This is bring to your notice, one largest builder name is M/s Supertech Ltd. Office Sector-58 Noida, UP.
The above company deducting service tax from there with Material contractors & Labour contractors for last so many years, but not depositing deduct service tax amount to service tax account.
If contractors asking their receipt to maintain his firm ITR, they simply telling them, you deposit from his own pocket and then claim from us. But the contractor situation is as per instructions of supertech company- do not add/ calculate service tax amount in RA bills/ invoices.
So meanwhile that type of condition huge of large contractors amount in cr. rolling in this company.
