In Kingston flash products there is a technology called "wear-leveling" algorithm. Basically, flash cells can only be written to a certain amount of times (100, 000x's I believe is the number), so if you only fill for example, a 512MB card with 10MB of information, delete it, and repeat, throughout the life of the flash, the flash's first 10MB worth of cells would go bad before anything else, making the flash product dead. To alleviate that problem, the controller reserve 7 % ~ 12% spare blocks for bad block replacement to lengthen the products' lifetime. So that if a couple cells die prematurely, the flash memory will still function normally.
This also ultimately prolongs the life of the flash product.
This could be one of the reasons why the capacity may be slight different from USB drive to USB drive.

If the product is genuine Kingston product, not physically damaged and within warranty terms, then it is eligible for warranty.
