Our Chairman is not running society as per bye laws
We had open group of watsapp where people were putting their voice, He has turned that group in admin group.Now we cannot raise any voice
There is second group of MC members .Here also he instructed me not to forward any message to open group which pertains to welfare of general members
He had removed me from important group of showing maintenance payment

    This is the 2nd time we are writing this letter.

    Ref: - building sujata empress co-op housing ltd. Plot no 50 sector 35d, kharghar
    Sub: - water problems for the past 1 month

    This is to bring to your notice that we at โ€œsujata empress, plot no 50, sector 35dโ€ have been facing water issues for the past 1 month, we have being receiving shortage of water supply. We have a total of 105 flats in the society and wuth a total of 400 to 450 residents.
    Previously, we were getting a steady and good pressure water supply in the night, from 10.00 pm till 6.00 am in the morning, that makes for 8 hours of water supply.

    Off late our supply timings changed. We have started getting water in morning, from 8.00am in the morning till 2.00pm in the afternoon, that makes for 6 hours of water supply. Also the water pressure was much reduced.

    But past 1 month we have had it worse. We notice that the duration of water supply is reduced to 4 hours. The timing are morning 8.00am to 12.00pm in the afternoon and the pressure is also further reduced, because of which we are facing shortage in water supply to residents.

    We humbly would like to bring to your attention again that we have total 105 flats in the society and with a head count of 400 to 450 residents.

    We kindly request you to please look into the matter and help in resuming the normal 8 hours of water supply under the optimum pressure standards

    Looking forward to work with you and provide any details you may need to take necessary actions here.

      I would like to know the max charges society can ask for and how much time they should allow to submit documents.

        My society is charging 10% non-occupancy surcharge on monthly maintenance bill for my rented flat. I am paying that surcharge.
        Building is now undergoing some repairs and society is charging each flat to share the cost equally. I am ok to pay my share. However, society is also charging me 10% non-occupancy surcharge on top of my share of building repair expense. Is this legal?
        I can understand paying non-occupancy for service costs, but why i have to pay it on top of repairs? Seems wrong to me

          The few residents of shubham residency, near keshav park society, vavol-kolavada road, vavol, gandhinagar has started to collect the fund with name of maintenance charges. Although the builder; anand developers has not handover the society with maintenance fund collected during and also builder has not registered the society even in local body as well as under co-operative society registration. The few residents have been designated as committee members by themself without following rules and law. There is not any memorandum of article and process set up for maintenance. There is not bank account of society. There are trying to deposit the collected funds in their personal bank account. The few residents started misconduct and burglary type behavior to collect the funds by any way.

            Our Society was formed on 1st October 2013. Monthly maintenance for Oct. and Nov.2013 was paid to society and receipt was issued accordingly. In Dec.2013 Society issued a maintenance bill with outstanding amount of Rs. 10147/- along with regular maintenance charges. I had written several letters to know reason for outstanding amount. But society did not reply as on date. Every month amount increases with 21% interest. Base on this outstanding amount society started harrasment to me also refuse to avail community hall facility for my daughter's marriage. It was verbal information that Builder had given me possession in July 2012 for my urgency without maintenance charges and taken Maintenance charges in Oct. 2012 in lump sum for a year.i.e. up to Sept.2013. It was with mutual understanding with Builder as building was under construction. So society wanted me to pay maintenance for the period of July 2012 to Sept. 2012. But do not want to give in writing as society was formed on Oct.2013 Please tell me the solution

              no any parfect meeting no any a/c no any No of registretion on bill to all membar e leagal factory in resident

              my complaint i have not give share certificate and mr jagdish (2) savlaram demand Rs15000/against share certificate

                Change of name in share certificate

                My mother has transferred a flat in navi mumbai to me through a gift deed which was registered /stamp duty paid as per legal rules in 2013, i applied for change of ownership rights, which was acknowledged and accpeted by the society, i again applied for change of name in share certificate, which was put on hold as society told me they dont have the rights to transfer the share certificate.Please let me know how can i get the new share certificate...

                Hello,
                This is regarding Maintenance charges. I need clarification on a simple issue .
                I recently bought a new flat in Housing society. This is a resale flat and I took it from previous owner. The society is 4 years old and still under builder undertake. i.e. Registered Society is not formed .
                Building members themselves decided amount of 500 as a monthly maintainance for secuirity,electricity and other things.
                I paid complete amount of 3000 from Jan 2012 to June 2012 (Rs 500 x 6). Till now there is no issue.

                Now it happened like the previous owner had not paid the amount till Dec 2011. Various charges sum upto Rs 27000 pending from previous owner.
                And now society members are asking me to pay those pending charges. I am held responcible for not enquiring if the previous owner has cleared all the charges at the time of buying.
                I got NOC from Builder since there is no registered society and NOC mentions everything is clear and nothing is pending.

                Now I need clarification on
                1) Whether I need to pay the pending maintainance charges before Jan 2012 when I was not the resident of this society
                2) The society is still not registered. They dont have letterheads also.Its still under builder's undertake. So do they have right to ask maintainace charges from me at all.
                3) Should I be held responsible for not enquiring if the previous owner has not cleared all the dues against him.

                4) I was threatened by committee members that if previous amount is not paid they will take leagal action. How much valid is this ?
                I mean do the members of commitee (o[censored]nregistered society) can take legal action against me for not paying amount before I came in this society.

