dont't have any proper papers for any land. If you are thinking of taking this up, pls first go and inquire with your bank or your lawyer.
Then you will know the truth.

first floor residential nuisance

I am a owner of a ground floor flat
The owners of first floor causing nuisance by providing pipes in their balconies around the flats and draining filthy water on the walking path making difficult move around.
Their balconies also seems to have been constructed unauthorized.Balconies have developed cracks and damage posing threat to lives living under due to falling of debris and collapse..
Toilet pipelines are leaking from top sewage water falling on the path and moving area.
Despite my repeated requests, no response to attend problems,instead they are abusing and threatening.
kindly suggest ways and means to solve the problem.

Fraud Builder

I booked a flat in bhopal in October 2010 for Rs.11 lacs. The builder promised to give the posession in october 2011. I made 60% of the payment and booked the flat but then when i enquired about the builder i came to know that he was a fraud, known for not keeping his words. He built 4-5 pillars on the site of the building and since then there has been no progress. There are many more families stranded like me who are living in rented houses. It looks like he does not intend to build the apartment anymore and keeps insisting us to cancel our booking so that he may sell the flats at a higher price. He is harassing us by not building the flat so that we get agaigated and cancel our bookings. I would like to mention here that the property rates in bhopal have soared more than 50% in tha last 2 years. Please help me out in taking action against this fraud guy.

Apartment not given in good condition

I had bought a flat from Builders in 2009. I was assured to get the apartment in Dec 2009 or Jan 2010. After lot of problems, Builder provided me a half baked apartment in April 2011. Since then I am following up with him for the pending work. He is not responding. We are major problems like water gets in to the Living room and Bed room when it rains and we have to be there all night taking care of it. Couple of such issus are there.
I have followed up with the builder, his engineers, their management but they dont react. Now they dont even pick up my calls.
Could you please advice what steps I should take next?

Unhygienic Water Accumulation/Malaria,Dengue causing situaltion

Near our entrance of the apartment rain water and the water from the toilets gets accumulated every year.But our chairman and secretary are giving us the stupid excuses.We are finding trouble in walking through this water and it stinks badly.Its creating unhygienic atmosphere,it may also cause malaria and dengue in large scale as we have around 50+ families staying here and 40+ people from the age group 0-20. So we feel such water should be disposed off as soon as possible.But the authorities of our apartment are just not willing to consider our major problem and take any action against it.

Approach Road

One builder had acquired some land of 32 Guntas and shown one approach road of 30feet to the Apartment
building and got the construction drawings approved from BDA. Builder constructed the building with some work left out uncompleted. The approach road he provided is of only 20 feet and that too is kuchcha road. This road is passing through the land of some other owner who was compensated by providing equal land from these 32 guntas. The agreement on stamp paper between the builder and the land owner in whose land the road is passing is a part of the total agreement given to every flat owners. Basing on this agreement the BDA has approved the construction drawings.
Now one of the partners of the builder's company has acquired that land which is touching the apartment building from front side and is intending to grab the road in his new venture of 30 flats by joining land of both sides of road and is offering us the passage from his basement of 12.5 ft wide which as per our knowledge, he is bound to leave open from all the four sides of his proposed building.
We are requesting him to give us equal road on one side of the subject land and that will just touch our main gait of the building. We feel he is adamant and is trying to grab the land of road free.
Is there any legal remedy to this case ? Any institution providing legal help at a very low cast as the owners of flats are from middle class.

Knocking noise disturbance from the immediate upper floor occupants

We are occupants and residents of #35/1 6 th main road chamrajpet Bangalore-560018.The name of the apartments is Kamalalaya Homes.Mr.G.Krishnamurthy is the name of the owner for the 35/1 ground floor flat.
One late Mr.Hanumantha Achar & Co is the promoter of the whole apartment and the family resides in the first floor of the building.
The entire family members are so inclined to create all sorts of knocking sounds to disturb our peaceful living in the ground floor.It is more or less like terror strike from the top.This is happening round the clock and especially in the night.Having compalined police,they are yet to take any action.
Kindly curb and put an end to these people's menace at the earliest.

Apartment — Apartment being broken as part of road expansion
Hello,I have purchased an apartment last year. Now I see that the road in front of my apartment is being expanded and half of my home will be demolished. What are the options that I have? Can I hold the builder responsible as he would have known about the expansion priorly and still did not leave enought space in the front. kindly advice me on the same.

