[Resolved]  Used Car — Token money

I have given rs.5000 to a car owner against token money to buy a used-car at the time of night. he had hand over the car to me and i had promised to pay balance money(rs.113000) within next 10 days.
Next days the car was not in that condition as he told me befor handed over the car. i refused the deal and return the car. But he is not returning my token money back. there are no any proof of documents.

what should i do.