                5) What legal action can I take against such threat

                maintainnance amt — regarding maintenance of the bldg

                i am tenent resident of apartment in hyderabad,they take maintainance from me every month and when i am not here also they take full amt of maintainance
                i want to know why they take the amt not to do the job
                i want to know the duties of the maintaining society
                i pay so much money to the society
                my car is inthe parking n they dont take care of it
                some one frm the upper floor wash their toilets with acid n it has fallen on my car
                but nobody is takin notice of it
                as i was out of station ,i am usually out of station for three months but when i come back they want to have full maintainance
                plz tell me whta to do now
                children play cricket in front of my car n broken the number plate but they dont take any notice of it

                  Sir,
                  I own a shop in JM Nagar Complex Co-op Hsg. society, Dombivali west and run my graphic design studio in it, there are total 16 shops but society doesnโ€™t even provide essential facilities like Maintaining common toilets, Drinking water and Cleanliness.
                  Society charges Rs 982/- for 180 sq. ft area shop, Rs 90 charges as electricity charges, but there is no facility of common tubelights for shops, rs 200 charges as service charge but there is no provision of sweeper, security guard, common toilets for shop owners anre in very bad state and no water connection in toilets therefore unusable and no common tap for drinking water. i have complained in society several tomes but there is no action taken.
                  It is strongly suspected that there is misuse of funds here, and that the accounts are not properly maintained. Under these circumstances, please advise what best action can be taken against the managing please suggest me which authorities should i approach for the same.

                  Dear Sir, We are living in a Chakan, Pune. In our Apartment there are 108 flats and all are sold out. The construction is of 2009 and till Builder has not handed over the Society to us. We have formed our Ad Hoc committee and running society from last 06 months. Up-till all common electricity meters are on the name of Builder. But the bill of some of the metres has not submitted by Builder, and the MSEB bill for this meters is around 5 Lac rs. So we are not able to pay this bill and MSEB has cut our common amenities electricity meters. When contacted to Builder no proper response has given.
                  We are literally in frustration, pls tell what to do?

                  I am staying in Royal Classic CHS.Ltd, New Link Road, Andheri West.The Office bears of the society has Miss used Society funds to the tune of Rs.3050000/-.It is reliably learnt that the Treasurer & Hon.Sec Has issued Cheque to 6 different parties from society funds and taken cash from them for their personal use, THEREBY COMMINTING a fraud of rupees 30 lakh
                  INSPITE OF REPEATED REQUESTS FROM NUMBER OF MEMBERS, THEY ARE REFUSING TO ALLOW THE MEMBERS TO INSPECT THE VOUCHERS OR GIVE COPY OF SUCH VOUCHERS.

                    Dear sir , I the tenant / member of the socirt NAGSEN CHS ; Shivshrusti , kurla (east) . mumbai - 400024,
                    requires help from ur side . the commitee of our society is misusing the funds of the society as if they are the owner of the society & without any general body election they hadhave elelcted themselves as chairmain , sectetary and treasurer every now n then they are changing things as they wish . by hrrassing the tenents who appose them for what they are doing . we are asking them to take the election so that we can do voting but they are ignoring the things . As this is the free collector Land given to SC/St Caste they are making the sale deed with any one who wants the falt in this societ even they are taking heavy donations from the both parties . and misusing it without any members notification .
                    They had already done a scam of 35 lacs in society.
                    We need ur help as the society commitee has not yet paid the propert tax which is around 12 lacs (twelve lakhs ) . evevn the few members have paid the maintainence amount some members who are suppoerted by the commitee are also defaulters havings lacs of rupees dues on them . so we require u to administor our society with ur way as we had got an attachment from BMC , we had appointed a builder also for Redevelopment fo our society due to bad condition of it , but the commitee demands a huge amount to him which is not possible so we need u to intefere in this matter otherwise we will have to loose our houses in auction. We dont need this kind of committeee .

                    Plz . we are hopping a positive action from ur side .

                      Sub:- Defaulter Committee members and their harrasment to us .

                      This Regarding our society named " NAGSEN CO-OP HOUSING SOCIETY " REGD:- No. :- B.O.M/H.S.G.1195/63 PLOT NO. 16 A / 17 A , SHIVSHRUSTI , KURLA (EAST). MUMBAI -400024.
                      In our society the commitee members i.e the Chairman , Secretary are the main defaulters of the society and they are not mainaining the society even we are paying the maintainence to them , Along with them there are some other tenants who are their relatives and they are also the defaulters of the society with maximun amount , and are supportedby the commitee . so we are always harrassed by them . The commitee members even they don't do any auditing of our society and and just deposits the amount in the societys account and they are make missuse of the society fund and the interest available on it .
                      Already the previous commitee and the current commitee had made a misuse or scam of 27 lacs of society amount and they are now harrasing us for Redevelopment . we are not interested in it .

                      please help us out from the cureent commitee who are illegally became the commitee members of our society .

                      Due to their behaviour our societ has got an attachment letter for " Auction" on may 2011 and they had not even showed the letter of attachment , due to this w tenants are really harrased by this . .

                      This Regarding our society named swantra co-operative housing society situated in lallubhai compound hirandani akruti building no-13 mankhurd west -400043.
                      sir.since i belong to the educated family i know the few things that mhada alloted us a area of 225sqmtr including gallery.sir since we are having a problem of water we gate the water one day after sir because of that we have got the two drums for storing water, since we are not having enough place to place the drumbs inside house we place the drumbs in gallery alloted by the mhada authorities which comes under 225sqmtr, and second thing about my gate which i put for my safety because in our area their is more offence but my gate is opened full dat after 10.30pm iam closing the gate since our society ofiice is on our next room. And our society member ie.two people are belongs to same family but they thave two room.and they have not arranging the regular meetings and they are not informing to buliding people about the expenditure, and they are waisting money which we may required in future for some another purpose.
                      so, sir kindly help us for solving our problem as soon as possible so we can live a good life in this world

                          We live in building for last 20 yrs. which is formed as Co-operative housing society.
                          There is 1 member causing trouble to all others.
                          Actually we have a parking outside the apartment which is not allocated to anyone and its corporation road. So there is no rule that who should park there car where.
                          So its decided to have parking on first come basis so whoever come first will park his vehicle on the whatever space available. But this member is not listening and creating nuisance and using abusive words. He want to park his vehicle at specific place only. This is really problematic in AGM. And we fear if he creates some problem .
                          Please advice how should we take action against such people.
                          Please let us know the rules and regulations and action we can take against such cases

                            I have a flat in a co-operative housing society in Durgapur since more than 15 years.
                            I want to sell the property as I am not living there.
                            I am trying to sell it but the secretary of the society is not letting us to sell it.
                            There are lot of candidates who are wanting to purchase but the secreatary is denying them saying they are non begalis, sometime they are saying they are from other religion, sometimes they are saying they are old and they want young people.
                            I now want to take legal help as I don't see this ending anytime sooner.
                            I would like to know as how far a co-operative society is involved in the sale and what all are the rights of the owner.

