Dear Mr. Rajesh Kaul,
I am in receipt of your email dated 24.08.2014 containing harsh language. In this regard I have to draw your attention to the following facts:-
1. In case the company has successfully developed some projects in Delhi and around NCR then it cannot be presumed that everywhere your company will develop projects in the same fashion. Thus any cannot claim any creditability of company on this accounts.
2. I repeat that without completion of the entire committed civil jobs the possession of the dwelling unit was given to me. The following jobs are still incomplete in the flat:-
a . Almost all door frames fitted in the flat are coming out due to poor workmanship and inferior quality of the material utilized in the flat.,
b. Uneven walls finishing at 8 places in the house reveals that the skilled workers were not utilized
c. Electrical switches are not aligned and require replacement of boxes
d Wooden flooring getting loose due to utilization of the poor quality material and poor workmanship
e. Excess level play in sliding aluminum windows and require replacement
f. Bath tub is sinking- not fitted properly.
g. Structure cross beam is not straight
h. Plasters are falling from places. One time it has injured my relative Mr Paryaksh causing loss of mental agony and discomfort.
i. Outside design completely changed – In sales time it was sold by showing Initial blocks- The windows rain protectors have been removed.- The company have not honored the agreement in order to cut the expenses/cost.
g. The floor plan offered to me in builder buyer agreement and provided is entirely different – attached photograph

h. Open parking space is not provided to me in writing despite charging Rs 50, 000/- for the allotment of the parking place. You are allocating the space now on road meant for vehicle movement.

i) Till date the Company has not provided me the possession certificate, occupancy certificate as well as completion certificate. All are silent against my basic rights.
Your entire email is silent on these material aspects.

3. That the project is not as per the approved place from MC/shown to me at the time of sale of the dwelling unit.

4. 2nd lift installation process has not been started. Till date even civil work of the 2nd lift is not complete. Causing lot of harassment and humiliation. You have blocked the designed track.


5. The STP plant is fitted in front of the house and it cannot be part of the approved plant. The STP plant is meant to be utilized for about population of around 1800 persons. As per basic norms the said STP plant is liable to be situated at least 100 meters away from the residential accommodation whereas the present distance between the house and STP Plant is not even 8 meters. The odour coming out of the STP plant is oozing foul smell. It is not possible to stay in the hazardous atmosphere created due to STP Plant. – Attached photograph

6. The sewerage of basement is defective and is unable to discharge the rainy water properly. The said problem is not temporary in nature rather is permanent in nature. Chocking of water may cause any disaster in the locality and one of my relative had already faced electrical shocks.

7. The project was to be developed in 12 acre and the same has been developed in 6 acre only. Six acre plot has been sold to another builder and commitment of dwelling units with 70 % open space has been taken away.


8. Tennis court and cricket pitch has not been provided.

9. The entrance road is blocked by club developed by you causing regular commutation .

Vide your trail mail, you have not resolved even my any of the problem rather had utilized the reply in the threatening manner. I have already served you with the legal notice dated 15.06.2015 and till date you have not given any reply to the said legal notice.

Under these constrained circumstances it is presumed that you are refusing to resolve my grouses. Thus I have been left with no other option but to instruct my counsel to file a complaint against you in the competent court of law.

This company has done this to almost all its buyers. The construction quality is very poor as well and on the final possession, there is no way one can move in without significantly investing again to make it worth even putting your old furniture.
Their office staff - it is better not to describe in words
