I, Shreyash Nanaware, an advocate by profession, am writing to file a formal complaint against Amazon India for the undue delay in processing my refund, which has now exceeded 48 days. Despite repeated assurances and promises, Amazon has failed to resolve this issue, causing significant emotional distress, financial losses, and reputational damage. Additionally, Amazon’s refusal to process the refund directly to my bank account and their attempts to force me into accepting a refund via Amazon Pay are manipulative and unfair practices that violate my consumer rights.

• Product Ordered For: My friend’s office (paid for by my friend, Advocate Advait)
2. Incident Timeline and Issues:
• 18th October 2024: I returned the product and requested a refund to my bank account.
• 30th October 2024: Amazon sent a cheque for ₹3, 850 with the incorrect name, Yash Nanaware, which I immediately flagged.
• After multiple communications, Amazon confirmed that the cheque would be cancelled and the refund would be processed after 14 working days.
• 14 working days passed, and when I followed up, Amazon requested an authorization letter. I provided authorisation letter but amazon demanded it in the name of the incorrect person on the cheque. Again I provided in said name. Despite submitting this letter, Amazon continued to provide conflicting information and extended the wait time further.
• Eventually, Amazon offered the refund in Amazon Pay wallet, which I declined, preferring a direct bank refund.
• Amazon then promised in writing (Gmail) that the refund would be credited to my bank account by 4th December 2024. However, even after 4th December and 48 days passed from date of refund process initiated and multiple follow-ups, I still have not received the refund.
3. Harassment and Impact:
The continuous delays have caused significant mental and emotional distress. I had borrowed money from my friend, Advocate Advait, with the understanding that Amazon would honor its commitment to refund me within the promised time frame. I explicitly promised to repay my friend within 14 working days, based on Amazon’s written assurance that the refund would be processed by 4th December 2024.
However, Amazon’s failure to meet their deadline has led to a breakdown of my professional relationship with my friend, Advait, who is also an advocate. He has now accused me of dishonesty and has refused to assist me professionally, which has caused irreparable damage to my reputation and loss of business opportunities. The stress of being wrongly accused of being a cheater has also taken a toll on my mental health and affected my ability to manage my work effectively as an advocate.
Additionally, Amazon’s persistent refusal to issue the refund to my bank account and instead offering it via Amazon Pay appears to be part of a strategy to limit my choices and force me to spend the refund on Amazon purchases. This is both unfair and deceptive.
4. Shipping Address vs. Bank Address:
Amazon has also claimed that the shipping address is different from the bank address and has cited this as a reason for not processing the refund. I would like to clarify that it is not mandatory for the shipping address and bank address to be the same, particularly when I ordered the product for my friend’s office. I can make purchases for others and choose different shipping addresses as per my convenience, and there is no rule or policy requiring the shipping address to match the bank account holder’s address. Amazon’s refusal to process the refund due to this reason is unjust and invalid.
5. Demand for Relief:
Given the 48-day delay, the continuous harassment, and the damage to my personal and professional life, I request the following:
1. Immediate refund of ₹3, 850 to my bank account, as initially promised by Amazon, and not through Amazon Pay.
2. Compensation of ₹10, 00, 000 for the emotional distress, financial loss, reputational damage, and loss of professional opportunities caused by Amazon’s actions.
3. Reimbursement of any legal expenses incurred in pursuing this matter.
4. Appropriate action against Amazon for their negligence, failure to comply with their refund policy, and deceptive practices.
6. Legal Proceeding:
Amazon’s own refund policy clearly states that refunds should be processed within 7 working days, yet after 48 days, I am still awaiting the refund. Furthermore, Amazon’s offer to refund only via Amazon Pay rather than directly to my bank account is an unfair and manipulative tactic to limit how I can use my refund.
I request your urgent intervention to ensure that this matter is resolved quickly and justly.
