My society is charging 10% non-occupancy surcharge on monthly maintenance bill for my rented flat. I am paying that surcharge.
Building is now undergoing some repairs and society is charging each flat to share the cost equally. I am ok to pay my share. However, society is also charging me 10% non-occupancy surcharge on top of my share of building repair expense. Is this legal?
I can understand paying non-occupancy for service...

Demand of extra money showing as outstanding

Change of name in share certificate

There is 1 member causing trouble to all others.
Actually we have a parking outside the apartment which is not allocated to anyone and its corporation road. So there is no rule that who should park there car where.
So its decided to have parking on first come basis so whoever come first will park his vehicle on the whatever space available....

Service charges

As per this link ' http://www.karmayog.org/general/general_3086.htm ' Service charges are to be charged equally irrespective of the size of the flat as provided in bye law no 69 of the model bye laws.

Also, the law does state Non occupancy charges can be collected to the extent as decided by the General body meeting but not more than 10% of the service charges as has been stated in the circular dated 1st of August...

Non issuance of Share Certificates

Our secretary is not issuing share certificates since last 2.5 years. Everytime he has some excuse ready. Moreover he is related to a politician and is very rowdy natured. People prefer to stay away from him.

Can anyone help me how do we tackle this situation and force the secretary to issue share certificates imm. this is our right and property....

Maintenance charges

Hi,

I have bought a shop (150sq ft) in saki naka and given on rent. the society is charging me maint charges as 1200 Rs. Please let me know is there any rule for CAP on maintenance charges. It is not a posh society. can i bargain on maint charges, Should the maint charges to be the same for smiliar shop of same size. Can I get refund of these charges paid in past by myself.

Secretary's resignation

I have resigned as the secretary of my Housing society in Mumbai.
I find no one coming forward to take up the responsibility and be the secretary. There are a few members who have been responsible for causing this trouble to all the residents.Need help on how to deal with this situation.