                              It's perfect as the Member who reside may be for some reason would not be in a position to pay the dues. Being it's housing Society charging interest on the member should be avoided or has to be very nominal for the caution. If the same member constantly make late payment he should be informed about it.Monthly maintenance charges has to be on time where as if Society takes some repair work and does not complete to the satisfaction of any individual member ( his/her flat getting damaged due to the repair work outside building ) then the so called committee should take responsibility and discuss the issues with that member and settle the dispute. if not it will drag on.

                              Our request to you sir is can a Society abnormally charge RI (21% Compound Interest even though in a General Body Meeting it's approved for SI ) on an individual residing Member. As mentioned above, the member decide to pay in one go to settle all his dues if he is not charged interest/ a very nominal amount as penalty. It clearly shows his interest of making payment to the Society. Kindly suggest. Thanks.
                              Socity can not charge compound interest, only simple interest can be charged.
                              Society can charge upto 3% penal charges over and above normal rate of interest

                                I live in Andheri East,Mumbai in a co-operative housing society our building is more the 15 years old
                                there are 32 flats but many our defaulters even the secretary is a defaulter many of their dues are more than 1 lakh.
                                Most of the people are indifferent to the societies problems.The society is full of filth people throw food,used furniture,debris etc
                                in the society this has increased in the number of musquitoes rats stray dogs.
                                Other buildings near our society are clean but our building has become a great nuisance for people living in our area.It is dangerous for health of everyone.
                                A stern action must be taken against the secretary and the society should be fined. Please kindly tell me were can I complaint about this.
                                And is there any NGO our goverment body which can guide us for steps to be taken against defaulters and the secretary.

                                I am facing same problem, people in society do interior and throw all debris below my window, writing to society commitee has done nothing about it. Whats law for it and where can i complain for the same... Please let me know.
                                You may complaint to the registrar of the co-operative Societies, the Ward Officer of Municipal Co-operation.

                                  Builder — Builder problems in a housing society

                                  Hi,

                                  I have bought a 2BHK flat in Jan 2005 in a society of 50 flats and 20 shops. Till now builder has sold only 10 shops and 25 flats.

                                  As per the agreement, builder was supposed to give the possesion in Aug 2006. We checked the status of building every month since Jan 2005. The building was 90% complete in Apr 2006. But since then builder slowed down the work in building.

                                  Everytime we asked for the possesion date after Aug 2006, he started stating that he is not getting the Completion Certificate from Navi Mumbai Muncipal Corporation (NMMC). Till Jan 2008, he delayed the possesion. And in Feb 2008, he asked the flat owners that if you need the possesion, you need to pay Rs 72.5 per sq.ft extra and also you need to sign the indemnity bond where by he can sell the open parking. Now he is asking for Rs 1.5 Lakh for car parking and Rs 50K for scooter parking.

                                  Builder has not given us the Completion Certificate from NMMC. When I enquired with the NMMC officials over the phone, they told me that your builder had not submitted all the papers. When I told the same to builder, he told us that NMMC officials are lying and he had submitted all the papers.

                                  One more issue is I gave my flat on rent recently as I stay in Pune. My builder started asking for Rs 1 per sq. ft maintenance charges for the flat as I have given it on rent. Whereas I have given Rs 2 per sq. ft maintenance charges for a year already to him while taking a possesion of the flat.

                                  I want to know -
                                  1) Can builder sell the open parking?
                                  2) What should be the maintenance charges for a flat given it on rent?
                                  3) What is the step to get the completion certificate?

                                  I have been allotted Accn No 161, Sector 1, RK Puram, recently. The condition of the quarter is very poor/shabby. Necessary repairs/maintenance are required to be undertaken to make the quarter habitate. Your instructions on the subject to the concerned authorities are highly obliged.

                                  register a complaint with secretary of the society. mention that under section 48(a), (b) the society should act. it is clearly mentioned in this section 48 that the secretary alongwith one committee member shall inspect the flat from where the leakage is occuring and shall give notice to the concerned flat owner to carry out repairing work in a stipulated time. if the concerned member fails to carry out repairing work, then the society shall carry out the work and recover expenses from the concerned member.
                                  also write that u will take action against the society as well as committee if they fail to act u/s 48. it is now committee members personal responsibility to look in to the matter or they will have to pay you damages because the new bonds to be submitted (M-20 forms) by the committee members hold them personally responsible.

                                  several flats in our society, are left unattended and not being maintained. the ceiling beams and coloums are all falling apart. the flat is locked with no one staying in it for the last 13 years. it has been sold in the same condition to another buyer who is also not opening the flat and it remains in the same condition unattended.

                                  I have taken possession on Jun 2004 in newly constructed complex. Some of complex member came together & started proposed co-operative society. Up to March end 2011 builder is handling maintenance & all complex related expenditures & same is taking from all flat owners. From April 2011 builder requested to proposed committee members to take charges of all complex related expenditures. Till date we do not have registered co-operative society.

                                  Up to September 2009 there was not a single problem in my flat. From September 2009 there was leakage started in our lobby from slab. I called builder person & asked to rectify the same. They tried but leakage not stopped. After some time leakage started I my one bedroom & then after second one.
                                  I am writhing mails with photographs to builder saying to rectify all leakages from September 2009 & also having face to face meeting with top most person of builder. After long mailing & meeting with builder, they have tried to rectify from below slab but they have not able to stop the leakage. At the end they said this rectification work of leakage to be done from above us flat bathroom.

