[Resolved]  Pradeep Deviah & Associates Pvt Ltd — Defaming by publishing photograph in Newspaper

2. Confirmed with effect from 28.4.2008
3. Discharge information given by email on 17.4.2010 at 11.05 am, stating the reason as “In the over, two years time you have been in employment with the organization, there are numerous instances, where the management has felt, your delvery on certain roles & responsibilities assigned to you has not met expectations. We felt the gap would be bridged over a period of time with experience and time spent in the work space. However, we notice that the disparity between expectations and delivery still exists on variouas activities. We now feel, your skill sets, attitude and aptitude, may perhaps not be suitable for our industry and its ensuing demands. We therefore wish to relieve you of your responsibilities in exactly a month’s time from the date of receipt of this letter and are accordingly providing you a month’s advance notice as stipulated in your confirmation letter. You willl be required to serve out this notice as indicated therein
4. Accepted by me by mail on 17.4.2010 at 1.05 pm
5. Abruptly relieved by email dated 23.4.10 at 10.27 am
6. Srinivasan S, Directo & Preident sent out a mail to all staff on 23.4.2010 at 11.11am defaming me by talking of my skil sets, attitude and attitude and also stating I am unreasonable in my demands of PL encashment and that I had declined similar requests earlier, though I had recommended for it and it was also sanctioned by Srini, but declined by Mr Pradeep.
7. Letter of Reliving bearing No PDATF/GEN/001/2010 dt 27.4.2010 was given, relieving me on 23.4.2010, of my responsibilities.
8. Email dated 1.5.2010 sent by me demanding my PL encashment and 15 days salary for every completed year of service in terms of industrial Disputes Act.
9. My demands declined by Srini vide email dated 11.5.2010 12.45.07 ist.
10. I filed petition with LO on 19.5.2010 about my demands, and to look into them if they are justifiable and obtained their acknowledgement. Hearing is slated for 18.6.2010.
11. IN reply to Srini’s mail to all staff ,I sent out a mail on 18.5.2010, to Pradeep with copy to all staff exposing the true reasons for retrenching me and also exposing their constant violation of law and unethical practices. This hurt their pride, prestige and ego.
12. Therefore, on 2.6.2010 a Public Notice was published by them in TOI with my photograph, once again defaming me in the eyes of the general public stating that “anyone dealing with her with reference to the Organization will be doing so at their own risk”

Reason behind retrenchment-

I supported a pregnant lady who was first sanctioned maternity leave and then asked to resign and when she did not, was terminated mercilessly and she approached labour officer who in turn ensured all her benefit, and , besides, exposing their violation of law and unethical practices.

Otherwise does t take 2.4 years to judge a person’s skill sets, attitude and aptitude?

Totally agree, and pradeep deviah should be sued and damages claimed from them.
