Complaint under Consumer Protection Act, 2019, and Relevant IPC Sections against Revv Self-Drive Car Rentals for Providing Faulty Vehicle, Endangering Life, Negligence, and Unjust Billing

RESPECTED SIR / MADAM,

I, DEV KAPOOR, hereby submit this formal complaint against Revv Self-Drive Car Rentals Pvt. Ltd., for the following facts and reasons:

FACTS OF THE CASE:

1. On 13th may 2025, I hired a self-drive rental vehicle from Revv Self-Drive Car Rentals, a company that claims to provide properly serviced and quality-checked vehicles for customer use.

2. When the fleet representative delivered the car, I immediately observed and informed him that the vehicle appeared old, heavily used, and had faulty wheel alignment. Despite raising this concern, the fleet representative assured me that the car was fit for use and that I could proceed on my trip.

3. During my trip, it began to rain heavily, and I discovered that the wipers were not functional, creating a severe safety hazard due to poor visibility.

4. On my return journey, shortly before reaching Faridabad, the car began making loud, unusual noises, and suddenly, the steering locked. This caused the vehicle to spin uncontrollably, crashing into the right and left dividers. My passengers and I suffered injuries, though we thankfully survived.

5. After the accident, I immediately contacted Revv’s customer support for assistance, but no help was provided. I had to arrange and pay for a tow truck myself, amounting to ₹3, 500, to send the vehicle to their service center.

6. When I reported the entire incident to a Revv representative, explaining that the accident happened due to their failure to provide a properly serviced and safe vehicle, they assured me that they would investigate, resolve the matter, and initiate my refund.

7. However, to my shock, after several days, I received a mail from Revv demanding ₹1, 34, 900 as damage charges, falsely claiming there was no fault in the vehicle, despite my repeated and documented complaints.

8. I clearly state that the accident was caused solely due to the poor condition, lack of servicing, and negligence of Revv’s provided vehicle, not because of any fault or negligence on my part.

9. As per Revv’s advertised claims, they guarantee properly maintained, clean, and checked vehicles — and as a self-drive car rental company, they are legally bound to ensure compliance with RTO norms, Indian Government safety standards, and not create arbitrary policies to shift liability onto the customer.

10. Additionally, I have found multiple similar complaints from customers in various states, highlighting a pattern of negligence, threats, and unfair practices by Revv. Their customer care executives have also behaved rudely and threateningly, which is unacceptable.

LEGAL GROUNDS

The following legal provisions are applicable in this matter:

• IPC Section 336 – Act endangering life or personal safety of others.
• IPC Section 337 – Causing hurt by act endangering life or personal safety of others.
• IPC Section 420 – Cheating and dishonestly inducing delivery of property.

Consumer Protection Act, 2019 – For deficiency in service, unfair trade practices, negligence, and mental agony caused to the consumer.

RELIEFS SOUGHT

I humbly request to:

1. Direct Revv to immediately cancel the unjust bill of ₹1, 34, 900 raised against me.

2. Direct Revv to refund the ₹3, 500 I paid for towing charges.

3. Direct Revv to provide complete service and quality check reports of the vehicle prior to handing it over to me.

4. Award appropriate compensation for the physical injury, mental agony, harassment, and risk to life caused due to their negligence.

5. Issue strict directions to Revv to comply with RTO and Indian government safety norms for all self-drive rental vehicles and to stop engaging in unfair trade practices.

6. Take action under relevant IPC sections for endangering life and cheating.

7. Grant any further relief deemed fit and proper in the interest of justice.
