I would like to advise you that you initially send a legal notice to Omaxe Builders Ltd. through an Advocate and then file a civil case (with civil courts in order to get the possession of flat) and consumer complaint with Omaxe Builders Ltd. under the provisions of Consumer Protection Act, 1986 in the District Consumer Forum in order to receive back refund of the full amount along with interest from such company.

    Omaxe Fraud


    It is very unfortunate that India's shine is being blemished by riff raff, real estate goondas in the wild west of Indian construction business! The sad part is that the Indian govwrnment as well as the top brass in police recognize the problem but are unable to act!
    I wonder if any one else has had a bad deal in Indian real estate?

      Dear Sir/Madam,

      This is to about the 200 sq. yard plot at the rate of Rs.13200 per sq. yard that I applied for in January 2009 in Chandigarh Extension Mullanpur, Punjab, the fate of which is yet not known to me. I just received a letter from you to which I represented but again no response was received from your side . I happen to stay away from Chandigarh and am unable to visit you at your office. As per your demand Rs. 2 Lac 66 thousand was paid to you for the plot.

      Kindly advise me the status of the same.

      The only option is to file a consumer complaint at the Consumer Disputes Redressal Forum/Commission at Chandigarh or Punjab Commission (@Sector37Chandigarh). The entire case shall last approximately 3 months. There is a great benefit in such like cases as you are not only awarded possession but also compensation and penal interest @12% or more on all payments from time of payment till actual possession.         I have booked a plot for allotment of villa in Omaxe city,yamunanagar.Date of draw was on dated 15/12/2012.But I don't find my name in draw list.After that i requested them through application to return my booking amount(Rs.2 Lac) as early as possible.But after passed Approx 1 month we have not received our amount.I contact them many times but they do not response about my request.Now i request you to please take up the case for refund of my booking amount.

          Dear Sir,

          As spoke to yourself over teletalk, pl guide me the further action in my below mentioned case.

          I had booked residential flat at Omaxe, Rudrapur (2007), Possession was supposed to be by 2009.
          I took help and served legal notice and waited for 4 months and then filed consumer case in Nov'1.
          My case is very strong and the lawyer was confident to get the same settled by Mar'12, but not settled till date.
          I am not able to understand my next action. My Lawyer is suggesting to take help of apex court at Dehradoon or settle out of court. I am in bad need of my hard earned money. pl guide me.

            Dear sir,

            On 22nd I received a call from Mr.Rahul that two instalments are over due, I replied that I had deposited all the instalments as per your letter dtd.20.08.12 in time.He told two instalments dtd.29th sept are not deposited for which letter is lying in the file. I was surprised and replied that I have not received any letter ,I am very punctual about the payment.
            After talking with me he sent an email along with scan copy of payment intimation reminder-I dtd.19.10.12 , but I have not received any intimation before reminder-I. Even I have not received reminder dtd.19.10.12. Your staff has forget to send the intimation now they are making unfair tactics and it seems they are filing the letters in back date. I am writing this letter on 25th and reminder dtd.19th has still not received.It is sufficient to prove unfair tactics of irresponsible and poor performers.
            I want to bring into your notice the working style and behaviour at your office and harassment which we have been facing since booking of the floor, hope you will seriously consider it ,to maintain your brand name.
            There is no deadline of any work, Intimation of payment letter,agreement, receipt etc.They give false replies.
            Date wise detail are given as under:
            Date Activity detail
            30.05.12 Flat no. 71 FF in Shbhnagan, Omaxe,Jaipur was booked on 30.05.12 trough Mr.Rohit. His marketing was excellent.
            Application was filled .Ch. no.2411182 dtd.
            30.05.12 dtd.100000/-
            Agreement was signed by me in Advance because I was
            leaving for South Africa.

            30.05.12 No action was taken till two months.
            to 31.07.12 Ch.dtd 30.05.12 was not presented for two months.
            Agreement not signed by your authorised signatory.
            I made many call and talked with Ms. Jigyasa.

            31.07.12 Above cheque was lodged by your office on 31.07.12
            –After two months and
            My funds were lying idle in the bank for two months.
            Receipt of Above cheque was not sent to me.

            31.07.12 we requested many times on phone for receipt and copy
            of agreements.
            to 20.08.12 Twice we were told that agreement
            and receipt has been sent by courier ,when for a week we
            did not received, we asked about the phone no. and courier
            no. of courier company. But in fact documents
            were not sent. False replies /information was given.
            Ultimately Ms.Jigyasa promised to send.

