HTC — HTC phone overheating

I have purchased HTC Desire 820 10 days earlier and it is getting heated frequently and battery is draining like hell. The service centre person are saying that I have t obear this problem and there is no solution for it. I want my phone to get replaced. I have spend my 24000 on it. Such a company cannot cheat people like this.
