Dear Sir/Madam,
On 19th Jan, 2018, at 8:30 PM, I bought a NOKIA 3 from JMD Communication, Sahibabad, GZB. I have discovered that the Mobile Phone has the following damages on 14th day of purchase:
(i) The Loudspeakers, which have issue of sound which is not working properly.(Hardware Issue)
(ii) Hanging Problem.
The Dealer/Seller were not intimate me about the policy of replacement at the time of purchasing and it also has not been given at any document or website of NOKIA. I also had talk with the NOKIA customer care they also refer me to visit NOKIA CENTRE. As directed by NOKIA care and Dealer/Seller, I visited to NOKIA CENTRE i.e., NOKIA CARE, RDC Rajnagar, Ghaziabad, U.P., on 03/02/2018 but they said that this is the replacement policy which is concerned with NOKIA company which is about of 14 days and it is not their fault that the company and dealer have not mentioned it.
The Consumer Rights Act makes it an implied term of the contract that the product which a consumer receive must be of satisfactory quality and as the reasons stated above they are not. Hence, I am entitled to a refund/ item replaced with new one, as I don't want to continue with existing/old one.
