We had first received telemarketing call on 22-Oct-2016 noon saying “Fortune Inn by Jukaso – ITC hotel group celebrating 35 years & invited us for Dinner with offering free 4 vouchers holiday stay in group of hotel’s to their Journeys Resort Pvt Ltd by Jukaso from Fortune Inn by Jukaso, Viman Nagar, Pune Office. Marketing team ensured that I am on track to attend the meeting.
Sales Executives invited & explained the holiday / timesharing scheme with lucrative offers under name of “Journeys Resort Pvt Ltd by Jukaso” an Fortune Inn By Jukaso group company & showed us Fortune In hotel/Resort brochure too. They had proposed multiple packages, initially we were reluctant, not convinced and asked time to think, research & get back.
After sometime, Rakesh Verma (Branch Head) involved to convinced us saying this is celebration one day offer & decision has to be made now by paying 100% payment. The company has 10 days free lookup period & you can cancel your membership during this period even though contract is signed for 100% refund with promise.
By that time it was late 10.00pm & we made our mind to enrol for minimal package of Rs.60, 000.00 with overall 30 nights stay with yearly 4N stay with accrual option in Fortune Inn group & tie up hotels/resorts with free food, free club, Spa, Gym, free 6 months monthly family dinner @Fortune Inn etc etc…. we had paid Rs.60, 000.00 through my Citi Cr Card & filled up enrolment approval form with personal details & requested for receipt, form photo copy & Rakesh Verma’s Fortune Inn business card. Rakesh said that he had to submit this form to head office for an approval with your spl offers, once approval is in place, next day he will come to our place for contract sign off wherein printed features, special offers, refund clauses without any fine print T&C.
After dinner, we reached home & researched about “Journeys Resort P Ltd by Jukaso” timesharing online consumer forum reviews & shockingly we saw all negative feedbacks as fraud company. That time we made our mind to rollback our application & NOT to enter into contract sign off. Immediate next day i.e. Oct 24, 2016 I went to their office to withdraw my application and NOT to enter into contract sign off, thereby I had requested for 100% refund of my money before contract sign off & not to avail your services.
I had reported the above matter to company several times by emails to their official email id between Oct 24, 2016 till date and subsequent follow-ups over official phone.
Although, I had received their cancellation confirmation against application of membership by email on Thu, Oct 27, 2016 with 90 working days refund clause, however, I had declined their refund waiting period and conveyed that I had not entered & signed off formal contract with the company, hence terms & conditions including refund waiting period are not applicable to me.
Therefore, I had requested immediate 100% refund/charge back to my credit card.
Despite all my pleadings neither they have made refund yet nor intimated about any initiation of refund process, actions from their side .
On account of aforesaid dereliction of duty and failure and neglect to rectify the same. Thereby finally called upon to refund my sum of Rs.60, 000.00 within15 days by sending notice and warned them about civil and criminal case as are warranted by law, besides filing a complaint under the statutory provisions of The Consumer Protection Act.
However, there is no response/action yet from company side. Hence, this would lead to legal proceedings.
