RTO India — To pass an order for alteration in the registration certificate of the vehicle No HR12N0545

The applicant respectfully submits as under:-
That the applicant is owner of a Hyundai Creta S 1.5 (Petrol) car bearing registration no.HR-12N-0545. The said vehicle of applicant was insured with SBI General insurance Company Ltd. for the period from 14.01.2021 to 13.01.2022 vide policy no.P[protected]. Copies of RC and insurance cover note are enclosed and contents of the same be read as part of this complaint.
That unfortunately the above-said vehicle of applicant met with an accident on 23.05.2021 at Meham Bypass, Rohtak. The complainant was driving the said car and in the said accident, the car was turned turtle 4-5 times and as such the car was completely damaged.

That the applicant follows the due process and procedure and file a claim application to SBI General insurance Company Ltd and after the completion of due process the Hyundai, Sristhi Motors Pvt. Ltd., Opp. New Power House, Jind Bypass Road, Rohtak had started the repair work of the said damaged vehicle.

That after the completion of repair work applicant get to know that the whole body shell of the said damaged vehicle has been changed and due to which a new chassi was being replaced with the damaged one of the said vehicle of the applicant.

That after getting the car repaired by the Hyundai, Sristhi Motors Pvt. Ltd the applicant had approached the Registering & Licensing Authority office for making alteration in his registration certificate of his said vehicle but the Registering & Licensing Authority Cum Sub Divisional Magistrate/ Sub Divisional Officer, Rohtak bluntly refused to made any kind of alteration in the registration certificate reason stated by the concern authority was that “there is no provision under Motor vehicle Act for change of Chassis of the vehicle” and not only this subsequently the concern authority also seize the registration certificate of the above mentioned vehicle.

That Registering & Licensing Authority Cum Sub Divisional Magistrate/ Sub Divisional Officer, Rohtak vide his letter bearing No 443 dated 27.07.2022 was sent to Hyundai, Sristhi Motors Pvt ltd. while bringing section 52 of Motor Vehicle Act to the notice of Hyundai, Sristhi Motors Pvt ltd specially mentioned that there is no provision of change of chassis of vehicle and also directed them to inform his office that under which provision of law/rules the chassis of vehicle bearing No HR12-N-0545 of the complainant has been changed but the Hyundai, Sristhi Motors Pvt did not come forward with any response then the applicant made a request to Registering & Licensing Authority, Rohtak by appearing personally before him to do the needful and again a letter bearing No 1490 dated 06.09.2022 has been sent to Hyundai, Sristhi Motors Pvt Ltd asking to inform the said office about the rule under which the alteration of the above said vehicle has been made, the copy of which has also been sent to the applicant for information. Again it is a matter of great concern that despite issuance of letter dated 27.07.2022 & reminder dated 06.09.2022 by Registering & Licensing Authority Cum Sub Divisional Magistrate/ Sub Divisional Officer, Rohtak to the Hyundai, Sristhi Motors Pvt Ltd as of now. A considerable long period has been elapsed, the applicant is running pillar to post to get his grievances redressed but the same has yielded no results. The applicant is being harassed due to no fault on his part and he is suffering hard and all this is due to Registering & Licensing Authority and Hyundai, Sristhi Motors Pvt Ltd.
It is therefore respectfully prayed that appropriate action be taken against Hyundai, Sristhi Motors Pvt Ltd. and justifiable/reasonable orders be passed to Registering & Licensing Authority, Rohtak to make alteration in the registration certificate of the repaired vehicle of the applicant.
