Barclays Bank Plc — Mental Harassement

I started the Relationship with your Bank probably last Year in the Month of November and your Services were good.

After 3-5 Months I was unable to maintain a Good Track record payment and I suppose in the month of June – 2008 I had a Total amount due of Rs.29800 (Approximately) as I paid it in Full by Cheque and then my Services was back to Normal.

When during my visit to Singapore I used my Credit Card and the Limit exceeded to Rs.21000 (Approximately) and due to financial reasons I was unable to maintain my monthly payment dues and I do agree with that. So I was then transferred to many places in South India regarding my Job and recently I came to Chennai I got the Information that I received a Notice from Mr.Ramdass & Mr. A Gunaseelan from Barclays Bank PLC and the information told me to contact Mr.Vijayakumar with the Mobile number as: [protected]

So I thought let me contact Mr. Suresh who was visited my House many times regarding this and when I contacted I told him the complete information with my Mobile number and his reply was” No need to contact Mr.Vijayakumar anyways even if you contact him the matter will come back to me and no need to contact the Advocates either regarding this issue he insisted.

So based on his words I agreed with that and Mr. Suresh with his Mobile number as: [protected] on Tuesday dated: 23.12.2008 from my Father’s Number and explained him clearly he said I will give you 2 Options:

1. You can pay the prescribed amount of Rs.30415 (Approximately) and I will give you an Offer of Rs.1300 and further your Account will be activated immediately which is within 24 Hours.

2. If you would like to close the Credit card account we can go for a Settlement.

I told him give me 2 days time I will let you know based on my Financial Status and gave him my Mobile Number.

Unfortunately I didn’t call him after 2 days which is dated: 25.12.2008 as I was held up in Thiruvarur so I thought I will call him on Sunday (Dated: 28.12.2008) and that’s my mistake I totally I agree with it and I apologies for that.


On 26.12.2008 Mr. Suresh called my Mobile Number and my Wife picked up and he asked where he is and she responded he will be in Kolathur and gave the Residential address. Then he called up my Father’s Mobile number from which I spoke on Tuesday (Dated: 23.12.2008) and spoke very badly giving Mental Harassment to my Father aged 67 Years.

After this incident my Father called me up and he cried literally and I felt vet bad and today which is Sunday dated: 28.12.2008 the same person called me up and I didn’t show frustrations and I spoke with him as if nothing happened.


I asked him did u call my Father he said “No” for that and then I said I can see your Mobile number in the Received calls and the He (Mr. Suresh) said “yes I called” Further I asked him why did u spoke like that for that even he said “No” . Then I told him that My Father recoded the call of whatever you spoke and after that he said “Yeah I spoke what for that” and then when I further spoke with him regarding the Settlement the call got dis-connected and he never called back and even I didn’t had the balance to call him up further.

Madam I feel very upset about these things happened and I would like to know one thing which is I do agree that I’m liable to the Bank and I’ will pay my debts with the contacts and why this Collection Person Mr. Suresh spoke like this (Mental Harassment) Use threatening language over the phone / Vulgar & Harsh Manner.

As per Fair Practices in debt collection India Act:

Banks / NBFCs / their agents should not resort to intimidation or harassment of any kind, either verbal or physical, against any person in their debt collection efforts, including acts intended to humiliate publicly or intrude the privacy of the credit card holders’ family members, referees and friends, making threatening and anonymous calls or making false and misleading representations.
