[Resolved]  Yamaha Motor India — manufacturing fault and bad behavior of service engineer and dealer

Dear Sir / Madam, I am Kunalpuri M. Goswami from Vadodara city Gujarat state. I havepurchased Yamaha Fzs from M/S. Dynamic Motors, saran buildings, A 19&20, Bhagvati park, op :- Bhadra lok apartment Old Padra Road, Vodadara-390020, on July 12th 2014, on cash, amount 79900/- includinginsurance, Invoice number:- 000168, details of the bike are as follow, · Vehicle Identification Number:- ME121C0J6E2045645· Engine Serial number :- 21CJ045865· Battery number :- 651150· Key number:- 3173Please note that I have purchased this bike for my younger brother whohas recently joined his new job as Marketing ExecutiveAfter riding the bike for around 200 kms the bike started givingpopping / misfires sound from the engine after bike’s engine getsheated running 40 to 45 kms and also the starter didn’t work when bikeis in gear, to start the bike every time I have to put it in neutraland then have to press start button which too take long cells to getthe bike start even when bike’s engine was quite hot. Also the poppingsound of the bike keep coming whenever I lower down the accelerator, so on 17th July 2014 I went to the show room with the problems, theyare having their own service center too so the service center incharge told me that nothing is to worry about that it is happeningbecause of some particles in petrol have jammed the carburetor soafter riding the bike for the while it will go away and he turn downmy complaint, but the problem stayed as it is without any change init, so on 18th July 2014 I again went to the showroom / servicecenter, then the in charge Mr. Hitesh Shah told me that keep the bikehere we will see and resolve the problem in give it back to you in theevening, I asked him the reason behind this problem but he told methat nothing to worry about it I have cleaned the carburetor now itwill not happen again, but still the either of the problems were notresolved, so again on 21st July 2014 went to the showroom / servicecenter again and requested Mr. Hitesh Shah to resolve this problem asmy brother cannot work without bike. So he changed spark plug and AISand then told now the problems are resolved, but as usual they werenot. So again on 22nd July 2014 I have in fact I was forced andfrustrated with the service of your dealers went there and told themabout the problems that they are not resolved and so Mr. Hitesh Shahagain asked me to keep the bike there one more time so I requestedthem to arrange a substitute vehicle as my brother’s new job wasgetting disturbed so after requesting them they arranged Yamaha Ray(Moped)GJ 06 FN 8778 for my brother that was also quite old not newone but as we were not having any choice we accepted it. On that dayMr. .Hitesh Shah changed some called “clutch switch” for startingproblem but still the problem was not resolved, so again I took thevideo as Mr. Hitesh was not believing on the fault I was asking themthey were not in the interest of resolving it instead they just turnme down somehow. Then again on 23rd July 2014 I again went there withthe same problem, this time I asked them to change my piece as theproblem was not getting resolved after changing and giving them thismany chances. Then they started showing their true colors one salesperson Named: - Mr. Sandip literally started abusing and shouting onme in front of everyone after having very hot arguments with them foralmost an hour they told me that “today our engineer which isappointed by Yamaha Mr. Neeraj Vaghela is going to come today at 12:30so keep bike over here we will show him as well as we will call youwhen he will come here. But whole day passed nobody called so in theevening we took pain to go there in heavy rain and to our surprise Mr.Hitesh Shah, has opened whole bike right from fuel tank to the upperpart of the engine (photographs of which are attached with this mailplease check it, my temporary RTO registration number is GJ06 TC 583which can be clearly seen in the photographs, ) Then I asked Mr. Hiteshthat with whose permission you have opened the engine at least youshould have taken a courtesy to call me before doing this then he toldme that Mr. Neeraj Vaghela (your Expert Engineer ) told him to do soon phone as he could not come due to rain in Ahmedabad(we werestruggling with problem here each day and your engineer was enjoyingrain at home ), but I was completely unsatisfied as what he haschanged after opening the engine I don’t know also he has not preparedany job card (yellow card/form) for it or get it signed from me when Iasked him that I want to talk to the owner of the showroom that tooafter hot arguments he called his owner, I told owner Mr. Saran JogMalhotra about the problem he told that he was not knowing about suchthings, so I simply asked him to change the piece as I am not going totake this opened engine piece so first he tried to turn down requestby telling me that once the RTO registration has been done bike cannotbe replaced now, for your information my native is Bharuch so I haveapplied for the RTO passing from there and paid the passing fees therebut when I asked my RTO agent he told me that it is possible as stillRegistration number has yet not came. But Mr. Saranjog convinced me towait for one more day as your expert engineer Mr. Neeraj Vaghela isgoing to come and as soon as he will come we will call you. So nextday 24th July 2014 as usual there was no phone call from anyone thereso again I called them the person who answered the call told me thatyour Fzs is ready come and take it, i asked him about the Expertengineer he told me that he went away after solving your problem yourbike is ok now come and take it. So when I went there Mr.NeerajVaghela was present there and bike still was whole opened. By seeingthis my heart missed a beat so I decided that now I don’t want thispiece because now if your Expert engineer Mr.Neeraj would wave amagical wand over it still I don’t want that piece as I will remainunsatisfied all the time riding it, then I asked Mr. Neeraj Vaghelaabout the problem to my surprise he was not knowing the problem hestarted asking Mr. Hitesh about it, Mr. Hitesh instead of telling himthe problem kept on repeating the same thing bike is ok you take it, then i told about the problem of popping and starting to Mr.Vaghelathen he just throttled the bike two three time on the BAY and toldbike is ok pack it and give it to the party, without taking any testdrive by himself as I have discussed earlier bike shows this problemafter running for some time after engine got heated up, how can hetell that even without taking the test drive and his tone was veryharsh towards us he was not ready to listen to any of our problems, Ihave kept the bike over there only as it is and still it’s there I amnot going to take that same piece again. I want new piece so pleasetake my complaint seriously and replace my bike or else my next stepwould be Consumer court. Please do the needful further and change mybike.Out of 12 days from the purchase which was on 12th July 2014 followingday bike was in service center, 1. 18th July 20142. 21st July 20143. 22nd July 20144. 23rd July 20145. 24th July 2014Out of 12 days 5 days bike was with service center and one whole dayin presence of Expert engineer still neither service center nor ExpertEngineer Mr. Neeraj Vaghela was confident enough to tell us that thisproblem will not come again so how can I be confident on this piecenow??????
