[Resolved]  Society — illegal redevelopment

This is regarding the redevelopment of our residential complex Chandresh Residency Co-operative Housing Society Limited situated in Lodha Complex, Mira Road (East), Thane, 401107 and registered under TNA(TNA)/GNL/C/729/[protected]/ (year 2001 dated 27/12/2001).

We would like to bring to your notice various irregularities by the office bearers of the Federation of the Chandresh Residency Co-operative Housing Society, who have appointed M/s PNK Spaces Redevelopment Pvt. Ltd. for the redevelopment of our residential complex which has 8 buildings and 316 flats, are not following the redevelopment process as per the bye-law of the co-operative housing society and have not taken the consent of the Chairman, Secretary and Treasurer of few buildings in our complex and went ahead and selected and PNK Spaces from start without the consent of the owners of 316 flats.

The office bearers of the federation which looks after the functioning of all the 8 buildings have kept all the owners in dark and did not involve them or informed them about the progress of the redevelopment process keeping them in dark nor did they reverted on the written queries by various societies in the complex.

In the month of ramzan in iftar party,all the secretary and chairman of the sociteyhas given the signing authority to chairman and secretary of federation for conveyance and redevelopment. This authority was given without the approval of members of society.
After the process of conveyance advertisement was given in the news paper of inviting tender.5 developers has purchased the tender and federation had taken the meeting with all the developers. Federation has never opened the offer of any developer and finalized the pnk without the approval of any of the member. Federation has informed about the appointment of pnk as a developer through notice on 2 oct 2011.
The offer which pnk has given was not accepted by any members in the society.
Federation has appointed pnk without the approval of the members.It is also mentioned in the minutes of the society that they are not ready for redevelopment with pnk.
Again on 7th march 2012 federation has distributed circular that pnk has arranged site visit on 11th march. Approval for the same was also not discussed with any of the members.
Again on 22 april 2012 federation has given circular that they have arranged meeting with pnk in GCC club with all the members.on 13may. The approval for the same was also not dicussed with any of the members. Expences for the meeting is being arrange by the federation which includes 632 people lunch .No discussion for the same with any members.
On May 13th 2012, the federation organized a meeting between the owners and the builder at GCC Club where they took past owners and several people from each owner families to show majority and get the allotment letter. While that meeting failed to get the required support from the owners who realize the federation was cheating with them as they were not getting anything from the builder – no corpus fund, no bank guarantee or extra space as per the provision of redevelopment. It was surprising to see the Registrar also attending this meeting who has not bothered to listen to address our complaints filed against the federation about the irregularities in the redevelopment process.

After 13th May 2012 meeting, the federation has started taking sign from all the flat owners on irrevocable consent letter with franking paper of value of Rs. 100, which is illegal. The most shocking is that they are taking signatures by going to each flat and taking signature from housewives who are uneducated and unaware what this document is all about. Once they manage to get signature on this consent letter nobody can stop them from going into redevelopment and hence we would be obliged if you help us in this crucial matter related to our building and save us from falling to our federation who has their own vested interest and taking decisions at the cost of the 316 flat owners.

Most of the owners of 8 buildings in the federation especially ‘E’ and 'H' wings and majority owners of other buildings under Chandresh Residency have been complaining and opposing the redevelopment process due to no clarity and miscommunication from federation who did not bothered to address the same and was very aggressive in their approach and always wanted ‘E’ wing owners to accept their terms and conditions and brainwashing owners to come forward and accept their proposal. Now other wings have also understood their plot and going against them and hence we would like your support in highlighting the same.

The current redevelopment process adopted by the federation has a backing of only 25% of the owners while 75% owners are against it as they are not following the prescribed redevelopment process as per Thane redevelopment Act.

Please find attached all the communications shared between the federation and the registar to help you understand the issue in detail. The attached documents include:

- Advertisement of the redevelopment inviting tenders from builders
- Complaint against federation by few socieities
- Complaint for dissolving the federation
- 3-4 complaints to registrar against the illegal redevelopment process
- Irrevocable consent letter by federation on franking paper for getting signature from all the owners for their consent on going ahead with PNK builder.
