[Resolved]  Society mismanagement — Committee formation and society rules

Dear Sir,

I am a flat owner in one of the co-op. hsg.scties in Mumbai.

An adhoc managing committee of the society was formed to take over charge from Builders.

The Adhoc Committee called an Extra Ordinary(Special General Body) Meeting to discuss the various rules and guidlines of the society.

In the above meeting, some group of members formed a Managing Committee of themselves in the presence of other members of the society and got their term passed for 5 years. When questioned, they state that the GB has already approved.

Pl clarify, tif an official Managing Committee can be formed and elected in an Extra Ordinary Meeting without a process being followed and without suficient timelines, inviting nominations, circulars, etc?


This committee has further set arbitary rules to govern the society:
1. Water charges rate - same for 1 BHK Flats and 2 BHK Flats. Further, there are 3 diff areas in 1 BHK. Is the Society justified in charging an uniform rate for diff areas of flats. I believe it should be on Sqft basis.
2. Similary, repair and fund contributions have also been arbitrarly charged. i.e. Lump sum amount of Rs. 5000/- per flat for 1 BHK and 7000/- per flat of 2 BHK. Apart from diff areas in 1 BHK flats, 2 BHK flats are larger than 1 BHK in size by atleast 50% . Pl advise, as the 1 BHK members are suffering and are made to pay more.