                                  I have also given mail (3 Times) to proposed committee members

                                  Builder gone to that flat owner & requested them to give permission to work in their bathroom, but that flat owner not allowing builder to work in their bathroom.

                                  Please let me know what should I do as legal.

                                  Unjust Water Leakage Charges from flat owners by Cooperative housing society Ltd

                                  The water leakage rule made by the MC of this society doesn't involve the duty of the secretary or the responsible authorities.. but it involves the watchman visiting the flat for inspection. The MC has levied exhorbitabnt charges (Rs. 2500) without any confirmation from the flat owner and witohut any visit to the flat by the committe member.
                                  The flat owner also called for a plumber and no leakage was found by the plumber.. however, the MC is not ready to listen and is still going ahead with the fine stating that the Watchman's visit to the flat (no inspection done by the watchman whatsoever) alone will be considered as the proof.
                                  What can be done against the Managing committee/ Secretary in this case.
                                  i am getting a same problem as above i.e leakage of slab of kitchen during monsoon as well there is leakage through wall of bed room.

                                  please led me know how hall mark solution can solve this problem and also give me details of clause or co-operative society act by which i can demand repair from society

                                    This is regarding the encroachment we have made in frount of the shop.
                                    Society has send me a notice to remove the chain which we have placed in front of the shop saying that it causes problems for the society members to pass by.

                                    We would like to add also that there are many shops in my society including my shop have done encroachment in front of thier shop and also few members in the society also have done structural changes in thier respective houses.
                                    Society had send notice only me to remove the encroachment.

                                    I am the secretary of our society. There is groupism in soceity. Fed up off these I lost eagerness to continue in the soceity and I decided quit in this AGM. Chairman of the soceity by mingling with other members wanted to illegally extend their hall till building duct. I am opposing this. But 3 days back chairman illegally did the same thing. He illegally extended the hall upto duct. I am sure many more others will follow him. Please give me some solution so that I can take action against chairman and make him pay the price for this illegal act

                                    The building watchman has informed me that The Secretary's wife has directed them not to talk only to me and my family in the whole society and defaming us. Why at all defame me in the society before the watchman who is a temporary employee. I am a sick person and senior citizen and sometimes I may need help of the watchman when I am alone in the house. They have informed me that because of the Secretary's wife's threaten they are scared to talk to us. I am also not aware as to any resolution has been passed by the Committee Members or in the AGM.Please guide me where should I complain since I am a bonafide member of this society and watchman is the employee. Even the salary of the watchman is paid from my share of the society's maintenance.
                                    Please write a letter to the Chairman / Secretary of your society informing about the incidence, Inform the same to the registrar of the co-operative societies, commissioner of police and further if nothing happens then you need to move to court and file case for defamation.
                                    we have a secretary who has resigned in between the term. can we appoint new secretary without AGM. Also have sent circular stating that watchman will not open gate. can society make such irrational rules..

                                      As per this link ' http://www.karmayog.org/general/general_3086.htm ' Service charges are to be charged equally irrespective of the size of the flat as provided in bye law no 69 of the model bye laws.

                                      Also, the law does state Non occupancy charges can be collected to the extent as decided by the General body meeting but not more than 10% of the service charges as has been stated in the circular dated 1st of August 2001 issued by State Government.

                                      Does anyone know what all is a part of "SERVICE CHARGES"? i.e. Are the following a part of 'service charges': Legal advisor charge, repair fund, sinking fund, common electricity bills, elevator maintenance fee, water bills, houskeeping charges etc??? Most of these are essentials for operation of a society right?

                                      The reason I ask is, if a building has 2, 3 & 4 BHK homes... the larger homes surely use more water, more elevator etc. Would those charges have to be equally shared by all apartments equally?

                                      Service charges means repair fund, sinking fund, sweeper, security, gardener, society manager and legal advisor.

                                      Electricity and water bills comes under expenses accounts. It should be charged to each wing seperately according to their bills. Lift maintenance and repair same each wing seperately if one does not use lift also.
                                      The service charges are to be equally divided. they are: Light bill, watchmen/sweeper/gardner's salary, Insurance, lift maintenance, accounting fee etc.
                                      Non occupancy charge shouold be 10% of the service charge.
                                      Sinking fund is to be claculated at the rate of 0.25% of the total construction cost and to be divided by buil up area of the flats/shops & repair and maintenance fund with the rate of 0.75%.
                                      water charge to be calculated to number of inlets provided to the flat/shop from outside.
                                      Dear Sir
                                      Please clarify, May a housing society charge service tax on water charges bill provided to their members if bill is below of Rs.3000/- P.A.
                                      Kindly mention registration code & head .

                                      The service charges should be uniform where the house sizes are uniform.
                                      For dissimilar sizes, say 800, 1000, 1500 & more sq ft, the logic of charging same maintenance charges does not hold water.

                                      The purchase price of these flats are differnt based on the area, the house tax is different again based on the area, the area is the determining factor.

                                      The bigger house is normally for a bigger size family and that's why larger sum is paid for the extended facility to faciltate use by an extended number of members.

                                      To say that it shoud be uniform irrespective of size of the Flat is to rob Peter to pay for Paul's luxurious living. Highly unreasonable, unjustified and discriminatory.
                                      my socty charging extra 500-rs.per month for taking home tution at home, as left is used by stduent. pl help me. as i m oppose to it.
                                      1. Refusal to allow entry in to the building :

                                      I Mr. R.B. Popat was refused to allow entry on 04.10.2010 in to the building by Mr. Sandip Velhal and One Watch man on duty @ 10.30 A.M. in the morning. Thereafter, I went to Jurisdictional Kidwai Nagar Police Station and lodged NC vide NC No. 1924110 dtd. 04.10.2010.

