[Resolved]  Panchsheel Colonizers Pvt Ltd — Fraud by the Builder in Jaipur

4 plots were booked in April 2006 by us paying a total amount of Rs 6, 80, 000/ within a year and half of the bookings, including booking amount, but stopped making any further payments as we happened to know some unfavourable facts about the project i.e. 1) Builder does not have the complete land pool from which they claimed to sell plots. In fact they had overbooked the land from what they had. 2) They could not get or tried to, for approvals from concerned departments for almost three years from the date of bookings and if some known one is to be believed they do not possess those clearances even today. 3) Work on the site is complete dismay as even today there is no construction except the main entrance and a fifty meter long road surrounded by barren farms instead of promised Golf course, Malls, .Cricket Academy, Tivoli Resort, Amusement Park, Hospitals & schools. This whole project is a big fraud and now after more than 8 years of booking period instead of refunding the money with interest and compensation we are being threatened of heavy interest and forfeiture of deposited money by the Colonizer, if the remaining payment is not made us. Aapproached the Colonizer on several occasions but instead of paying damages & interest, they agree to refund the amount paid by us only if we part off with 20% of the amount committed to the Colonizer (Rs. 320000/ should be deducted from Rs 680000 i.e 47% of the money paid by us will be deducted). The second and last option they offered to us was to get land size equaling the money paid by us in their fake project (Which we are ready to do so, provided the Township and the Facilities as promised at the time of booking, are availed to us). Previously we were cheated but now by doing so they are only adding salt to the injury, adding more humiliation. Colonizer is well aware that any civil suit will only take many years for refund and as in past JDA Police will also not take any action, leaving us with no practical solution to get justice out of this fraud which happened under the very nose of Law and still continues to happen with us. Sir this fraud has engulfed hundreds of investors running into a scam of crores of Rupees, complexity and involvement of various Department while investigation shall need multi-disciplinary ramifications, hence making it a perfect case for investigation by SFIO (Serious Fraud Investigation Office) under Section 212 of Companies Act in larger Public Interest which may further lead to improvement in system, Laws or Procedure. Approaching Builder on various occasions for refund of money through mail, phone & visits. 12.3.14 Grievance to PMO GOVRJ/E/2014/00297 which was forwarded to Sh C M Meena, Principal Secretary (AR&GAD), Rajasthan Govt. 4-8 May 2014 Submitted complaint and visited several times JDA Police Station but were refused receipt and no action was taken. 13.6.14 Complaint sent to you through registered post and mail and reminder mail on 27.6.14 27.6.14 Mail from Ashok Nagar Police Station, Jaipur for filling complaint. 3.7.14 Submitted our complaint with all supporting documents in Ashok Nagar Police Station, Jaipur but again denied receipt of complaint and FIR not lodged citing further investigation by IO (Investigation Officer) 30.6.14 to 5.7.14 We were contacted by Mojamabad Tehsildar office, Kapdiawas to get details about complaint which was provided to them. As per them, inquiry report shall be presented to their seniors but no action till date nor were told of reasons instead of repeated requests. 3.7.14 to 23.7.14 Contacted Ashok Nagar Police Station, Jaipur several time to know the status of complaint lodged by us on 3.7.14. Repeated reminder mails to the SHO for the same on 7.7.14, 14.7.14 and 23.7.14 without any reply for any of the mail. No FIR has been lodged till date without citing any reason instead of repeated requests. 15.7.14 Mail from Dudu Police Station to know about our complaint for which we replied on 17.7.14 where we updated them that we have lodged complaint with Ashok Nagar Police Station, Jaipur and waiting for them to lodge FIR. The Colonizer is so well connected with the system that every attempt for justice faced strong resistance but now we shall be exploring every possible legal option like FIR through Court only and registration of complaint with SFIO.
