[Resolved]  GreenView Villa Pvt. Ltd — Earnest money is not returing by Real Estate company after cancellation of plot

Dear Sir or Madam I am in Singapore Before I come to singapore in last Feb 2015. I book a plot near Rajarhat New Town from GreenView Villa Pvt. Ltd and given an earnest money Rs.495000.00. This was done in hurry and I found that when I checked with a Layer in kolkata. My Layer advised me to not to take the plot and cancel the booking. I have cancelled the booking and GreenView Villa Pvt. Ltd is agreed to refund the earnest money I payed. But they are behaving very strange way and delaying unnecessarily to refund. 1. I cancelled on 23rd April 2015 and filled up written form given by the company. 2.I have return the searching documents they have provided to me and documents(Sales Agreement) from Singapore sent to their office but they have not collected the Document from Postman so the document is returned to Singapore. 2. After 30days when I asked about refund they told me after Cancellation form is not accepted because they have not received a document (Sales Agreement). 3. Then they said they need 45days after All the documents returned to them. 4. 6th June 2015 Personally I have traveled to their Kolkata office and handed over the document (Sales Agreement). They asked me to sign another cancellation form. And they said another 45 days to wait after this. 5. They have sent a post dated cheque dated 20th July 2015, but Cheque is not realized till now and Company told me that I should not have deposited the cheque to Bank. They have told me the reason why I should not have deposited it. Till now I am waiting for the money - returning the money is delaying by this way. Please help.

The company has return me full earnest money. So don't have any more issues with this company.but I would advise all who are dealing with property please consult lawyers before you give any money to dealers.

As per our records you booked a plot on 24/02/2015 by paying Rs. 4, 95, 000/-. Our company rules you will deducted 40% from the total deposited amount in case of Booking cancellation. But if customer apply it within 30 days from the date of Agreement & it seems like documents are inappropriate at that time customer will get full refund. As per our Lawyer there was no dispute in anywhere of our documents which is provided to you at time of booking. But you are not agree with us on that time. And you applied on 06/06/2015 for cancellation. So, its already 30 days has passed . Inspite of that, we will committed to you that, you will get 100% full refund (Rs. 4, 95, 000/-), no deduction has been made from your amount. That’s proof our intends not to cheat with you or anyone else. Otherwise we declare that, you will deducted 40% or your money will be not refunding. Reminding we are not doing this. As per business rules no one can hold money in hand for a long time. In each & every business, owner has invested money in their business. In the mean time we are having some business trouble, goes with ups & down. Inspite of that, we already paid your full amount (Rs. 4, 95, 000/-) by partly wise. Those copies are attached with this comment. Yes there was our mistake that, we can’t pay your full amount at a time.
Inspite of that, we see that you post that type of misguiding behavior. If company intends to cheat with you, company is not pay your amount back. May be it takes some time we admit that. But company refund you full amount back. If require proofs, please see the attachment photos.
Dear all, we admit it there was a mistake from our end that we can’t pay full amount (Rs. 4, 95, 000/-) at a time & it takes some time to back full amount. But its very true that payment will full clear, no more dues. Inspite of that Mr. Basar doing like this.

Can you clearly specify why your lawyer advised you not to take the said plot and also why did the developer asked you not to deposit the cheque? With your detailed reply I can suggest you the action plan.

Thank you for reply.

First, My lawyer advised not to take the land because Developer did not own the property yet and they had just entered into Sales Agreement with original owner of the land. Then original owner does not have Sales Deed either, other contradictions found by searching banglarbhumi.gov.in about owner name, plot name, plot type, etc. When I entered into Sales Agreement with Developer I did mistake by not searching these information, specially not checking the sales deed.

Seconds, after asking many times, they gave post dated Cheque, on receiving they ask me to inform before deposit. I said them I will deposit on the same day Cheque is dated(20/7/2015). Then I deposited the cheque on 20/7/2015 and reported them. When I reported them that I deposted the cheque they said- I should not have deposited the cheque. Later they stop the cheque and it is return to my bank in SBI, Berhampore.