Apartment — Residential apartment
HiI along with few others bought an apartment where it has builders/land owners contract for building an residential apartment. The initial plan for to build 5 floors during that time the land was under panchayat limits.
Later on the land has moved into BBMP limits and due to the financial crisis the builder didn't want to build one more floor. Also, the original plan was not changed and approved by BBMP.
The construction was over by 85% and already families shifted in (builder has given the possession certificate)
Now, the land owner, started constructing the 5 floor for rental purpose.Now, how we the residents of that apartment can stop this construction.
Apartment — 24 hrs noise menace
Sir,We are resident of #35/1,Kamalalaya Homes,6th main road(Appu raoroad),Chamrajpet,Bangalore-560018.This is a 3 bedroom apartment and my father Mr.Krishnamurthy is the owner of the aparment.
There are totally 8 houses in this complex and the apartment that is directly on top of ours is the promoter of this complex by name late hanumanthachar.These people are creating all sort of noises right from wooden stick to iron rod hitting noises on our roof top during day and night times.
In this regard,police complaint is given and the problem is still persisting
This always remains as a threat to live in this apartment as they are disturbing the calmness of our living during day and night.
So I request that a suitable action to be taken at the earliest.

Dear sirI had purchased an appratment in udupi. After completion I had given it to the rent.Now builder had taken all the houses except mine from the other owners for rent and started Service appartment illigally. Due to this my tenent started telling he will leave the house and I am not getting others also. As the builder taken all the permisson from authority as hose construction and he is using it for commercial.
Can anyone to give me the guidance how to move ahead and stop this

Loud Deafening Noise Pollution in Residential areas near Hebbal - Kempapura, The Night shift working people are regularly losing their sleep due to this Non-Stop Noise Pollution going on here throughout the day. Non-Stop Nuisance here from a Pet Dog Owner who s letting the Pet Dog to Bark 24 hours Non-Stop throughout the day and entire night is adding to the Nuisance. This particular Pet Dog has been creating Nuisance here by Non-Stop Barking Throughout the day and Non-Stop. There is Increased Nuisance of Non Stop Noise Pollution throughout the day. What is Shocking is that the Residents CONCERNS & GRIEVANCES are NOT AT ALL BEING Addressed giving way to Spurt in Noise Pollution.
We are occupants and residents of apartment nandanavanam flat no110 we are getting sound from our immediate upper floor from early in the morning until midnight and we are unable to sleep or having lot of disturbance since last one year we are regularly complaining but to deaf years
Kindly put an end to these peoples menance it is intolerable

Advance money Not yet Returned
I booked a flat (apartment) with Shreyas Buildersin Baroda (Gujarat) which was owned by Mr. Raveendra Bhate. During booking I paid Rs. 2.5 lacs to this developer/ builder in year 2005-06. After so many years he did not start the construction of the apartment, but instead he closed his office and left Baroda since then. I also heard that he sold his house and moved to Pune with his family. Before he returned to Pune in year 2006 he gave me bank cheque for Rs. 2.5 lacs, but while I deposit it in my bank. the cheque got bounced. I have all the papers, receipts, cheque copy with me. I don't know how to proceed to recover this money from this developer. Please HELP.

Unacceptable clauses by builder
Dear Sir/Madam,
I have purchased an apartment/flat in C-1102 Park Prime project at Gurgaon, Haryana from BPTP Ltd. through contruction link plan. I have been sent a buyer agreement which have certain unacceptable clauses which reflect the agreement to be one sided. I have put a request to the builder i.e. BPTP Ltd. to provide clarification on the same but to my surprise there has been no reply from the company despite several reminders instead I am asked pay further installments.
A copy of the clarification letter is attached here.
It would be very kind of you to take action on the same.

Disturbance on peaceful living
We are living in an in Kaggadasapura, Bangalore of Karnataka State. These flats are constructed by builder on JD. The builder has constructed many pent houses with out any lift facility. The people staying in these pent houses are coming upto last but one floor by lift and going by steps to the pent houses. In this context, we are all disturbed a lot on our peaceful living because of the rush in the floor and lot of noise and sound even in odd hours. This became a nuisance and disturbing our peace ful living. In addition to this, there be lot of noise and sounds from the pent houses which are directly disturbing inside our flat living in all the rooms and all the times. In addition to this disturbance they are using all the resources viz, water, electricity, common area, parking, etc, because pent houses are illega constructions. How to go about this problem ?. Whom to complain ? Can it be registered as a consumer complaint ? If so kindly consider and take necesasary action on the builder who constructed pent houses and disturbing all the living people in the flats. Immediate action is requested . In
