Sub: Incorrect Order issued by DDR 4 without obtaining comments from Society Committee or other Members & One sided attention to Complaint by a repeated Habitual Defaulter Lt Col SS Nalawade (Retd)

Dear Sir,

I have received a Notice along with 22 other Members of the Society to remove Grill from Car Parking purchased by us. This is based on a single complaint by Lt Col SS Nalawade (a Habitual Defaulter) in this Society.
In this connection, I have the following Observations / Complaints.

Complaints against Lt Col S.S. Nalawade, the Complainant

It is not understood as to how an individual complaint which is not routed through the Ganga Park Co-Op Hsg Committee has been accepted. It would have given the Committee and Members to raise issues about Lt Col SS Nalawade. Thus the Committee could then also include and add Points to be checked in Re Audit.

In any case the Re-audit called for and paid pertains to Financial dealings for the period 2014 to 2016. The subject of improper matters like Grill for Parking would not cover in the Re audit as the points pertain right from Period 1991 onward.

POINTS REGARDING LT COL SS NALAWADE
Lt Col SS Nalawade is a habitual and repeated Defaulter in the Society. His Defaults of serious nature are:

1. He had not paid his Society Maint Charges for over 10 years. He begged for waiving off the Penalty for the delay and the Committee had accepted a reduction by huge margin.
2. He had tampered with Society Overhead Tank without permission and taken a private connection to a Solar Heater. The case was lodged in Court and the Court had issued Orders to disconnect the connection on – this was done and original status restored.
3. Lt Col SS Nalawade /Builder has somehow managed to Amalgamate Two Flats into One – without any supporting documents available with Society. The Brochure of Ganga Park by Builder shows the Flats as Two separate Flats of 1X 1 BHK and 1 X 2 BHK. He now pays Maintenance for a 3 BHK Flat. The Auditor could get into details of this transaction. Supporting documents are not available with individual or the Society.
4. Lt Col SS Nalawade has taken over Common Terrace as a private Terrace which is against rules as it is a Common Terrace. Please get the same verified by the Auditor.
5. Lt Col SS Nalawade has enclosed two Open to Sky Balcony of adjacent Flats purchased by him. It is a similar violation as enclosure of Parking by some owners. Please include this as part of Demolition also in your Notice. Please do not take action on selective Complaints put up by this Defaulter who has hidden the facts about his own defaults while complaining.
6. It is learnt that Lt Col SS Nalawade has been pushing for his complaint to be recorded by DDR 4 your Staff by claiming to be a Senior Army Officer and some Staff are scared of him. He has been coming to the Society Office and boasting that he has contacts with very Senior persons in Govt and would go to any length to get his complaint filed. Please note that I too am an Ex – Lt Colonel from Army and I command the same respect. There are, in this Society, many other Army Officers who are more senior to Lt Col SS Nalawade Lt Col SS Nalawade has probably projected himself as the Sole Army Officer who alone has single headedly defended the Country and we are free only due to his individual Services.
DEBARRING OF PREVIOUS COMMITTEE MEMBERS.
7. The Committee Members who held Office in 2014 have been wrongly debarred from Fresh Elections due now.
8. This Committee did not complete the Audit in 2014 as the New (Current) Committee did not allow the outgoing Committee to hand over the Society after completing the Audit. The Current Committee failed to pay the Charges to the old Auditor under supervision of Mr Tapasvi (Registered Auditor) Neither theis Committee followed up with Mr Tapasvi to get the Audit completed in last 6 Years. Actually, it is the current Committee that needs to be Debarred NOT the old Committee. All this is done due to pressure on DDR 4 from Lt Col SS Nalawade (Retd).
9. Please stop the current Election Process immediately and order a fair Inquiry before taking action.

OTHER POINTS.

10. I had personally brought out the above points in my interaction with Mr IC Savalgi, Auditor detailed by DDR 4. It is surprising that my points were not included in his Audit Report.
11. I had questioned the Committee as to why they had not responded in writing to your Notice / Re-audit Direction once they got the letter from you regarding complaints by Lt Col SS Nalawade. The Committee informed me that this was not done as they had personally informed DDR 4 both verbally and in writing about all defaults by Lt Col SS Nalawade
12. Regarding point by Mr IC Savalgi, Auditor that No explanation was provided by the Society to establish my ownership of the Parking. Please note that the Office File pertaining to Flat G-1, A-Wing contains the Allotment Letter of the Builder. Comment: What Lt Col SS Nalawade has to show and answer his rights over the Parking of his car in Passage for over 20 years – and moreover he has NOT been regularly paying Rent for the incorrect Parking.
13. Regarding Point concerning Ownership and additions on Sale Deed to claim purchase of Car Park by one Mrs Handa. I had personally explained the matter to Mr IC Savalgi, Auditor that there was overwriting and manipulation made in the Sale Deed. The correctness could be verified by obtaining a Copy of Registered Sale Deed from the PMC Office. I am sure you good office can obtain such a Copy for verification. We do understand that in case the two copies differ – it would be a serious case of Fraud punishable under relevant Section of the law.
OTHER DEFAULTERS NOT COMPLAINED BY LT COL SS NALAWADE
14. There are many Defaulters in the Society – besides Lt Col SS Nalawade. Some being:
a. Permanent Rooms constructed on Terrace.
b. Inclusion of Open to Sky balconies inside Flats
c. Etc. Etc.
15. It is requested that the selective pinpointing of defaulters is stopped and action be taken to identify Defaults by Lt Col SS Nalawade and demolition if any be started from his own building.
