Noida Authority Online — Regarding cancellation of TM due to not paying the amount

Respected Sir/Ma’am,
I am writing regarding the ongoing problem over the sale of B-100, Sector 52, Noida, owned by Mr. Hem Chand Bhatt (SELLER) S/o Late N K Bhatt R/o B 2 Sector 20, Noida, Uttar Pradesh. An agreement was signed by Dr. Himendra Singh (PURCHASER) S/o Shri Rajendra Singh R/o A 47, Sector 39, Noida, Uttar Pradesh on 31st January 2021 according to which the full payment should have been done within 60 days i.e., till 25th March, 2021 as per the agreement (annexure-1).
The main purpose of the sale of the property was the medical need i.e., a kidney transplant. Earlier there use to be two dialysis in a week which has currently turned to three dialysis a week and still is unstable. After 25th March, 2021, the buyer didn’t contact the owner. After seeing my health condition, I have also sent a legal notice of forfeiture to the purchaser (annexure-2) but still no solution has come out. They have kept on asking for more time. It’s already been seven months since the deal and they are not ready to pay the full payment. The buyer wife and son keep on asking for more time. However, they are not paying after numerous reminders and notice.
Even after our visit to Noida Authority, Sector 6 where OSD madam Jyotsna Yadav Contacted the wife of Dr. Himmendra Singh where she said he is Mentally Sick and they will do the final Payment Before second week of September. Since then, there has been no communication from the purchaser side. After so many delays and Reminder we don’t trust them anymore. We don’t believe he is sick as we have not seen any proof. The Medical condition this side is also not stable.
Therefore, I humbly request you to cancel the Transfer Memorandum (T M) done by the purchaser on B100, sector 52, Noida, as the deal was held incomplete. I would request you to consider the main purpose of the owner of the selling the property. I am keen to resolve this issue amicably and as quickly as possible as my health is suffering day by day. Hope you will do the needful favorable with an immediate effect.
