[Resolved]  Mahidhara Projects PVT LTD — Selling plots without having gpa over the same

Hi,

I have booked 2 plots in Mahidhara Central on March 16th 2013 for my brother-in-law and for me. I have booked Plot No: 15 (2200 Sq.ft) for my brother-in-law and Plot No: 19 (2200 Sq.ft) for me. We have paid the booking amount of Rs.2,00,000 for each plot by 20th March 2013. After that, we started providing necessary documents to get the loan from AXIS Bank. My loan got sanctioned by 1st week of May 2013. Since, my brother-in-law is an NRE, it got bit delayed in getting his loan sanctioned. His loan gets sanctioned by 29th of May 2013.

After all our loans are sanctioned, we asked mahidhara about the registration date. They said, they are waiting to get the General Power Of Attorney (GPA) from the land owners for the plots-15 and plot-19. Once they get the GPA, they can go for registration. Also, they said, it will take 10 days to get the GPA. After 10 days, i called them to ask about the registration date. They said, as the owners are abroad, it will take little time to get the GPA. They keep of saying the same answer till end of July.

On 31st of july, Mahidhara said that they got the GPA for the adjoining plots:13 and 14 (Both are 2200 Sq.ft each) in the same sector, and it is ready for registration. So, they asked me shuffle my plots to Plot:13 and 14 to which i agreed. I also gave a requisition letter to shuffle my plots to Plot 13 and 14. After 1 week, on 7th of August, mahidhara said, they are yet to get the GPA document bundle for Plots 13 and 14 and said me that there are some other plots for which GPA papers are ready and are available for registration immediately. But the other available plots are either less than 2200 sq.ft or over 2200 sq.ft for which we are not interested.

Also, I already informed mahidhara, in the month of may, that I will be going abroad in the month of august and won't be available for next one year. Since, they said it wont take till august for the registration, i waited for some more time. But now, i will be travelling by 20th August and still there are no updates on the registration from mahidhara. So, I have planned to cancel my booking.


Its been nearly 5 months we have paid the booking amount. Also, my brother-in-law and I have spent a lot of money to get the documents ready, and to pay for the loan processing fees. Not only about the money, we have spent lots of time sacrificing our works to get the documents ready for the loan. We want suitable compensation for all the trauma we have faced apart from booking amount, interest on the booking amount, and amount spent on documents and loan. I don't know how mahidhara is selling plots even without getting GPA from the land owners. It amounts to cheating and forgery. I am going to file a case against them.
