1. Year 2010:
a. We bought this property on 8th Nov’2010 in Landmark Cyber Park Sector 67, Gurgaon.
2. Year 2011:
a. Four postdated cheques (dated 5th Feb’11, 5th May’11, 5th Aug’11 and 5th Nov’11) of assured returns of Rs 26933/= ( after TDS of Rs 2992) were given to us .
b. TDS certificate was paid after a lot of follow-up as 26AS account did not show till 31st July that TDS was deposited by Landmark.
3. Year 2012:
a. Postdated cheques (for the year 2012) of assured returns of Rs 26933/= ( after TDS of Rs 2992) were given to us after a lot of follow-up.
b. Again same story for TDS certificate, we got same after a lot of follow-up. 26AS did not show deposited amount.
c. Although TDS was not deposited in time. (email ( subject: Again delay, same as last year” attached for first 2 years).
d. On 8th Aug’12, additional amount of Rs 24273 was asked by Landmark and was paid on 14th August’12. Amount towards service tax as per the information below (provided after clarification sought through email )
i. Further as far as Service Tax is concerned as per finance Act 2010(Govt Budget)Service Tax is applicable @ 2.575% on Booking Amount/ installments /purchase amount of any under construction property w.e.f 01/07/2010. This rate was increased to 3.09% by Finance Act 2012(Govt Budget).
4. Year 2013:
a. Only two Postdated cheques (for the year 2013, Feb and May was given only) of assured returns of Rs 26933/= (after TDS of Rs 2992) were given to us after a lot of follow-up.
b. Again after a lot of follow-up, two post dated cheques were issued in Sept’13 ( for the month of Aug’13 and Nov’13)
c. August’13 cheque was deposited and got cleared.
d. Nov’13 cheque was deposited but bounced because of no fund available. Rs 250 penalty was charged by Bank to us.
e. Since then, we have been following for assured return, No response.
5. Year 2014:
a. Again enquired for TDS certificate and assured returns.
b. Neither TDS was deposited and nor assured return was given.
c. 28th Nov’14, Mr. Rahul Kapoor from Landmark called me to settle this complaint.
6. Year 2015:
a. From 28th Nov’14 till 27th Jan’15: after a lot of conversation and email exchange, He had agreed to pay all the assured return and interest of 9% on delayed payment as arrear. ( Mail attached for your reference)
b. Asked for TDS certificate of Year 2013, which was given on 29th Jan’15.
c. Requested payment schedule for the above payments and issue the post dated cheques.
d. Again the same story, no commitment from them.
e. From the above, It seems still their intentions are not clear.
f. We filed one complaint to EOW (EOW complaint #[protected]/19/05/2015) on 19th May 2015.
g. Landmark paid partial money and deducted EDC/ IDC etc.
h. Complaint was closed by EOW on the basis that they can not do any thing.
i. Till date property was not handed over.
7. Year 2016:
a. Till date ( i.e. 30th June’2016) Neither the Property is handed over nor any rental income is paid.
