Subject: Legal Notice.
Sir,
Under the instructions and authority of my client Sh.Amit Goyal son of Late Sh. Mohan Lal, resident of VPO Balbera, Tehsil & District Patiala, I hereby serve upon you with the following legal notice as under:-
That my client is having a Credit Card of addressee No.3 Bharat Pe (Visa) No. [protected]. My client has linked his Bharat Pe Credit Card with PayZapp mobile app having registered no. [protected] with addressee No.1, from where, my client operates his financial transactions through the said app. The said PayZapp mobile app is being run by HDFC Bank.
That recently on 03.05.2022, my client did a transaction of Rs.4500/- through PayZapp (addressee No.1) by scanning bar Code of Jass Electronics who has TID No. 60594181, registered mobile No. [protected] with HDFC Bank vide Transaction ID[protected]fR82oP6. However, to the utter shock, the said amount was debited from bank account of my client through Payzapp but it was neither credited in said ID of Jass Electronics but nor refunded to my client.
That thereafter, my client sent various emails and made mobile calls vide which he lodged his complaint, but to utter shock, no response has been given till date nor grievances of my client have been redressed.
That my client has suffered financial loss as the amount was debited from his account but not credited in the account of beneficiary. Rather, my client has to suffer additional burden by paying the amount from his own pocket.
That despite number of requests and emails, you did not pay heed to requests of my client and nor did any needful in the matter.
That there is clear cut deficiency in service and unfair trade practice on your part. You have made my client as a scapegoat for your monetary gains and to cause wrongful loss to my client. For which, you are also liable to pay compensation to my client.
So, through this notice, you are hereby called upon to refund the amount of Rs.4500/- and to pay compensation to the tune of Rs.50, 000/- and cost of legal notice as Rs.2200/- within the period of 15 days, failing which my client shall be constrained to initiate legal proceedings against you in the competent court of jurisdiction, in that event you shall be liable or responsible for all the costs of litigation, so incurred by my client in this behalf.
