HTC — My cell phone HTC 516 was replaced with a duplicate phone after i submitted to the service centre in bangalore

I bought a new phone from HTC 516 from Bharat Access (jayanagar b'lore) but i got a phone which had microphone issues, I called up HTC customer service but they didn't help me. After 7 months my phone had lots of issues like SIM1 was not detecting, camera pic were black in colour and the microphone was corrupted etc. I gave my phone for repair on Jun 15 2015 and I was told to collect it after 5-6 days and was told to call the customer service before coming. I called up the customer service after 6- days but they said me the device is ready please collect it on 26th June 2015 which is 11 days instead of 5-6 days, when i went to collect my phone I was told that I will be getting a replacement brand new phone as it cannot be repaired and asked me to come back again on 1st of July to collect the new phone. I went back again on 2nd July '15 and collected the phone but with old battery and old back panel. They did not gave me box piece. After I used the phone for 2 hrs I realised that there are more than 5 problems in the phone. Display light starts flickering like a tube light when I start any app, Speakers are low as mute, call button doesn't work to make a call, Hangs alot, when inserts any memory card it gets corrupted and has corrupted 3 of my SD cards, Old panel and battery doesn't fit well with the new phone issued to me and irritates when using the touch screen and many more. I went back to the service centre on 4th of July and spoke to the manager that the replaced phone is a duplicate one. Manager immediately offered me another new phone to which i refused as i don't believe if that model 516 not be a faulted piece again. Manager offered me DOI and asked me to go to the retail store and ask for a brand upgrade as I did not wish to take the phone from the service centre for same model because I don't trust them any more.I did not had earphones of which the HTC service centre said the amount will be deducted by the retailer of which i was fine I wanted a new phone HTC826 and was ready to pay the difference amount but the retailer from Bharat Access tried to gave me a used second hand mobile with the market price money...I asked for refund amount instead if replacement is not possible but he clearly refused and abused me and the Manager of the HTC service centre for getting the DOI. I went back to service centre and asked what can a customer do when the retailer is bashing and trying to double cross and asked him for refund amount but he clearly refused me. All I want is the refund amount or else a different model to which I'm ready to pay the extra amount. I also have some messages from the HTC manager where he is trying to excuse and not talk to me. Manager : Senthil ([protected]) Retailer : Fayaz ([protected]) Rahman ([protected]) After a long wait i got an update from HTC that i need to submit my cell phone to the service centre and it will be decided by the team for further process. I submitted the duplicate phone to the service centre but i was shocked when i was told by Zahid from the HTC escalation team that i will be getting a replaced phone again of the same model. I was verfy dissappointed as i had already rejected this offer from the service centre on 4th of July. Tey also said that it is not possible to give a model upgarde or refund. But I did not accept there offer of replacement and asked for refund or model upgrade to HTC826. Please help me on this as its been 12 days and i have not got any solution on this. HTC people are trying to delay and escape and giving me same info..once they also said that model upgrade is also possible but later they deny the same. If i want model upgarde i want only HTC 826 because my friend is using it and it seems working fine or else refund of entire money so that i can go for some other brand.
