[Resolved] Kumar Properties — Booking amount Refund

I booked a 2 BHK apt in Megapolis in Pune with Kumar Properties in August 2008. The builder later called me and informed me that the tower I booked the flat in would be delayed and I should shift my booking to a new tower, which I denied and asked for refund. There is no agreement done b/w me and builder and not the builder is not returning the money - 4L. I had borrowed this money from market at high interest cost, and I am also not sure about my job. I had booked 1bhk flat with initial amount of Rs.51000 at Navi Mumbai with Rushi Constructios in May2008 but later Builder taken Rs.150000 as Instalment. I requested him to give receipt but he has refused & make to payment. Now after 9 month he send me interest charged Letter of huge amount.& forcing me to make the sell agreement But in next 6 month My Job will be in trouble so I requested him to refund my money but he refused & told me your amount has been forefeited & you wont get any refund
I have not made agreement so How could i get that amount from Builder.

Please advice me.Shall I go to take legal action against him ot suggest me another way to reciver my amount from him.
