[Resolved]  Tek Care India Pvt Ltd — Willful delay in providing service & unfair trade practices

I have an AMC for my washing machine for the past three years. The current one is from 19/01/2011. I had water leak from the machine and called your personnel 3 weeks back. The charge demanded by your personnel for replacement of the discharge tube was Rs.450/-. I was told over phone that its cost is Rs.250/- only.

After 2 days, the machine didn’t function and upon lodging a complaint your personnel found out that it is due to starting trouble. He said the part can’t be replaced on AMC as the machine doesn’t have a Serial Number. The said cause is not from my end and as a consumer we do not even know that the machine has / has not a serial number. The following are my complaint numbers: CHE [protected], CHE [protected], CHE [protected], CHE [protected] & CHE [protected]. It was not at all fair to have denied service on this grounds.

I spoke to Sri. Thirukrishnamurthi @ 43181001 on 06/12 and he assured that he will revert back, which he has not done till date. I also spoke to your office the same day and I was directed to call Sri. Sathya Narayanan @ [protected] and he too assured to look into. He had earlier demanded bill, which I said was out of context and the case is not about warranty but about AMC. I waited patiently for a couple of days and called again on 10/12/11. He promised to repair the machine positively by 12/12/2011.

To my dismay the machine is still unattended and your personnel had not even bothered to call. I called Sri. Sathya Narayanan and again narrated the whole event, since he has forgotten altogether. He asked me to put back so that he would gather data and call me back. He later talked about the hose issue repeatedly [4 times] when I told him time & again that the issue is different. It seems that your organization is resorting to dirty tricks to avoid the replacement. He again told that by tomorrow he would send someone to inspect.

May I request you to answer the following?

- The machine is under AMC continuously for the past three years, how all on a sudden you had denied service?
- How come you had entered AMC thrice for this machine without the serial number?
- Why can’t I feel that your personnel had indulged in removal of the serial number in order to avoid servicing citing this as a lame excuse?
- Why you had not bothered to rectify even after 3 weeks?
- Having accustomed to the gadgets in this era, is it not inhuman to put a customer in such a piquant situation?
- Is not the very purpose of AMC totally defeated and had you not put in enormous amount of strain in my life for no fault of mine.
- Are you not only liable for liquidated damages but also for the hardship caused?
- Do you feel that the machine owned by me is a duplicate one?
- Is this the way a professional organization would behave?

Atleast at this point of time, may I request you to please rectify the defects immediately at your cost under the AMC?