                                      2. Manipulation of Minutes :

                                      (a) This is to inform your goodself that in the last AGM my wife had signed attendance sheet stating that she object to the removal of name from membership by her. However, when we received minutes it was stated that my wife has agreed to the resolution of removal of name from membership. In order to prove manipulation of minutes we had asked through letter cum notice dated 27th March, 2010 of our Advocate Shri Vinod Sampat to give us certified copy of the 2009, AGM Attendance sheet which was not given till to date by the said society. However, in reply to our Advocate the society stated that they had given inspection to us which was also not given. Further in our Advocate’s letter cum notice what was asked for by us was copies of the several document but none of them is given to us.

                                      3. (a) Allegation of Bazari Activity and removal of name :

                                      The society has by alleging Bazari activity, removed our name from membership of society. However several time including through Two RTI and letters and even through letter cum notice dated 27th March, 2010 of our Advocate Shri. Vinod Sampat we asked for evidence of Bazari activity as alleged by the society, which are not received by us till to date.




                                      (b) Right of cross examination :

                                      We reserve our Right of cross examination of each person who voted against us and in favour of resolution of removal of name from membership of society and ask them to provide evidence of Bazari Activity.

                                      (c) Not granting of hearing By the Asst. Registrar F south, Mumbai :

                                      Not granting of hearing By the Asst. Registrar F south, Mumbai of hearing till to date on removal of our name from membership of the society. We are even not aware whether society has filed such resolution with the office of Asst. Registrar F south Mumbai.

                                      4. Evasion of stamp duty and registration fee by Secretary :

                                      The present Secretary Mr Anil Agnihotri has submitted application along with all record for deletion of his first name from Flat No. 302 certificate, which was accordingly being removed from the share certificate by virtue of application by him.

                                      At that time Mr. R.B.Popat was secretary, Mr. Prabhu Desai was treasurer ( of Sameer) and Mrs. Amla Agnihjotri wife of Mr Anil Agnihotri was Chairperson. We all deleted the First name from the said certificate of flat no. 302 by making endorsement on the reverse side of the said share certificate of flat no. 302 and kept single name of Mrs. Amla Agnihotri on reverse side of the said flat 302 share certificate and all amendments were accordingly being carried out in share register.

                                      This name was removed on application being made by Mr. Anil Agnihotri with all necessary papers on account of Notice from Income tax Delhi being received by him as was told to me by his wife at that time.

                                      I heard from some one that again the society converted single named share certificate of Mrs. Amla A. Agnihotri to First name of Mr. Anil Agnihotri and second name of Mrs. Amla agnihotri.

                                      Now, the issue is how come one can become secretary from flat no. 302 when the stamp duty and registration fee is not paid by them at both instances as narrated above.

                                      We request concerned authorities [ collector of stamps ] to check payment of stamp duty and registration charges on both the above transaction and also on all immovable portion of Abhishek CHS Ltd. (building) including all stilt parking owned occupied by Mr. Agnihotri family.

                                      5. Raising of false maintenance bills of Rs. 33000/- plus towards difference in car and scooter parking by alleging fraud by Mr. R. B. Popat :

                                      It was abundantly proved that we have scooter parking as per Conveyance copy from builder to society which was part of registered agreement of our flat.

                                      The society in reply from their advocate stated that the society has only one type of parking is also misleading information given by committee members to their advocate.

                                      It is also abundantly clear that society has G parking for closed garage P parking for open garage which is further are of two type one is small which is for scooter parking and big for car parking as categorized in conveyance deed from builder to the society. Apart from that there are open parking for scooter ( two wheeler) and car parking for (four wheeler) for which different rates are being charged.

                                      Society alleged that Mr. R.B. Popat has manipulated bill by charging less amount is also replied in Notice cum letter dated 27th March, 2010 of our Advocate Shri. Vinod Sampat’s. However The bill raised by Mr. R.B Popat was same as raised for immediately preceding month by Mr. Kambli ( ex-manager of the society ) who was manager of the society.

                                      In order to prove all the facts detailed documents was called from Society vide letter dated 07.07.2009 And vide Two RTI application In the month of March, 2009 and reminder letter was filed with Asst Registrar Shri. B.D, Ahire for seeking information under RTI vide letter dated 11.06.2009 but no reply is received till to date. And also vide Notice cum letter dated 27th March, 2010 of our Advocate Shri. Vinod Sampat but till to date we received no reply from the society.

                                      We reserve our right to file defamation suit against the committee members.

                                      6. Non raising of regular maintenance bills :
                                      Though, maintenance cheque for Quarter April 2009 to June 2009 was sent by Mr. R. B. Popat society returned the same by stating that the matter is under consideration and returned the cheque.

                                      Further, vide letter dated 03.06.2009. It was intimated to society that the non issuance of maintenance bill by the society is leading to delay in receipt of payment by the society and interest cost shall be borne by the committee members, . But to the said letter they failed to reply.

                                      The Asst. Registrar F south Shri. B.D Ahire was informed of such discriminating act of society of not issuing regular maintenance bill to us vide letter dated 11.06.2009 but no reply is received till to date.

                                      And also vide Notice cum letter dated 27th March, 2010 of our Advocate Shri. Vinod Sampat’s it was informed to the society for non issuance of the maintenance bill by the society, However in response to the said point society through their advocate failed to reply.

                                      7. Not giving Notice of Any meeting including Annual General Meeting :
                                      For the reason stated vide Para 1(a) as stated above committee member did not issue us notice of AGM, because minutes of previous AGM meeting are to be approved in next AGM meeting, which was held in society on 14.08.2010 at 8.00 PM as told to us by some member on telephone. If we object to the said manipulation of minutes by asking them to produce last attendance AGM sheet then the committee members cannot talk on next agenda only !

