[Resolved] Tata Motors — Engine failed at 28320 kms, warranty not given
I have purchased TATA Motors' HCV TATA LPS 4018TC, for which billing date is 31/03/2009 bearing Regn No. CG-13D/3951. The vehicle is being purchased from TATA Motors Showroom, Jaika Automobiles, Raipur (C.G).
The Sevice Manual depicts under Warranty. The vehicle as a whole shall be warrantied for 18 months, where as cummins engine is warranted for 24months or 150000 km.
All the free service and maintainance is being carried out at TATA Motors' Authorised Service Centre, Shivom Motors, Raigarh (C.G)
For which, engine oil consumption has been 1st reported on 19/11/2009, at Shivom Motors, Raigarh(C.G) when the vehicle km mileage was 26520km. and susequently on 21/11/2009, 27/11/2009, 3/12/2009.
And finally on 10/12/2009, when it has been found that the 'HIGH ENGINE OIL CONSUMPTION IS DUE TO ENGINE FAILURE'.
Before dismantling the engine, it was being said that the Tata Motors may replace the engine in warranty and in any case if the TATA Motors reject the warranty, then the customer will have to bear the cost of Engine Overhauling, otherwise Shivom Motors will not dismantle the engine. Due to the fear of Freight Loss, we have agreed to pay if the warranty is being rejected.
After being guaranteed that the repairing expenses will be paid, if the warranty got rejected, than Shivom Motors dismantled the Engine and rejected the warranty after dismantling the engine by saying the Deisel used is adulterated and finally we have to pay Rs. 76,300/- as repairing charges.
Where as we have been purchasing deisel from Shree Balaji Engicons, Belpahar, Dist Jharsuguda (Orissa) for last three months. And Shree Balaji Engicons is providing the guarantee for Quality and Quantity and is also ready to get the sample sealed any time, we or TATA Motors has any doubt.
For which we argued with the Shivom Motors' Work Manager but they straight forward denied to get the sample sealed from the vehicle as well as from the petrol pump. And kept on claiming the deisel used is adulterated.
Where as the engine failed due to the fact that there is manufacturing defect in the vehicle or the lubricants provided by Shivom Motors is not genuine. It has also been noticed that the employees of Shivom Motors sale the lubricants without bill at cheaper rates. So, there is possibility that the employees might be mixing other cheap lubricants or may be water to complete the lubricants stock.
On being complaining of inferior quality of Engine Oil provided by Tata Motors , no action has been taken.
The TATA Motors personnel claims that the adulterative deisel is being sold in the Raigarh City, that is the only reason for engine failure at the Raigarh City, where as the fact is the adulterative deisel is being provided by TATA Motors' Authorised Service Centre at Raigarh City, for which the Engine gets failed in Raigarh City.
Now, after being complaining to higher authorities as well as TATA Motors Customer Assistance Centre, no one is interested in solving the issue, but they are only talking of we will not consider your case under warranty.
Please suggest me, whether we can sue through consumer court, if yes how and where we can sue.
