That being allured by the advertisements and claims made on the internet by Amazon.in on its website, I placed an order for purchasing a Samsung Galaxy M21 mobile phone, on Amazon.in vide order dated 29/07/2020, invoice dated 29/07/2020, bearing Order[protected] for a total consideration of Rs. 13999/- including VAT and other taxes.
That the said phone/device was delivered to the Complainant upon payment of full amount above mentioned.
It is submitted that as the I started using the said mobile phone, I realised that the said phone purchased by me was not functioning as per the my expectations and it appeared that said phone was faulty and defective.
That since I began to use the said phone upon purchase, I started experiencing deficiency in performance/service of the said device and realised that the camera and video were not properly functioning.
That I also realised that pictures taken by the complainant and videos which were shot on the said device would be automatically deleted and yesterday the phone/device started blinking automatically and it became fully white.
That being aggrieved by the said dysfunctional device, I submitted the said device to the local Samsung Customer Service at Ponda Goa for testing and for repair on 05/10/2020.
That upon submitting the said device to the above service Centre, the service personnel informed the me that the LCD of the said device is damaged and the same had to be replaced and the same was reason for the problems experienced in performance of the said device. he also informed me that the damaged LCD is not covered under warranty.
That the Service provider dint even check the device properly and declared that LCD has damaged. I am totally disappointed by the sheer negligence on part of the Service Centre and agreed to repair the same.
It is submitted that due to the poor quality performance of the said device, I have suffered physical and mental agony, and has experienced additional financial losses due to visits that had to be undertaken to service centers inspite of paying and effecting the full amount while purchasing the said device.
It is submitted that the Complainant being utterly disappointed, disgusted and exhausted by the negligent and careless attitude displayed by Samsung, the complainant requests the Samsung Customer Support team to provide the Complainant with a new handset in exchange for the said device under repair as the said device was still under Seller warranty or alternatively refund the amount of Rs.13999/-