After this I warned them about filing a case for this. Then I sent me email saying sorry for payment delay and requested extension upto 10th Sept 2015. But again they delay until 14th Sept when they transfered initial amount Rs. 1.5 Lac, then again on 23rd Sept 2015. Still remaining amount Rs. 2.45 Lac pending and they said they will pay soon. But never give me any date for the refund- that makes me worried.

That is the last update.
I still looking for faster recovery of the money.

I urge you to check all details by a experienced lawyer and pay him his fees. If not you may have to pay lot more by other mean. So don't make quick decision in such matter.

Even thay have return me money but after lot of struggle and frustration.

Your Boss gave warning that final day when he was writing the final cheque " If I was not his customer he would have something done to me"- It is very scary. Don't repeat this to others.

Greenview Villa has paid me full amount by 10-10-15 and initial return request sent was April 2015. Almost half-year. Any way Thanks for refunding the whole amount.

Thanks for your huge suggestions, but may be it will not required. As per our records, Our first payment to you was 14/09/2015 by NEFT, Rs. 1, 50, 000/-. Then, 23/09/2015 by NEFT, Rs. 1, 00, 000/-. Then, 10/10/2015 by Cheque (No.- 664854), Rs. 2, 45, 000/-. Please check your bank statement carefully. So, don't say any fake comment. Public is not foolish. 2nd payment was made 8 days after 1st payment. And 3rd payment was made 17 days after 2nd payment. So. what was the wrong from our end. We kept our commitment. Yes it was just delayed, but it proves our intends not to cheat with anyone. For kind your knowledge several times you given threat to us before it payment. We never react anything. So, don't be exited.
And finally thanks to accept for payment full cleared after 2 months over.

Do you have any information that exactly when they are planning to give the possession.

Earlier it was December 2017 & on the same month, they have sent an email that they need more time of six month for the possession which is current month but till date they have not started any basis task at the site.

I am bit worried.

I'm having the same issue here. I have also purchased land in Amrita Village. They were supposed to handover the land in Dec 2017 and have also requested for a six month extension which is over now. When I went to the office and asked for the handover date, no one is certain. The manager told me to contact the Managing Director for details. Now from 9th June 2018 I'm trying to contact the M.D. over the phone for a short meeting. 3 times I was told that the M.D. was busy. Green View office has told me to pay the balance amount which is not much and get the land registered which they will do. My question is can you register a land which is not yet handed over to you on what basis? At first they were talking nicely but now their behaviour has changed a lot and acting strangely. All I need is to make sure that I'm not cheated and get the land as soon as possible. Can anyone suggest?

I am also in same line. I have given my full money.

Also, they have done the registry of the land (Amrita Village) in 2016 and they have given delivery date of December 2017. Later, they increased the date by 6 month to June 2018, which is also over.

I am not sure what they are planning to do.
Do anyone know when they are planning to deliver? What is the current status of project?

Hope you have not any Black Money. Just few comments you have seen & you post this type of word against a company. Listen it carefully, what you think about us its not an issue. But the main issue is you can't any comments with out having proof in your own hand. May be you visit our side but you didn't book any plot. That means you are not a customer of our company. So shut your mouth & keep quite. We are not a cheater but you proof that you are a fake. First you book any plot, after completion your full payment then you have decide. Mind it...
Any idea when they will start the possession. Seems lots of people have bought land from them and no one has any idea when they will get it.
Since last 2 years they are saying like work will start after Monsoon, then after Vote, then after something and so on. Some times they used to say the front properties are not sold yet, hence there is a delay. Not sure what actually is going on.

Don't behave like fraud, if you book any plot then please contact to us directly.
I am willing to book in the green valley but I am worried when they will deliver the plot. can I get that information?
