Possesion letter without completion of flat
SVP has offered possession letter after 2 years, I personally visited the site to see the overall condition of the entire site and also my allocated flat and would like to bring into your notice the following facts:-
1. The ongoing new tower construction bang in middle of the project is not at all fit for our family especially small kids to live due to dust, labour & material transport and during purchase of the flat the same area was shown as central park in your brochure and an important factor to invest in your project.
2. The entire basic infrastructure like proper connecting roads, electricity, sewerage, water, lifts, club house, parking lots, parks, entrance gate, etc required for any family to shift is not even completed and possession letter is issued.
3. While inspecting my own flat, I was literally shocked to see quality of workmanship and material being used in comparison to what we were clearly promised and we paid for at time of booking the flat and stark contract to the Sample flat we were showcased. I would like to mention the clearly visible discrepancies:-
SVP's Specifications :- Anti skid tiles from Kajaria
Currently Fitted / Status:- Low Quality tiles – Scratches & big cracks already clearly visible.
SVP's Specifications :-Parryware CP in all toilets
Currently Fitted / Status:- Nothing installed and we don’t even know which brand going to be installed.
SVP's Specifications:- Skin Molded Hardwood frames doors from Masonite, Canada
Currently Fitted / Status:- Low quality door from Orion, Noida based company is being installed and already hinges are coming out.
SVP's Specifications :-Wooden flooring in master bedroom from Pergo-West Germany.
Currently Fitted / Status:-Wooden texture tiles are provided which are already cracked.
SVP's Specifications :-Schneider Electric fittings.
Currently Fitted / Status:- Electrical fitting from Prokon, Noida based company is being installed which we never heard and used.
SVP's Specifications:- Power coated Aluminum windows with clear glass shutters
Currently Fitted / Status:-Ordinary low quality plyboard windows with very thin grade 3 glass fitting.
SVP's Specifications:-Concrete ceiling in bathroom
Currently Fitted / Status:-False ceiling installed which already started coming and badly fitted.
4. Only one lift is installed in the tower and that too not tested as their in no electricity and the other list
is still not installed.
5. The main 45 Mts road still not constructed and the boundary of walls closed currently so all material
and transit for Krishan Garden project would be through our project as there is no separate entrance
for them.
6. As per government guidelines we require completion certificate from builder before taking final
Possession and GDA officials also confirmed us the same but no mention of the same.
7. The project has got delayed by more than 2 years and no mention of penalty charges as per user
agreement.
How can builder issue possession letter with all above critical issue unaddressed and asking us to pay balance payment immediately.
