[Resolved]  Co-Operative Housing Society — Non issuance of Share Certificates

Our secretary is not issuing share certificates since last 2.5 years. Everytime he has some excuse ready. Moreover he is related to a politician and is very rowdy natured. People prefer to stay away from him.

Can anyone help me how do we tackle this situation and force the secretary to issue share certificates imm. this is our right and property.

I purchased flat in 2005, through Bank loan . At that time i got NOC from society signed by one of the three member of the administrative board. Even as the bank had no issue about that, yet the society under the new managing committee refused to take cognizance of the NOC given by the earlier admn. board ( signed by one member) Further as per the new managing committee there was pending dues to be recovered from the previous owner of the flat . Because of this even though i have share certificate but the society has not transferred by name on the same. Even though right from the day of purchase i have regularly paid the society charges /dues etc . The society wants me to pay the dues on the flat ( which was imposed after 4 years of purchase of the flat) . My issue is that society is not transferring m name on the share certificate . This is to infrom you that I have purchsed house from 1st party but he didn't submitted his share certificate along with all his document but now he refuse theshare certicate and demand me some money for the share certicate. buthe transfer all his power on my name and have transfer document with me.
Can I make new certifacte with the help of these document ?

1st owner demanding money for his original share certificate and i want to transfer on my name.
I purchased home in 2006 he given me all the document of home and i complted all the formalites like registration /transfer but without knwing me i forgot to collect socity share certificate copy from the first owner and socity secretary wants that copy without that copy they are not prviding the share certificate form.
Stop paying maintennace fee of the society and put the ball in secretary's court. Let him cibble instead of yourself.
Iwant help from your end can i make new certificate with help of power attorney which given by the 1st owner?

I need your urgent advice urgently.
I am purchasing a resale property in Mumbai from the first owner of flat and already completed registration of flat in my name.

now when I want to avail the bank loan, Bank has asked for Share Certificate.
The property I am purchasing has the joint agreement of husband and wife, while Share certificate is only mentioned name of husband. as per Society, since Husband's name is the first in agreement, it has listed only his name, while my bank has refused the loan due to this.

I am little confused and worried now. Is society done something wrong? is there any documentation about such process?
Can someone please assist me get out of this trouble as this is the first home I am purchasing and quite anxious?

Submit the agreement paper registered with the registration dept showing both names this will entitle for you to get both names on the share cdertificate
I had issued 20 Share Certificate by the Administrator appointed by Asst. Registrar of MAHADA after Committee dissolved. And as per other Society Members they had issued 40 Share Certificates. I had apply to the New Committee Members after Election for additional 20 Shares. They are not replying my 3 lertters and verbally answered go and take the order from the Asst. Registrar of MAHADA to issue the additional Certificate OR the Administrator should give the letter to the Society to issue the additional Shares. Please help me in this matter
I had the same problem. It is easily solved by making an application to the dy. registrar o[censored]r ward with relevant documents He will subsequently direct the society u/s 79 (1) of MCS Act & if they still do not issue the share certicate he directs them u/s 79(2) & if the society still does not comply the Dy Registrar issues a letter to the Tahsildar who then directs the local police station to seize the records of the society After Tahsildar's order to the society they have very little choice than to give the share certificate.You can check T ward Mulund for a recent case where such a method was adopted successfully.Approach legally & do not be Afraid of such strong arm tactics of society office bearers Make sure all the papers /documents are in order.You will surely win.All the best

We had a problem of leakage on our bedroomwall. Hence, we got water proofing done in the presence of one of the member. Now society asked us to paint the wall with the same color. But there is bound to have some difference. But society complains that the colour does not match. These all expenses were done by us. I talked to one of the member in somewhat rude manner, which I regret now. Society said that they will send notice to us regarding this. Society has also delayed the share certificate.
Can society send us notice and of what type when the leakage and painting expenditure was done by us?

In June 09, August 09 I had forwarded a letter to Secretary for issuance of my Share Certificate and then again in October 09 I had forwarded them Banks(from which i have taken loan) letter accompanied with my letter but till as on date they are not cooperating me saying that I should pay Rs 500/- which is towards renevation of the flat moreover they are saying that Rs 500/- should be paid in cash and receipt of it will not be given. The said amt is not being reflected in my monthly bill for last five months.
pls guide me, should i pay Rs 500/- (without receipt)and collect my Share Certificate or what should be done?

Dear sir,
ours is co operative society. ours is terrace flat . Terrace exclusively belongs to us. we have four flats on 3 rd floor and all have independent terrace. Society was regd. in 1957 Society has Held up my transfer of flat in my name Inspite of all the Transfer documents are in order, they are asking us an additional bond on 200=00 stamp paper mentioning that we will not make any construction in terrace. Is it lawful to ask for this additional Bond .

I have bought a property in 2006
I have all the documents and papers including share certificate but the problem is that there are 4 signs in my share certificate as below
1. Chairman - who was the chairman before my purchase of the flat which he sold before me purchasing
2. Secretary - who bought a flat just before me but his share certificate has the same problem as me
3. Treasurer - who was a member that time
4. Witness - who has now applied for membership in 2009

I have purchased a shop in housing society. when i contact to the secretary for transfer of share certificate in my name he refused to do so giving the reason of NOC and demanding me Rs.25000/- for NOC and Rs.3000/- for transefer fees. I was agreed for transfer fees of Rs.3000/- only. Taking NOC is the responsibility of previous owner or not. At the time of regestering of agreement I asked the previous owner about the NOC and he preduced at that time. But now when i show them that letter to the Secretary he said that it is not NOC it No Due Certificate. I dont know what is going on I want to know that whether it is legal or not. Withous NOC registrar never registered the document, my document is registered on that No Due Certificate. Whether it is misguiding to me or cheating of previous employer and the society.
Can Housing Society issue share certificate without paying stamp duty and registration by flat owner ? Can anybody help regarding this issue.

You may approach the District Registrar. Forward copies of the corresspondence and related documents. Obtain acknowledgement and wait for a month or little more. If you donot get any reply take recourse to RTI ACT 2005 and apply to know what action has been taken by the Registrar and under what provision of the Co-Operative Societies Act. He has to reply within 30 (45) days. Then decide the future course of action.