            21.08.12 At last, My father went to Omaxe office and collected the
            following documents:
            A) Receipt of Rs.100000/- cheque,which was printed
            same day and given
            B)Given intimation letter of instalment
            dtd 20.08.12 which were due as under:
            Rs. 7496.98 231.66 due on 27.07.12
            Rs.52249.80 1614.52 due on 10.09.12
            Rs.52249.80 1614.52 due on 25.10.12
            C) when asked for duly signed agreement ,reply was given
            that authorised signatory is out of station and
            agreement shall be sent by post in a week.

            09.09.12 A) Amount which was due on 10.09.12 deposited vide
            ch no.152118 dtd.07.09.12 at your office.
            B) Again Asked for duly signed agreement copy (which I had
            given duly signed on 30.05.12).
            Mr.Rohit called the file and agreement was
            lying unsigned in the file .He asked to dealing
            Person for the reason o[censored]nsigned agreement ,
            dealing person replied that the stamping is
            to be done on the agreement.
            SINCE 30.05.12 STAMPING HAVE NOT BEEN DONE
            ON AGREEMENT.
            Mr.Rohit requested to dealing person for getting
            done stamping because it was very old matter.
            C) When seen the file only intimation dtd. 20.08.12
            was lying and no intimation was in the
            File towards instalment due on 29.09.12.

            Email dtd. We are surprised to receive email dtd. in which one scan
            22.10.12 copy of reminder-i dtd. 19.10.12.was attached
            If it was sent by post or courier it should be received by us
            till date. Letter before 19.10.12 was never sent to us or they
            forget to send and only filed in the files in the back date.
            Please look into the matter and take action again those staff
            who are making these type of negligency and playing unfair
            tactics to cover his negligency and should be penalised.

            I request you to kindly issue fresh letter giving the fresh dates to deposit the instalment, clients should not be penalised for the irresponsible act of few employees .

            We are punctual for payment according to your intimation dates. I have also purchased two properties as under for which we have made payment before time.
            1.Plot no.111,Shubhangan , Omaxe city extn.,Jaipur
            2.Omaxe retail street market(ORJS/8)
            We had received payment schedule at the time of booking.
            I again request you to kindly issue fresh letter giving the fresh dates, clients should not be penalised for the irresponsibles activities of employee.

              The complainant applied for flat in OMAXE My Home-II, Bhiwadi, Distt-Alwar, Raj. UID no-76975, Client ID OMH/85/T1 and applied for loan on the basis of documents issued by the Omaxe authority to Dewan Housing Finance Corporation Ltd. at Rewari (Haryana) who sanctioned the loan amount on August 17, 2012 but now the above said Dewan Housing Finance Corporation Ltd is not issuing the loan amount due to difference in the approved plan and floor plan (Approved plan IBHK and Floor plan 2BHK provided to the Dewan Housing Finance Corporation Ltd. Now due to reason mentioned above, the Finance corporation mentioned above is not releasing the loan amount while the complainant had paid Rs. 3, 36, 490 to OMAXE Ltd. Due to change of plan, the complainant is suffering. Kindly intervene the matter and provide justice to the complainant.

                Considering buying property from Omaxe? Think again…. if you don’t want to burn your money….4 years waiting no possession, construction incomplete and very poor quality. ..very bad customer service. They don’t respond…took 100% money still I don’t have house, I could have earned good amount of interest in 4 years from bank just by doing nothing….

                  Dear sufferers,

                  1. I have a plot in Omaxe City Rohtak. Plot size 300 sq. yards (initial total cost 24 lacs) Basic sale price 6400/- per sq. yard.
                  2. This allotment was made during 2005/2006. I have already paid out 96% payment. Now Omaxe is offering possession and asking additional amount of Rs. 41 lacs. Omaxe has increased area/size of plot from 300 sq. yards to 539 sq. yards.
                  3. Omaxe has raised demand @ Rs. 14500 per sq. yard for 209 sq. yards.
                  4. Omaxe has increased EDC/IDC from Rs.1000 to Rs. 2357 per sq. yard.
                  5. Omaxe is not replying any of our query.
                  6. Omaxe is not also displaying latest layout plan.
                  7. They are offering only option exit from plot.
                  8. I am fighting against Omaxe either to get additional land @ 6400/- or possession of original plot size, i.e. 300 sq yards.

                  We have suited a case against Omaxe in consumer forum. Please join me to resolve all the issue. Please contact me at [protected] or [protected].

                  Finally this issue is settled after 4+ years, they have offered increased area @ 6400/- itself. They have shown that they are good real estate company.