                                      8. Non supplying of copy of Annual Accounts :
                                      In last AGM society allotted major repair work to contractor which was around Rs. 50 lakh. The society committee hurriedly carried out work for which we demanded bills and several documents through our advocate Shri. Vinod Sampat but till to date they had not given any paper though we have paid Rs. 82000/- plus for such major repair work. The work is done of extremely poor quality as several residents have started complaining about seepage and leakages.

                                      9. Non supplying of information about M/S Semitronics (partnership firm) flat No. 01 :
                                      (a) M/S Semitronics flat No. 01 was Business office in the society building since inception i.e. commercial use. In order to continue them as Commercial Office society in last 15 year never took any objection to them and on the contrary the society was billing/collecting almost double maintenance charges to/from them, the records were asked by Mr. R.B. Popat thorough RTI in the Month of March 2009 by making the same before Assistant Registrar F south Mumbai but no information of any sort is received either from the society or from The Registrar F South Mumbai.

                                      (b) It is was told to us by some one that the flat transfer done of M/S Semitronics (partnership firm) is done without the copy of partnership firm registration certificate in the name of the firm. We hereby demand copy of M/S Semitronics (partnership firm) registration certificate duly certified by the Secretary of the society for verification.

                                      10. Cutting of 20 year old tree (earlier) and few months back removal of garden across our window ( just 20 feet away) which was having 3 big 6 year old coconut tree and 100’s of plants :
                                      (a) Mr. R. B. Popat filed first complaint of cutting of 20 year old tree (earlier) with BMC along with photograph of cut tree. However BMC officer closed the file without recording my statement.

                                      (b).Due to apprehension of death threat from committee members ( based on above behavioral pattern ) Mr. R.B.Popat did not report about removal of garden 20 feet across window of our flat No. 01 which was converted to unwanted parking space by removing from root 3 big 6 year old coconut tree and 100’s of plants. ( However after refusal of entry in to building on 04.10.2010 vide para 1 above I have decided to complain now).

                                      11. Not providing vital details :
                                      Contract copies and Bill copies of for major repair work to contractor which was around Rs. 50 lakh on which Service Tax compliance, TDS compliance both under MVAT and Income Tax was asked through our advocate Shri. Vinod Sampat’s letter cum notice from society to see whether any fraud on exchequer is there or not but no such information is provided till to date.

                                      12. Non acceptance of any letter :

                                      Society secretary refused to acknowledge any letter from us.
                                      I owe two falts but registration is of both ADJACENT flats are seperate. One myself and other my daughter. We have combined both the flats and now we have only one kitchen, one ration card incooperating all family member name. Now what is the procedure or how should I pay service charge. SIngle for both the units or seperate.

                                      I stayed in Dombivli East, Meenal Datta Co-Hsc Soc, The society secreatry is unquailified, not ever she could signed the letter, also the soc secreatry is charging for accessing the soc terrace for which no charge was discussed in any soc members meeting,

                                      Is it illegal to keep paying guest in our own house, our society is objecting not to keep paying guest (bachelors) they have said that they will not give NOC. They have passed a resolution in AGM not to partially sublet the flat.

                                      Please advise what should we do.

                                        Dear Sir,
                                        Our society has different dynamics with 4 towers.Apollo, Athena, Avalon and Atlantis.
                                        Apollo and Athena being 18 storyed and having 2BHK, 3BHK, 3 ½ Flats and 75% of the 2BHK flats are combined together making it 4 BHK,
                                        The 3BHK and 3 ½ BHk have 2 sale agreements with 2 flat nos but only one possession letter and one share certificate. They are accepted as one unit on the basis of the possession letter but 4BHK have 2 agreements and 2 possession letter making it 2 units.
                                        They are 4 flats on each Tower. Total 140 flats in both towers put together in Apollo and Athena.And the sqft area of 2BHk is 1075 sqft.
                                        T he Avalon and Atlantis have 3BHK, 3 ½ BHK and 4BHK flats but all with one sale agreements and one possession letter .They are 17 storyed and have 3 flats on each floor. Total 98 Flats.
                                        Under the Byelaw no .69-A our society has without any proper intimation or calling a SGBM to explain what the impact will be has decided to make our service charges flat –wise from 1st Jan 2011 The builders were charging us Sqft wise and even when the MC was formed in 2009 it was agreed in the AGM the will be paying maintenance charges are wise.we have been prepared for the repercussion when we bought these flats in 2005 .But when the Hon Secretary who knows the byelaws have not informed us at that time and admits they overlooked the same and they have even taken away our option to from 2 separate societies which would have been more fair and practical.
                                        Since our building has different dynamics there is no equitable distribution presently with all 2BHK ( 1075 sqft) having to pay Rs.6000 more + 3BHK to pay Rs.1500 more 3 ½ BHK have to pay less- Rs.3000 and 4BHK ( which is the 2BHK combined ) having area of 2150 Sqft to pay Rs.12000 more for Quarterly maintenance charges.
                                        It should be noted here that a 4BHK flat in Apollo/Athena of 2150 sqft will pay 12000 more as against the 4BHK (2750 sqft) of Avalon/Atlantis which will get a discount of Rs.9000.
                                        The most affected is 2BHK in Apollo and Athena .while a 4BHK flat in Apollo/Athena will pay maintenance charges of Rs.70000, the bigger 4BHK flat in Avalon/Atlantis will have to pay only Rs.35000 .Is the allowed?
                                        Since there are 238 flats in total taking all the flats together, they have arrived at these figures dividing the total service charges divided by 238 flats.
                                        What we have suggested is the total service charges to be divided into half and them divide tower wise or Athena Apollo together and Avalon/Atlanits together which will make it more fair and equitable .All the service are equally used-same area of lobby in all 4 towers, same number of lifts (3each), security equally divided, FM boys the same and the club and swimming pool facilities. Since Apollo and Athena have one extra floor we are also agreeable to give due weight age to the on extra floor we have when there is an unequal distribution of flats how can we divide the amount by total number of flats? That would basically mean that Apollo and Athena are subsiding the cost incurred by Avalon & Athena which is extremely unfair.
                                        We have to also pay backdated the differential amount from the date of society formation which will be a very large amount some o[censored]s have to pay for no fault of ours. When it was decided earlier area-wise can they change it now without a SGBM.Do we all have to pay for his mistake?
                                        They have quoted the court verdict of Neptune CHS for paying flat-wise which we resident feel cannot be compared with Raheja Acropolis as we have totally different dynamics and structure
                                        On the basis is it better to form 2 different societies? We do not wish this to happen as it will hinder the progress of our society. We would like them to divide the billing and then charges flat wise or continue are wise billing.
                                        Please suggestion or commitment in to this matter.

