Dear Nimbus Post Management,
I am writing this email to formally notify you of my intent to pursue legal action against your company for facilitating the delivery of fraudulent products and enabling scam operations through your logistics aggregation services.
On DATE, I placed an order for Order ID: #14256 but received a completely different, substandard product that bears no resemblance to what was advertised and purchased. Despite multiple attempts to resolve this issue through your customer service channels, I have received no satisfactory response or resolution.
This constitutes a clear violation of my consumer rights under the Consumer Protection Act, 2019, specifically:
1. Your company has facilitated “product liability” as defined in Chapter VI of the Consumer Protection Act, 2019, by enabling the delivery of defective products causing “harm” to consumers.
2. As a logistics aggregator, you have a responsibility to vet the sellers you partner with and cannot absolve yourself of liability when you continue to facilitate known scam operations.
3. Under Section 2(1)(f) of the Consumer Protection Act, this incident qualifies as a “defect” in service quality, as you have failed to maintain the standard required by law in your delivery operations.
I have documented evidence of:
• The original order details and payment
• The incorrect product received
• All communication attempts with your company
• Similar complaints from other consumers regarding the same seller
Be advised that unless this matter is resolved within 7 days of receipt of this notice through:
1. Full refund of my payment of INR 3399
2. Written confirmation that you have blacklisted the fraudulent seller
I will proceed with filing a formal complaint with the District Consumer Forum, seeking compensation and costs as permitted by law. The limitation period for such action is 2 years from the date of cause of action, which gives me ample time to pursue this matter to its conclusion.
Furthermore, I intend to report this matter to the appropriate regulatory authorities, including the Consumer Protection Authority, as your continued partnership with known fraudulent sellers demonstrates willful negligence and complicity in consumer fraud.
I remind you that logistics companies bear responsibility for goods from the time of dispatch until delivery to the customer, and your attempt to deflect responsibility to the seller does not absolve you of your legal obligations as a facilitator of these transactions.
