Activa Home Appliances — Complaint Against Activa Fan Company for Deficiency in Service and Unfair Warranty Practices

I am writing to lodge a formal complaint against Activa Fan Company for deficiency in service, unfair trade practices, and mental harassment due to their poor handling of warranty service.

Product Details:

• Purchased From: Amazon.in
• Date of Purchase: 16.07.2024
• Warranty Offered: 2 years (mentioned at time of purchase)
• Place of Residence: Kolkata, West Bengal



Chronology of Events:
1. Fan stopped working within the first year of purchase, well within the warranty period.
2. I contacted Activa customer support. They refused to provide pickup service, stating that their only service center is in Delhi. I was given two options:
• Personally take the fan to Delhi.
• Send it via courier at my own expense (₹200 from Kolkata to Delhi).
3. When I declined to courier it at my own cost, they offered ₹150 to get it repaired locally. However, upon inquiry, local electricians estimated the repair cost to be ₹450.
4. Reluctantly, I decided not to argue over ₹200 and couriered the fan to Delhi at my own cost, expecting a swift resolution.
5. However, the delivery agent reported that Activa’s team did not respond to his calls or accept the package for several days. I was kept waiting during the peak summer season, without a working fan, for nearly a week.
6. Eventually, they accepted the fan and sent a replacement fan the next day.
7. Shockingly, when I received the replacement, the fan was damaged and non-functional. Although the outer box was intact, the unit inside was clearly broken.
8. When I reported the issue, they claimed it must have been damaged during transit and again asked me to courier the fan to Delhi at my own expense for a second replacement.
9. I have now spent significant time, money, and energy dealing with this issue, yet I still do not have a working fan. Activa has refused to arrange a pickup or provide a refund, and I have no confidence that the next replacement won’t also arrive damaged.



My Grievances:
• The company is misusing the warranty policy by placing an unreasonable burden on the consumer (forcing courier to another city).
• Their failure to coordinate with delivery agents led to unnecessary delay and hardship.
• Sending a damaged replacement and refusing a pickup again is unacceptable.
• They have caused mental distress, inconvenience, and financial loss, especially during harsh summer conditions.



Relief Sought:
1. Full refund of the product cost and compensation for courier expenses already incurred.
2. Compensation for mental harassment, delay, and inconvenience caused.
3. Appropriate action against Activa Fan Company for unfair trade practice and warranty fraud.
4. Enforcement of strict consumer protection norms for brands offering impractical service policies.



I request the Consumer Forum to take appropriate action and ensure justice is served.
