NMMC — Severe Water Leakage at NL-2/21/B-4 from the ceiling & bathroom area

Subject: Severe Water Leakage at NL-2/21/B-4 from the ceiling & bathroom area and continual water dripping.

Respected Sir,

With due respect, it is to state that I am a resident of the above said flat since the year 1992 (almost 30 years) and to inform you that Mr. & Ms. Roy Residing at NL-2/21/B-6 & NL-2/21/C-7 has undertaken the Bathroom & Flooring work, which is just above our flat as an extension work towards the Renovation of their Apartment.

This is to inform you about the water leakage problem from our ceiling and continual dripping of water through slab and slab beam from the Mr. & Ms. Roys flat as stated above.

The cause of water dripping and leakage has started due to the faulty tile fitting, basic structural wall breaking, non-waterproofing, and non technically bathroom work which was undertaken as above. The brief detail and issue is as below;

1. In the above-said subject, our tenant Mr. Jaykumar is staying along with his wife and daughter w.e.f 20th July 2021 and the said copy of tenant Agreement along with Police verification has been submitted to the society record & Nerul Police station.

2. The said water leakage was started on the date 12.07.2021 when Mr. & Mrs. Roy had undertaken their bathroom and flooring work as stated above.

3. It has been replied by Mr. & Ms. Roy that due to the water log between the slab after flooring work, such leakages are normal and shall go away as time passes or may take one to two months. We accepted their request and shown complete support on the issue rather than complaining.

4. On dated 11.08.2021 & 23.08.2021 major leakage broke out due to hammering and malfunctioning work of structural undertaken by Mr. & Mrs. Roy work and we immediately bring to the notice of Mr. & Ms. Roy where they accepted the leakage cause and said it will be addressed in due course of time and we shall not worry on the said matter. We have again shown our concern and said we are happy to resolve the said issue amicably as the gravity of water leakages is widening day by day.

5. The said leakage issue has been bought to the notice of Mr. & Ms. Roy several times and been notifying the status of the gravity and seriousness to them since 12th of July 2021 the day when they have done structural malfunction of the CIDCO structure.

6. The flat leakage issue was shown to the various plumber, the president of the society, and various other respected personnel for resolving the issue. The leakage is tangible and visible that due to unorganized, non-technical, and structural malfunction work that has been undertaken by the contractor of Mr. & Ms. Roy, resulted to such a severe water leakage, which Mr. & Ms. Roy confirmed and accepted the same. I have also wanted to show the same to water leakage experts which they denied to show them.

7. I am also concerned by the fact that if the leakage is not fixed at the earliest, there may be consequential damage to the building structure. It is also clearly visible and has been witnessed by the above said respected person were below said area are badly damaged and require immediate some structural repair work;

a. Our supportive beam (which supports our ceiling and Mr. & Ms. Roy Floor),
b. The Ceiling slab (which is the floor of Mr. & Ms. Roy),
c. The Bathroom ceiling (which is the base of Mr. & MS. Roy’s Bathroom),
d. kitchen area (Which is just below and adjacent to the bathroom),
e. Wooden rack (Which is just below the Hand wash sinking of Mr. & Ms. Roy),
f. and other areas like floor support area, all three walls, supportive pillar, Area of the bathroom, and nano pipe area of the toilet area.

8. Cause of leakage as identified by the above experts are as below;

a. Water Supply system;
i. The bathroom pipe juncture area shows the conceal crack
ii. The bathroom accessories juncture is loosely been fitted and has developed the space between the fitting and pipe.
iii. The joining area of pipes has not properly been not fitted nor has proper adhesive been put.
b. Drain water system;
i. The improper fitting of the cummode (2nd reason for leakage)
ii. The outgoing Pipe (Drain water system) of the toilet is haphazardly been fitted having various loopehole.

c. The cutting of the supportive wall i.e structural malfunction by cutting the supportive standard wall as designed and fixed by CIDCO.
d. The non-waterproofing of the Flooring and bathroom area.
e. The whole work of pipeline and toilet has been undertaken without having technical knowledge and not plugged the area which may cause water leakage.

9. We are already incurring mental pressure due to the non-cooperation from Mr. & Ms. Roy resulting in my Dad’s (Mr. Dinesh Sharma) deterioting health. Dad is going through mental pressure, health, tension due to such non-cooperation, inhuman and inhuman behavior by Mr.& Ms.Roy.

10. My Dad & Me have requested several time, begged and pleaded but it was unheared and fallen to a deaf ear. At the time of construction, they had requested us and based on humanity's ground we have allowed such structural work and done all the co-operation which a respected and a prudent man should do.

11. The said water dripping issue since 21 days is been witnessed by the president and all concerned person of the association and has yet not been addressed by our above said respected neighbor owner, intend responding by whatsapp (enclosed) not to disturbe them any more and intend shifting her wrongdoing to the other neighbour neglecting the fact that the said leakage was never in place from last 20 years and it has started only and only after their malfunction of the structural work.

12. The tenant who is residing at our said flat is already going through a daily trauma of cleaning the dirty water due to the said leakage and has already warned us for vacating the same.

13. Mr. & Mrs. Roy fails to believe the serious consequences of not attending to the leakage issue which may result in structural damage, floor collapsing, Serious Casualty, Life of a person so residing below their floor, and the mental agony of a person going through such trauma situation.

14. This is to be noted that our day to day expenditure is been taken care of by the said Monthly Rent and due to the said issue we are facing financial loss as it is the source of our daily needs and now the tenant is vacating the apartment.

15. Due to damage of the above-said area as stated in point 6 will require major repair work which is an additional and unwanted expenditure burden on us.

16. We have already incurred various unnecessary expenditures only as a good gesture and understanding neighbour and remained co-operative and supportive for whatever work was undertaken by Mr. & Ms. Roy. having been so positive and supportive, Mr. & Ms. Roy took the advantage of our innocent behavior and has been escaping and running away to resolve such delicate issue which has cropped up due to their faulty work as said in point 7.

17. On contrary the Ms. & Mr. Roy is asking the compensation (whatsapp enclosed) for the said faulty and nontechnical work undertaken by them, which is clear evidence of their malafide intention, where we are not responsible nor have any connection to the same. We have still communicated and are requested to resolve the issue and confirmed that whatever the expenditure will take place we are ready to borne to the extend it is viable and practical to us on humanity ground although we are not a party to such leakage.

18. Mr. & Ms. Roy rather than resolving the issue demonstrating the complete denial, non-practical approach, and irresponsibility towards rectifying the said leakage issue for which they are responsible and asking, again and again, some time to resolve it.

19. We hereby state that any damage of the slab or any casualty due to the said leakage happens or any wearing and tearing of the structural damage so incurred, the applicable expenditure so for redevelopment or any other such in nature shall be wholly borne and responsible by Mr. & Ms. Roy along with the appropriate expenditure. We further state that we shall not be responsible for any consequence so arises or loss or expenditure or any casualty or damage. Any compensation that arises by the above act shall wholly be borne by Mr. & Ms. Roy. I would further emphasis that the negotiation herein will in no way affect or prejudice the rights, interest and remedies available to us and all rights and my interests are hereby expressly reserved.

I request you to kindly take the necessary action and get the problem resolved at the earliest.
