Dear sir,

This is to inform you that myself dr. Ajay kumar is a practicing doctor in kolkata running my own health & fitness centre in kolkata in the name of "indeedcare wellness pvt. Ltd" started in the year 2015.

Company has done a good progress in last 4 year of running and we have planned to start 4 more centres in kolkata, for which we applied for lap in your esteemed organisation. The loan was already approved, attaching sanctioned letter for reference.

Mr. Rahul gupta from your organisation having office in technopolis in sector v salt lake kolkata had send me sanctioned letter and asked for all original documents for disbursement. I went to your office and handed over all documents on 1st of april and finally the loan was put for disbursement with a condition of registered mortgage of the property. He send me to your impaneled advocate mr. Supriyo basu. Money required for mortgage was given to your advocate on 2nd april.

Suddenly the next very day, on 3rd april i got a mail from rahul, your loan was rejected, stating the reason this is a developer unsold stock.

I want to clarify the things in this regard. The land was purchased by my brother in 2016, brigadier (Bdg.) sanjay kumar, who is also a doctor in indian air force - presently posted in army hospital delhi. After purchasing the land we planned to give it to a builder for construction. But as this is very prevalent in market, builder after taking land use to hold the land and work for indefinite time. So me and my mother planned and sit with a builder mr. Dipak nayak with a condition that he will form a new company on the name of dirsha construction to complete this project, where one o[censored]s out of two brother will be partner, so that we do not go in the grip of builder to take handover. So i became a partner, as i am staying in kolkata.

This is not my company and i am not active partner can be proved by my bank transaction that i have never invested in dirsha. No money transferred from my account to dirsha for construction.

After handover in the month of february 2019 by mr. Dipak nayak - partner of dirsha construction, my brother gifted the landowners portion to me by registered gift deed. Both gift deed is attached here for reference.

So i got the landowner portion - not the developer portion, so how the case is rejected saying this is developer unsold stock. This clause put for rejection is totally baseless, as the allocation received by me is landowner portion via registered power and development agreement of dirsha with builder.

Request you to please look into the matter and disburse the amount at earliest.

Even your empaneled advocated - mr. Supriyo basu - told me, rejection reason is totally wrong.

I am attaching approval letter and both registered gift deed and possession letter of builder for reference.

Regards,

Dr. Ajay kumar
