Subject: Pending payment for returned material
Madam / Sir,
Under instructions and authority from my client, Mr Chintan Shah, Founder – Fortune Computer, having his office at Shop No. 10, Ramkunj Apt., Above Top 10 Mobile Store, Kandivali East, Mumbai: 400101, I serve upon you the following notice:
1. That my client is registered with your website for selling computers and related products through your website (Meesho) since December 2021;
2. That my client received five orders through your website on 2rd December 2021, 27th December 2021 (2), and 28th December 2021 (2) from Gujarat (4) and Uttar Pradesh (1);
3. That all the orders were for Anantaum Tecnico High Performance Desktop CPUs;
4. That my client promptly fulfilled the orders by dispatching the products within the stipulated time period;
5. That the cumulative value of the entire Order was approximately Rs 1, 50, 000/- (Rupees One Lakh Fifty Thousand Only);
6. That however, the Orders were returned by the five customers without giving any reasons;
7. That the products were collected by your Company (Meesho) through the courier companies – Ecomexpress and Shadowfax;
8. That however, when the products reached my client, the actual products were missing and the boxes were filled with broken and outdated material including old cabinet, old scrap fan case, old motherboard scrap and a headphone box;
9. That my client took video recordings of all the boxes and shared with your team and accordingly raised a claim;
10. That through emails dated 4th January 2022 (for 2 products), 14th January 2022 your Company (Meesho) confirmed settlement of the amount of three of the claims and put the remaining two on hold subject to investigation;
11. That however, through an email dated 24th January 2022, you not only rejected the balance two claims but also cancelled the previously approved three claims;
12. That my client followed up with you through emails and telephone calls but to no success;
13. That it is clear that you along with your courier partners approached my client with malicious intentions of cheating him by availing free products and that you never intended to pay the amount due to my client;
14. That under the circumstances, we call upon you to make the payment of Rs 1, 50, 000/- (Rupees One Lakh Fifty Thousand Only) being the principal amount along with interest @ 24 % per annum till the time of actual payment within a period of 15 (fifteen) days from the date of receipt of this notice, failing which my client will be forced to take appropriate legal action for recovery of the said sum and in that event you shall be fully responsible for the same;
15. This is without prejudice to all other legal rights and remedies including civil and criminal for Breach of Trust, Cheating and Fraud, available to my client for the above-stated purpose;
16. You are liable to pay a sum of Rs. 15, 000/- (Rupees Fifteen Thousand Only) as necessary cost and expenses of sending the present legal notice to you.