                                          Non issuance of Share Certificates

                                          Our secretary is not issuing share certificates since last 2.5 years. Everytime he has some excuse ready. Moreover he is related to a politician and is very rowdy natured. People prefer to stay away from him.

                                          Can anyone help me how do we tackle this situation and force the secretary to issue share certificates imm. this is our right and property....

                                          i had 2 flat in our society on the top floor, in our society we had 2 wings A and B both the wings are of 4 th floor, i ahd 1 flat each in both the wing on the 4th floor.

                                          In the year 2008. we had faced lot of problem due to rain water from the top of the ceiling and wall in both the flats. due it there were dampness on the ceiling and wall. i had made complaint to our society in 2008. but they had taken action for water proofing of terace this year in the month of June 2009.

                                          My question is that the dampness which is there in flats, Is there any right to the member where he can claim for the dampnees from the society.

                                          I have contributed a amount to society for repairing which was going to happen in that month (Dec 2009), but some how all of the tenants did not gave money so it was held up. After that there was no meeting held about the repairing.

                                          As when the work was to be done was not sure i asked for refund & gave a letter to secretary.

AGMs are also not called for last 5 years. Our society has got an ownership flat at ground floor. It's monthly rent and maintenance also comes regularly. But, the committee members are not ready to show the funds of th society. We need an amount to build a shed on the terrace and it is a preliminary need.

                                          In the recent monsoon most of the families are suffering from water leakage from the terrace. They are not agree to construct the roof on the terrace, as most of the societys have done and their problems are solved.

                                          Can we sue the society? What will be the procedure?

                                          I am a member of a society called Pramukh Vijay Coop Hsg society in Marol, Andheri (E), which is part of the LT Colony. We have been residence of this society for the last 30 + years and have been very regular in paying all the maintenance and other charges demanded by the society at regular intervals. However now my grouse is I had a near death accident when my roof of the 4th floor aprt that I live in collapsed and almost killed me and my son. Before this I had major leakage which destroyed my fan and I made a complain of the same to the society. They did not take any action to this and hence the second mishap took place. Now they have woken up and agreed to do the repairs of the terrace which is in a miserable state, so much so it could be dangerous to the whole building. However we refuse to pay the charges for the damages caused to myflat due to the negligence of the society in full, they reckon they will pay only 25% of the charges and the balance 75% has to be paid by me. Please let me know if this is justified. Also is there a clause that says that the society will pay only 25% of any damages casued to members flats due to negligence of building maintenance as they mention to me. Would appreciate your advice.
                                          As per the bye laws, the terrace belongs to the society it is their duty to see that the terrace is done. pl. advise your cell/tel. number may be I could speak to you on this issue & give you more knowlege also there are many associations which do come forward to help

There are few members in my society who have not paid their dues which sum upto amount of over Rs 3, 00, 000.00. Neither the secretary seems instrested in taking any necessary action, nor any other members have raised any concerns.                                             I am staying in Registered Co-op Hsg society. The Society collected a huge amount of money for Repairs and maintenance which included plastering, painting and a portion of the amount was used for doing some work in the Garden. They sent an AGM notice stating that if anyone wants to go through the accounts, then they should give it to the Managing committee in writing.
                                            When the same was done, they sent back a letter stating that they cannot show the accounts, as the member will have to pay an amount as per the byelaw no. 172.

                                            It is strongly suspected that there is something fishy here, and that the accounts are not properly maintained. Under these circumstances, please advise what best action can be taken against the managing committee and whom to approach for this

                                            It is bed experience of transication M/O throught post office, I have singed Rs 1000/- from jaipur vidhyadhar nagar to my father at kerela, (Idukki, Kumily, Chakkupallam )on date 10/07/2009 thats delivered on 13/07/2009, but not recieved by my father and the name and signature on reciept (that i have recieved) was not correct, with inquairy with postmaster and post men They are not agree that particular M/O was not recieved and delivered by there end but in the reciept (acknowledgement) having post office seal.

                                            In our society, the managing committee never took election for the last 14 years. The committee feels that the new generation is not capable of handling the society matters or development issues of the building. They boast that they have vast experience in the above.
                                            Now, 27 members out of 40 members in the society have asked for dissolution of the committee. Finally with much adu the committee agreed to conduct election. All the committee members are contesting for the seat in new committee.
                                            CAN THE COMMITTEE AFTER RULING THE SOCIETY FOR 14 YEARS ARE ELIGIBLE TO STAND AS A CANDIDATE FOR NEW COMMITTEE.
                                            They are defaulters in many ways. We want this people out of the race in contesting.Kindly advice.
                                            The bye-laws says if you want a copy of any communication/accounts/letters/minutes of meeting from society you have to pay Rs 5/- per copy. But if you want to inspect the same in society office no need for any payment .Just write a letter to the secretary that you want to inspect the required information in presence of any office bearer. They have to show you within a period of 15 days failing which you can approach Dy Registrar. It is your right to see any or all the information you need.
                                            Please refer to the bye-laws of Co-Operative Housing Society Page no. 33 Sr no. 118 and to the MCS Act 1960 page[protected]FF) (e) says: no person shall be eligible for being elected as a member of the committee or co-opted:If the MC member failed to pay the dues within three months after serving of notice in writing, served either by hand delivery or by post (under certificate of posting) demanding the payment of dues.

