Daer Sir, I stay in a co-operative society. Want to know my rights as a member of society as the chairman and secretary makes difficult rules which have no relevance and creat lot of discomfort. Recently they have made a rule regarding use of entrance gate as well which is very vague. also they use security to get them implemented. securtiy guys are merely the puppets in there hands and behave in a very rude manner. I did tried to discuss with them but they are adamant. please guide how can i fight this out as I have paid for use of common amenities and also am paying maintainence on regular basis. rgds..

I am leaving in the co-operative Society in Ahmedabad and we have 4 flats in one floor. I am putting my Shoe rack out side of my house and my opposition neighbor having issue with Shoe rack. There is no rule to not to put the outside of the my house. Even 4 others are also putting out of 18 member. Now he gave notice to society chairman to remove from outside of my house and show me by law for 169(a).

Please suggest what to do?

There is no rule as to dump anything outside your apartment/tenement. It is a matter of civic sense as in case of Britain, where there is no written constitution governing the country. civic sense is you have to confine yourself within the limit your Apartment / tenement area. A piece of area that is allotted to you by the Society does not give you right to extend the use outside your area. The area outside your apartment is Society's area hence should not cause trouble / annoyance to others. Many complaints are coming even about parking the vehicles. They should be parked in the common area / area allotted by the society but not to dump where ever you like. Even society is justified to charge parking fees.because it is society"s belonging.

Kindly inform: Under Gujarat Co-operative Housing Societies Aact and Bye laws:
[1] What is the percentage of surplus required to transfer to 'sinking fund.?
[2] Can I add third name to two joint holders of shares in GCHS ? Which form should I use ? How much Stamp value needed on the document?
[3] Which form is needed for appointment of Nominee/ nominees? and how once appointed nominee]s] can be revoked using which form and its stamp value?
[4] If no nomination is filed, whether appointment in will is sufficient? In that case does it need Probate?

dear sir,

our copertaive housing soceity is registered soceity having registerno 4139 situted at karelibaug vadodara. each and every members having their own banglows. and this soceity is more than 50 years old soceity. Recently 3to 4 banglows owner sold their banglow to new owners. But they are not informed to soceity and not even applied for transfer of membership and not transfer share certificate. new owner got physical possesion of block and they are start to live in their banglow. i am president of soceity. please let me know what legal step we can take against old /new owner . so they force to pay our soceity transfer fee .
