[Resolved]  Cosmo Infrastructure Pvt. Ltd. Bhubaneswar — Builder Amitabh Mishra has cheated the customers

Hi,

Why to file a consumer case? Why not a FIR in a police station? Why go soft on the builder?
Is there any resistance from any source for filing a FIR?

In my opinion, we should not rely on the builder association, as they (the same money sucker individuals) will only support another builder.

Is there anybody in this forum who could file an FIR or can share experience if there is any obstruction in filing an FIR?

We are a group of 4/5 people trying to lodge an FIR. We have visited sahid nagar police station around 20 times. They are simply avoiding to accept the FIR. Each time we hear a new story. They ask us to wait and meet IIC Jugal Das. We wait for 2-3 hrs and then leave.

Last time we were asked by sahid nagar police to lodge FIR in Nayapalli PS. When we approached them, they refused and asked us to move to court.

My experience is that its not possible to lodge an FIR if you do not have a good contact in Police.

Dear All,

Just spoke with Kartik who is willing to coordinate this. We should draft a common complaint and collect signatures along with a copy of the proof of payment.

Since I do not stay in Bhubaneswar its difficult for me to coordinate but suggest all bhubaneswar guys should meet on a weekend and plan for next course of action. Some of can join through a telecon, if thats possible.

1. We all can engage a god lawyer and share his fees, also have an arrangement with him that if he manages to get all our money back he would get a percentage - this could be explored.

2. Lets also file a compalint at the consumer court. I know things move very slow but I still havent lost hope in our judicial system.

3. Multiple FIR filing is a good idea.

4. We can take Media's help to generate public opinion . There could be many more such Amitabhs operating and people shouldnt become easy preys to such greed who want to become rich by duping unsuspecting innocent consumers.

Its really painful to see someone vanishes with our hard earned money.

Lets not give up !

Can we decide on:

1. a common forum for the discussion
2. who are the members in the forum / aware of the forum

We have been trying to meet IIC of shahid nagar, but not able to catch him due to his absence( i don't know whether he is really busy or trying to avoid FIRs). I had a discussion with ACP Satyanarayan Panda who assured me of giving orders to IIC to launch FIR against Amitav Mishra. But it seems police is not coordinating in this case and it needs high escalation route. Media is also keeping mum..( i think even they have got a share) .Request all of you to make calls and explain your pain to higher authorities of police. I am sharing link to get the same.

No comments for last few months in this forum. Please don't give up. We need to keep the momentum on.

Recently I heard about a cosmo project (an apartment) happening in BBSR near Dumduma.
Local folks in Bhubaneswar - please check the owner of this apartment.

Please keep posted about the outcome of attempts made to file an FIR.

Lets do a periodic conference call to be in touch with each other. As a group, we might succeed.
Can we also explore the option of hiring an lawyer to file a case, without an FIR? All o[censored]s can share the lawyer fees. At least one legal case should be in place to have some hope of recovery of our hard earned money.

what is legal action if agent provide defective machine to us and we already return the same to agent but agent is not ready to return the money and abscond after receiving money send there is possibility that he may declare himself as insolvent. please give opinion - my mobile number [protected]

I agree with Pravat; We should not give up; by doing so we are only encouraging other builders to conduct this easy way to earn and deceive innocent people. Come on Guys.. This is our real hard earn money and should not be vanished this way..We need to be geared up;

Understood that we all are busy with our daily activities, but am sure we can definitely find some time to take this forward.

Is there anybody from Bhubaneswar who can act on behalf of others. That person will collect copies of docs from all members and go for filing FIR, if not possible through legal route. I can speak to some of my relatives who are working in Odisha police to help us out.

How to Lodge New Complaint ?
Orissa State Information Commission has taken a new initiative under which a person/complainant may lodge a complaint against any Public Authority in case of denial of any information under RTI Act 2005. The complaint will be directly lodged with the Commission itself. The interested complainant may register complaint online with OIC. The procedures to submit new complaint are as follows:

1. Log into Orissa Information Commission website www.orissasoochanacommission.nic.in
2. On the home page click on “Click here to submit a Complaint online” link or Click on “Click here to go to e-gateway home page”. If the complainant Clicks “Click here to go to e-gateway home page”, the e-gateway page is displayed. Click on “Lodge Your Complaint” link.
3. Fill up the fields as given in the form.
4. Click on “Save the Complaint” button.
5. The complainant receives the system generated Online Temp. Registration number on the Screen.
6. The complainant prints the copy of the Online Receipt for future reference.
7. The complainant uses the Online Temp. Registration number to check the status of the complaint in future.

Thats a great idea. can any one from Bhubaneswar volunteer with e-mail address to collect all the details - we can scan the payment receipts with details and file a common RTI . I know this has been dragging for quite sometime now. Lets take some concrete steps. Pains to see all o[censored]s losing our hard earned money - imagine the loss on interest, our investment on real estate would have grown twice by now.

Such episodic interest and protest is not going to yield any result. We need to come togther and take some concrete steps to bring this guy to book and atleast do the right things to ensure that we all get justice and yes importantly our hard earned money. Can you guys put all the details in a story form - how big was the project, how many people duped, rumours floating around. I want to write to both print, TV as well as electronic media to generate interest on this dying story and keep it alive. In future who knows our fight could save othesr from getting cheated of their hard earned money.

As far as I know, Cosmo Infra was planning to set up a project with more than 400 duplex houses in 3-4 phases with other facilities like swimming pool, playground, temple, etc. In the first phase, it has started booking for about 105 units in Phase-I. Cost of individual units was about Rs.40 lakh. As far as my knowledge goes, the company has collected booking amounts ranging from Rs.5 lakh to Rs.15 lakh from about 60/65 customers. Assuming an average of Rs.10 lakh per unti, total amt collected comes Rs.6-7 crore. In that he has purchased land not only for the project site, but also different locations at Bhubaneswar, Puri, etc.
It is learnt that he is constructing an apratment near infocity albeit on dubious names, without coming to the front. It has also been gathered that now a days he is staying in Delhi. WE MUST ACT & ACT FAST...

I am also cheated by Amitav Mishra. He has taken 20% from me.
I have not returned back my money yet.
I want to join your group also. His brother is staying in Bhubaneswar and I came to know that Amitav Mishra is doing some project though his brother.
If you guys get some update please let me know.
He should be brought into the public and should be punished severly so that other builder before they cheat the public should think 100 times..
Please let me know if you get any update on Amitav.