                                            In the case the defaulter’s notice was served to all the defaulters including the said defaulter who partly paid after 5 months (not within permissible time limit of 3 months) continues to be a defaulter, the said MC member seized to be member of the Managing Committee.

                                            The Hon; Secretary always misguide the General body in the AGM by giving baseless excuses, the intention was to shield the said defaulter saying since no one is willing to join the committee and sometime the MC members don’t attend the meetings .Not following the bye-laws amounts to violation even General Body have no authority amend the bye-laws.


                                            (i) Refer to the order of the Divisional Joint Registrar of the Co- Op Societies, Mumbai Division, Mumbai says that if the MC Member did not execute the necessary bond within the prescribed time limit of 15 days after assuming the charges of the office of the society as required u/s 73 (1AB) of the MCS Act 1960. Even, If the member has executed the bond but after the period of 15 days. Therefore there is violation of mandatory provision of the said Act. Due to this failure of the MC Member to execute the necessary bond in 15 days, for this reason alone he seized to be MC Member of the society. failing which the matter will be escalated you write like this and inform the Dy Registrar for inspection of recprd then he will hve to issue show cause notice and follows other procedure to appoint Adminstrator.
                                            ANy one can stand for election even previous MC Members .But see to it that at the time of fdiling the form they are not defaulter and all dues are cleared even one month rent sholud be cleared

                                            now the same woman is now hon.sec. is spending twice the without tender's ! same the 10year same hon.sec is now as hon.chairman

                                            Now is asking to increasing monthly again in 8 months ?
                                            the society has enough money, but not to squander.
                                            a) expensive tiles~*Rs.62/tile total cost is over 4lac ! my contractor has given estimate Rs.2.8lac.~ *question is why the other remain "cash"
                                            (where Rs.25, 000 would touch-up the cement would be o.k.)
                                            b) want's a gym in 80 sq.ft in a 35 year old building !!
                                            Co-operative housing society Complaints - Builder has not done the proper work in society and also not registered the society what legal action can betaken fastto solve tis problem soon ?
                                            I have contributed a amount for repairing work, but somehow the work was not done, & now I want my money back as i can use for other reasons.

                                            As per Annual General Meeting decision I will withdraw my letter dated 08/09/2009. But thing is society will not to write a single letter to
                                            Mr H.R.Devadige Flat No. D/35. 3rd Floor, Why ?. I have given his residence address at the time of Annual General Meeting on
                                            9th August’2009. & Special Annual General Meeting held on 20/12/2009.
                                            This time all society members had visited to my house and see the
                                            Leakages / Cracks. This is the major problem & serious matter. and then also not to take any serious action only meeting is going on & quotation Callings.

                                            If a member feels that the mg.committee has been misappropriating funds of the society members, then it can apply to the ward coop registrar for an inspection of the records and accounts of the society. During inspection all records will come out and if any mischief is found, the registrar will take appropriate legal action.

                                            our society matters have not been handeled by the books. a lot of misguidence and extortion is going on. members are not ready to speak cause they may lose their parking space, membership, etc. a grop of autocrats are ruling. past two years balace sheet has not been discussed. sub-comitees have been formed before AGM. basic amenities like water supply of the non defaulters is cut without noice. now without AGM they are out to get a new registration number.
                                            please help the ones who are willing to raise thier voices for help.
                                            Managing Committee is misusing the funds, they take a 80% OD facility against our Sinking Fund without passing in the AGM and even not taking the consent of the majority members and they have uses of this funds in paver block. When we argues to registrar found that Society is making a application for using the fund in paver block but registrar has given the permission to use this fund in Building Repairing. Great surprise we found in above data. Please advice what can we (member) do
                                            The building in which we are staying have not yet formed a society but they are planning to install CCTV camera and therefore are asking for Rs 3000/- per flat for installation of the same. If few of the members are not willing to give the money as society is also not formed and even they are not willing for the installation but proper security persons. What are the rights of owner of flat whose society is not formed whether they can deny the installation or money??If society is formed whether it is mandatory for pay the money of such above purpose if the people takes such decision in future...please let me know both the consequences if soc is not formed and if soc is formed??
                                            I have made certain payments towards society, but they have not issued receipts for the same, instead they have used the payments for settlement of other issues which I have not instructed, can they do this legally. I understand as per Maharashtra society law 1960 it is illegal for them to do this. Am I right in fighting them on this issue. Thanks for your advise.

                                            My society's Mg committee has passed in SGM Rs. 40 Lakhs for deemed conveyance. Without giving tender and without knowledge of members of society and allotted work to one Advocate . Mg. Comm. Has also disbursed Rs 1, 70, 000/=
                                            Ld. Dep. Reg. Has also objected but Mg.Comm. Has not obey the order of Dep.Reg.of Co-Sty.
                                            I am planning for gather signature of some members for requisite SGM with fresh scrutiny of tenders.
                                            Kindly help me if you have some crucial suggestions.

                                            i live in cooperative housing society in which the ex chairman had made payment to advocate regarding indvidual court cases that to after election were held and during the handing over period. even the bill recireved were after election period. can he officially do this deed once his tenured has ended. no resolution was ever passed.

                                              Maintenance charges

                                              Hi,

                                              I have bought a shop (150sq ft) in saki naka and given on rent. the society is charging me maint charges as 1200 Rs. Please let me know is there any rule for CAP on maintenance charges. It is not a posh society. can i bargain on maint charges, Should the maint charges to be the same for smiliar shop of same size. Can I get refund of these charges paid in past by myself.

                                              Secretary's resignation

                                              I have resigned as the secretary of my Housing society in Mumbai.
                                              I find no one coming forward to take up the responsibility and be the secretary. There are a few members who have been responsible for causing this trouble to all the residents.Need help on how to deal with this situation.
                                              I can take my resugnation back provided I am able to restructure the committee with a few new replacement in the members
