TVS Motor Company — new tvs zest not working

Dear Sir/Mam,

This is Merlin Thurai C.M from Mugalivakkam, Chennai. I have purchased "TVS SCOOTY ZEST(BS IV)-SBT MATTE YELLOW" model [Registered Number : TN 10 BH 9124] with full cash mode and the vehicle was delivered on 18/08/2019 from ARASU TVS, Mugalivakkam branch with 1.5 litter petrol.

When I was purchasing you were promised like this vehicle will give 55Kms per litter. I filled 3 more litters. I was shocked when the fuel meter shows empty with in 60 Kms. Then I have given my vehicle to mugalivakkam branch for service. They took initially 2 days and then 3, 4 days by the main porur branch. They did something and given the vehicle back and said everything is fine now.

Again I filled 2 more litter of petrol amd was started using it. Again the fuel meter shows empty with in 30 Kms. For 6.5 litter fuel this vehicle runs only 90 Kms which means the vehicle is giving less than 15 Kms per litter. Again I hand over the vehicle to Porur main branch for service. They took almost a week and reported me that there is some leakage fault with some spares like fuel valve. They said that they have changed the parts and promised me that the issue won’t happen again. From the next day itself the same issue repeats.

Once more issue is in the vehicle is, when I use accelerator the fuel meter automatically rise, when I use break suddenly it goes very down. Arasu TVS manager accepted that there is also some manufacturing issues.

Again 4th time I was given my vehicle to the Porur main branch for service. This time they took almost 3 weeks and saying to solve this issue they need some specialists and they are coming this Friday(18/10/2019) from Hosur.

In these 2 months I drove my vehicle only 5 to 6 days totally 90Kms only. I bought new vehicle not used vehicle. Now my questions are…

1. How come this vehicle coming for sales with these manufacturing defects?
2. Who is responsible for this testing team failure?
3. Is this really manufacturing defect or am I delivered used damaged vehicle?
4. In case if they rectify the issue and give the same vehicle, from my view I definitely feel like I am buying second-hand vehicle. Do you think 2 months older used vehicle cost is Rs.71, 000?
5. I have paid Rs.71000 by cash and the product is not been delivered yet. What is the compensation for this?
6. Who is responsible for my two month financial loss and my depression?

Now I am very clear that I was delivered with damaged vehicle. I can't use a vehicle which is giving less than 15 Kms millage per litter and have some more manufacturing defects. Now please let me know what I have to do now?