                      The Builder omaxe has provided an agreement for assured return to my wife, this agreement has serious flaws in it and our case against Omaxe is ongoing people with assured return agreements from 2007 onwards in any project of Omaxe may contact me on [protected], or drop a whatsapp message if I do not receive your call, possibility of a major settlement is very possible due to this flawed and fraudulent agreement.                         No one is ready to listen OMAXE.
                        We want to know that how we can proceed further in this matter. We had purchased this flat in 06.10.2006 and still not getting any response from your side after delaying the same for so many years. If you are not able to deliver the same till now after expiry of project date. So we request you to return our money Rs. 640000/- with 18% interest to settle the same or suggest the procedure to proceed further.

                        If you are not able to do anything we may go to CNBC AWAJ and CUSTOMER SERVICE CENTRE to get refund my money. Hope to look forward to receiving your valued reply in due course of time.

                          Flat was booked on 30.08.2006. Buyer seller agreement was not sent by the developer.

                          a. On booking of flat on 30.08.2006 company never issued Allotment Letter on its own till 06.01.2008 and delayed it purposely for 16 months. On applying for Housing Loan with the Bank and on demanding Allotment Letter by the Bank, company gave the Allotment Letter on 07.01.2008. In view of the delay in handing over of possession of the flat from the date of booking is about 27 months.

                          b. Completion certificate has not been provided to me by the company, As per the Bank of Baroda loan approval letter “Borrower to submit a copy of completion certificate issued by the competent authority.” In the absence of which bank will not release the final instalment.

                          c. Preferential Location Charges (PLC) charged is unjustified, un-reasonable and arbitrary. Amount can not be charged arbitrarily. Flat is not park facing.

                          d. Parking is not chargeable as per Supreme Court judgement passed in 2008 & as per all provisions of law.

                            I have booked a plot in omaxe-I happy home A B road Indore. Loan has been sanctioned to me by L.I.C. housing finance limited Indore. But omaxe has not submitted some document to finance company. So L.I.C. housing finance is unable to give me loan amount. Hence I am unable to pay the balance amount to omaxe ltd. But omaxe has added the interest of Rs.92,136 on balance amount. They have been telling me that till they don't submit the documents they will not take any interest. Kindly take necessary action omaxe. Tankyou.

                              I purchased a Flate in Omaxe Parkwwod Baddi in Tower Kachnar D flat no 502 in Jan 2007 and made 95% of payment total Rs. 1170000/-.But till now omaxe has not given completion of the same i visted site they have not even started the construction of Tower and after so much followup they are not responding and not giving any reponse i am Giving Rs 160000 bank intrest every year.Please help me and guide me how i can recover my money.omaxe is the worst builder

                                Hi !

                                I have purchased a Flat in Omaxe Grandwoods sec 93 Noida in 2008 in Regent towers. I have been following up with the Customer service team regularly regarding the possession . as of date also they are not giving any clarity , Every month they have been pushing the dates with false commitment. last moth we came to know that they have started giving possession of some towers but they were not advicing for the Flat registration with the Noida authorities. While I called the call centre they informed that there is an issue pending which is resulting to the non-clearence of the Registration . This hs sounded to a very serious issue and seems fishy. As of date also I have no clarity over Possession , Registration . Would request your good self to take up the issues to secure our Right to get the possession with Registration.

                                  I had booked ATM-1 shop in Omaxe Mall at Mall Road, Patiala measuring 125 sq ft. @ 10000/- per sq ft.plus IFM Security, External Electricity Charges and Fire Fighting Charges for power back up and meter connection charges. Total money was to be paid on construction linked basis and the company up to the time of 95% payment kept mum and did not talk of any escalation. However, when they received 95% payment they send the final demand increasing the area from 125 sq ft to 175 sq. ft. approx. and raised a demand of more than Rs. 10 lakhs towards the same without justifying the details of such an increase. We have taken up the matter with the company and written numerous letters which have not been replied at all. However, they keep on reminding us about the non payment and adding interest on that without any reply to our queries. The matter was raised in the State Consumer Forum at New Delhi and there also they are deferring the matter on one pretext or the other. This is a brief history of the case.                                     i booked a flat in Omaxe Grandwoods ,noida in 2007 nov,the builder signed letter of agreement on 2009 march ALPINE TOWER 601 , till then i had paid 12 lacs ,the flat was to be completed in 2 years and it was delayed ,I have paid about 47 lacs and have to pay 3 lacs more but company is demanding additional 2 lacs for parking and 3 lacs for late charges ,all their records show date of 2009
                                    i have requested company personally by going there and sent many mails that i should be given interest on my 12 lac rs which was paid in 2007 which is no where in records because for 2 years my money was used by the company but neither interest nor that date is being considered .The company is not replying to any of my mails nor do they reply when we go to their office,All my payments have been through cheque .since last 7 months all my mails are unanswered and their tactic is to delay answering and then create dispute for delay in payment
