[Resolved]  Tata Motors — Cheating by Dealer M/s Mudgal Motors,Ajmer

My Indica Car bearing Registration No. RJ 01 1C 3562 met with an accident on 21st May,2007.The car was sent to above dealer for assesing losses and prepare estimate of repairs.The dealer intimated me over phone that there shall be approx. expanses of about 35,000/,as I was bed-ridden after the accident.Dealer demanded Rs 15,000/ towards making estimate and getting the Car surveyed by the Surveyor of Ins. Co. Without my knowledge the dealer submitted an estimate of Rs 3,78,681.38 to the surveyor on 24th May,2007 and again submitted supplementry estimate for Rs 49,621.97 thus making a total of Rs 4,28,308/ towards the repairs whereas the cost of new Car was approx. Rs3,90,000 at that time.The surveyor in connivance with the dealer fixed Ins. cos liability for Rs 1.40,583.88 thereby the remaining amount for repairs i.e. Rs 1.02,000/was to be borne by me. Neither the dealer nor the surveyor was kind enough to intimate me the above matter and instead of making the case of total loss the surveyor allowed repairs.The surveyor mentioned in his final report"Repairer was advised to call us on dismantling of vehicle,but he did not call us and only after complete repairs,asked for final settlementof claim. on query,he apolosied with letter that he had taken photographs but they gor abolished due to some technical faults in computer."Unaware of all this, I came to know on 31st August,200 that the Car has already been repaired, when Mudgal Motors asked me to lift the vehicle after payinng Rs 2,42,000. Finding a wide gap between the claim entertained by the surveyor and the Bill for repairs, the surveyor was requested to review the case and confirm if the replacements as shown by the repairer were actually required and if yes why the same have not been allowed by him.When I visited Mudgal Motors on 24th Sept.2007 to inspect the Car, it was found that the same was not ready and several parts were either lying open or not fitted. I sent a complaint to Regional Manager,Tata Motors,Jaipur and Tata Motors,Passenger Cars Business Unit,Mumbai on 14th/16th October,2007 but of no avail. In the meantime the surveyor issued another report dt.6.10.2007 and allowed additional claim of Rs 36.209.54 after a lapse of over 3 months of his final report.Despite several requests, the repairer failed to show the actual salvage of parts replaced when the undersigned visited his works on 29th October,2007.However, on 2nd Nov.2007 the repairer sent the Car to my residence with his Sales Manager and Workshop in-charge with request to take delvery after making payment. I found that the defects reprted earlier were still there and the wheels of the car bubbled badly when driven on road. The headlights for which I was charged Rs 3,700/ each were od inferior quality and the battery was also a used one.Dissatisfied with the claim as also the workmanship,I had no option but to approach the Distt. Consumer Court,Ajmer for redressal of my grievance.As justice was denied to me, I was compelled to file a case in State Consumer Dispute Redressal Commission,Jaipur.After a long fight, the court issued its order on 21.10.2009 thereby instructing the Ins. Co. to pay the entire Bill amount plus interest @ 9% to me and the dealer was ordered to hand over the Car in good condition after making necessary repairs.It was only on 30th March,2010 that the issue of salvage was settled between Ins. Co. and the repairer.I approached Mudgal Motors to deliver me the Car as per instructions of Court. Mudgal Motors refused to deliver the Car unless I sign written statemnts in their favour that the Car is o.k and I am satisfied with the workmanship.Again while taking delivery of the vehicle it was noticed that once again the Headlights have been replaced with the inferior quality and do not conform as per quality shown in the Bill.The General Manager,intervened and got the same replaced. I was assured that the Car has been vigorously checked and is roadworthy.When taken out of the garage for Road Test, it was found that there was no oil in the Power Steering cup and the steering could have failed ,had the car been in speed on the highway.Despite repeated telphonic requests,the additional keys of Locks replaced have not been provided,overnight parking showed that Engine Oil was leaking ,Horn not working, and electrical wiring loom has not been provided between the switch and the headlights for motorised operation.I have been forced to get the above defects removed from private mechanics as it is very difficult to have faith in a dealer,who is indulged in unfair trade practice with the blessings of 'TATA MOTORS' My requests to Tata Motors to get my Car examined by their experts and declare it Road wothy have proved futile.In the event cited above,I do not have the courage to drive the above vehicle repaired by Mudgal Motors and put the lives of my family members at stake.In case if 'TATA's' do not take any action against their erring and dishonest dealers,I fear the day is not very far when the Tata's slogan 'World Class' will be replaced by'Worst Class'. Through your platform,may I request Mr. Ratan Tata to please look into the whole case and do the needful so that no other customer is cheated by your dealers. It may not be out of place to mention here that if a secret poll is arranged you will find that 100% customers are dissatisfied with your existing dealer at Ajmer but have no option. As both huge expanses and time is requireed to fight legal case in our country,the sufferer do not find enough courage to raise his voice against the corruption and misdeeds of your dealer.

All blames are ficticious. He was having problem with inssurance company due to his negligence.
