We have booked flight tickets to go to bali indonesia from chennai on 25.04.2020 vide booking id: nn[protected] with return tickets (02.05.2020) vide booking id: nn[protected] both the tickets are booked through make my trip for our vacation. The same are attached herewith for your reference.

Due to the prevailing situation in india i. E coronavirus and considering the virus spreading ratio in our country, indian government has advised us not to travel to any country and strictly advised us to avoid non essential travel. Immigration department notification is attached for your reference.

On account of the above, we cannot continue our travel plan as per the tickets booked by us. Since the reasons are beyond our control, we would like to drop our travel on 25th april 2020.

In this regard, i request you to consider that in case of cancellation of tickets from my side, please refund the entire ticket amount without any deduction since the reason for cancellation is beyond our control and as per the advice given by indian government.

Dear Sir/Madam,

I have received the below mail from your end informing about the cancellation of flight. As per your mail, you have given two options i, e ticket amount will be credited to Air Asia account or change the new travel date before 31st October 2020. It is also to be noted that the above tickets are booked through makemytrip.com (Trarvel Agency of Air Asia).

I am not willing to opt the above said two options due to prevailing situation (Covid 2019) and other my personal engagements. Hence I cannot decide my future travel plan now.

Further it is the settled legal position that once the flight is cancelled by Airline, the entire ticket amount to be refunded and you cannot hold my ticket amount in your account.

The Air Aisa has no authority to provide the above said two options. Further I never agreed for the above said options while booking my tickets. You have unilaterally provided the above said options which are beyond the contract terms between the Air Asia and Me which is also against the Law.

It is totally unethical to hold my ticket amount after cancelling flight by the Air Asia.

Therefore I request all of you to provide the entire ticket amount at the earliest, otherwise I will take it to appropriate legal forum against the Air Asia and Make My Trip to recover the above said my ticket amount including interest, compensation etc at your cost.

It is also to be noted that CIVIL AVIATION REQUIREMENTS SECTION 3 – AIR TRANSPORT SERIES‘M’, PART II ISSUE I, DATED 22 May, 2008 vide File No. 23-16/2016-AED, has clearly mentioned that, in case of credit card payments, refund shall be made by the airlines within seven days of the cancellation to the account of credit cardholder. Further it has stated that the option of holding the refund amount in credit shell by the airlines shall be the prerogative of the passenger and not a default practice of the airline.

However the Air Asia, has not responded any thing about the refund and hold my refund amount illegally.
