Respected Sir,
I, Rahul Kshatriya, had been sanctioned home loan vide Loan Account No-HOU/AHM/0519/688866 for an amount of Rs. 39, 65, 000 from PNB Housing Finance Ltd. (PNBHFL) in August 2019
Now there were negligences and seemingly illicit practices in the from PNBHFL which had led to direct and indirect of financial losses to me. The negligences/illicit practices are as follows:
1. I had filled/submitted all the documents related to PMAY subsidy along with the loan application. However, 6 months passed and I did not receive any developments. Also, whenever I enquired about the developments, telephonically, they used to state that it’s an automated process and I will get the details of developments as and when it happens. However, I did not get notification for 6 months, frustrated I went to the Mithakali branch, Ahmedabad, at that instance they told my Adhar card was not proper, hence the PMAY subsidy could not be processed. Now whose fault was that, as it is the sole responsibility of the bank to ensure that the application is submitted which they failed to do so leading to me a circumstance wherein I cannot transfer the home loan
I had planned that once I receive the PMAY subsidy of Rs 2, 34, 000, within 6 months I would transfer the home loan to other bank as I was paying 2% higher rate of interest from prevailing interest rate. Further, we (me and wife) had planned that after transferring the loan our emi would be reduced to Rs[protected] from Rs 33600, we would be purchasing TV, Sofa, and paint the house. However, due to the negligence of PNBHFL my PMAY subsidy form was not submitted and then I had to take a personal loan at 20% rate of interest to buy all these things which shook my financial planning and I then had to incur subsequent financial losses in paying emi and family problems owing to financial squeeze.
Now please state whose responsibility was to submit the documents and who is liable for the monetary losses that I had to bear for the first six months. It is also worth mentioning that they were aware that my required documents were not submitted because when I went to PNBHFL office, they immediately informed me that my Aadhar card was not clear and hence my application was not processed
It is also worth mentioning that submission of PMAY subsidy application is sole responsibility of the bank which they failed to execute. Now just for information sake, I missed the emi of December 2022 due to financial constraints for which PNBHFL is responsible, I got calls from their customer care, officials at PNBHFL Mithakali branch, one of their agents namely Sanjay (Mobile No-[protected]) called constantly to pay the emi when I was unable to do pay the emi he came and delivered notice at my residence so that I get the notice at the earlier than the courier and pay my emi, they had also sent the notice in courier also. Now question arises when the officials of PNBHFL take so much pain in collecting an emi then why are such efforts are not made in doing the welfare of customer instead of telling lies for their own vested interest.
2. Agony did not stop here, after much efforts they submitted my applications. At the day of submitting application I asked them that my emis have bounced many a times will it affect my PMAY subsidy allocation. The reply was that if a customer is eligible for PMAY subsidy he is bound to receive irrespective of his payment history. But as usual it was blatant lie which I came to know when my subsidy was reversed. The reason stated was delinquent payment history. This also came as a shock as how can a bank tell so many lies and stoop down to such a low level just to ensure that customer is forced to stay with the bank. When I went to the bank and tried to meet the employee who told me that I will be receiving subsidy in any case bank officials said that the individual has left the bank. So now who is responsible for the subsequent six-month financial loss which now sums upto to 12 months. It is a common sense that I would have transferred the home loan to another bank, which was offering me much lower rate of interest and reduced tenure for the same period, if they had informed me that I will not be receiving the subsidy owing to my payment history.
3. Then came another lie from the bank, in March 2021 after the above 2 lies and 12 months that if I maintain proper payment record for six months, I will be receiving the subsidy. They said that this time around I will surely receive the amount and bank will ensure that I receive it. I thought if they are saying with such a confidence I will surely be getting it and I paid But this was their biggest scam with me. First of all government stated that PMAY subsidy scheme has been withdrawn from March 2021. I immediately contacted the bank and informed them about it but they stated that as my application has been submitted before March 31, I will be receiving the subsidy, so I became assured, however, I kept following up in the emails for a periof of almost 2 years to which every time they replied that it is under process and sometimes it takes almost 1 ½ years to process. However when the stipulated time of process was over I wrote in the grievance cell of PMAY to which they give a reply in form of guidelines. The same when I forwarded to the nodal officer he immediately in a day replied that my application was processed after March 31 hence I will not be receving the subsidy. Now there is nothing more to speak off from my side on the scam that you forced me into just for the sake that I don’t transfer my home loan. Had PNBHFL clarified the first time when my application was not submitted I would have transferred my loan to much lower rate of interest and reduced tenure. This fraud has caused me a great loss of money which can be produced in form of evidence as and when required
4. Also one more scam from your side, I literally begged to reduce the interest as all other banks were reducing at your office but official denied. But when I wrote in email it was done immediately. But when the RBI increased the repo rate you immediately informed the same and increased the Rate of Interest. So now can you please explain if the decisions are in customer’s favour you make them beg and force him to write emails but when RBI hikes the repo rate it is immediately informed to the customer and in next month it is increased.
5. So now please answer:-
WHO IS RESPONSIBLE FOR THE MENTAL TRAUMA AND THE FINANCIAL LOSSES THAT I HAD TO UNDER GO FROM AUGUST 2019 TO DECEMBER 2023 OWING TO
